Heading back to DC after a overnight trip to Cleveland for a court hearing today. Judge Jeremy Santoro granted case and no appeal. He told he was was surprised as usually hearings are so contested by ACCs and can last 2-4 days and that was why he was pushing so hard for me to agree to dismiss.
That is just totally ridiculous waste of time.
Hard part is the 8 hours of waiting for flight back to DC!
Today I was able at very short notice ( one day) to go to Frankfurt Consulate at 7:00 am It a huge compound of rather ugly looking buildings with heavy security gates around it.
Although they were closed to public today, They expected me and gave me an emergency purple
passport within 15 mins. I was surprised at how helpful they were. It was eerie being in the huge hall that was empty except for the window 22 that was open just for me and then walking up to another floor of more empty corridors. All this they did just so I could get back today and speak tomorrow at the MD Bar Conference! Apparently the building was given to US as reparations after WW2 and was a former hospital
The only down side is that i got double checked in Germany leaving and even entering with my global.
Giving a presentation Friday night was worth it is helps
others.
Alexandria City school GALA to fund student college Scholarships was a big success
Thank you Jean!

House Democrats have introduced legislation to designate Cameroon for temporary protected status (TPS) while simultaneously calling for executive action to protect Cameroonians from being removed into armed conflicts back home.
"The Biden administration will continue to prioritize the arrest and deportation of immigrants who pose a threat to national security and public safety and those who recently crossed a border illegally into the United States. (ICE) officers should not attempt to arrest and deport farmworkers, the elderly and others who were vulnerable to deportation under the Trump administration, which allowed agents to arrest anyone in the United States illegally. Agents should avoid detaining immigrants who land on their radar because they spoke out against “unscrupulous” landlords or employers, or at public demonstrations. The new rules take effect Nov. 29"
DHS issues new arrest and deportation guidelines to immigration agents The guidelines prioritize the deportation of immigrants who pose a threat to national security or public safety.
“Both houses of Congress included plans to expand residency for some undocumented immigrants in a $3.5 trillion budget blueprint passed last month. “

Today President Biden issued a memorandum directing the Department of Homeland Security to take appropriate measures to defer for 18 months the removal for Hong Kong residents presently in the United States. This decision to offer safety and protection to these individuals was made based on the ongoing assault on democracy, and rights and freedoms in Hong Kong by the People's Republic of China (PRC).
Good news!!! DHS today announced extensions of the registration periods from 180 days to 18 months for initial (new) applicants for TPS under designations of Venezuela and Burma, and redesignation of Syria!
USCIS announced the opening of a new asylum office in Tampa, Florida on August 2, 2021, in response to an increasing asylum workload in Florida. This is the 11th asylum office in the country and the second in Florida. The Tampa and Miami asylum offices will divide the state’s asylum workload.
U.S. Immigration and Customs Enforcement (ICE) keeps making an inexcusable error: it has been deporting U.S. citizens by mistake.70 potential U.S. citizens were deported between 2015 and 2020, a recent report from the Government Accountability Office concluded.

Attorney General Vacates Matter of A-C-A-A-
The attorney general vacated Matter of A-C-A-A- in its entirety and remanded this matter to the Board for further proceedings consistent with this opinion and with the opinions in A-B- III and L-E-A- III. Matter of A-C-A-A-, 28 I&N Dec. 351 (A.G. 2021)
The decision states:
(1)Matter of A-C-A-A-, 28 I&N Dec. 84 (A.G. 2020) (“A-C-A-A- I”), is vacated in it sentirety. Immigration judges and the Board should no longer follow A-C-A-A- I in pending or future cases and should conduct proceedings consistent with this opinion and the opinions in Matter of L-E-A-, 28 I&N Dec. 304 (A.G. 2021) (“L-E-A- III”), and Matter of A-B-, 28 I&N Dec. 307 (A.G. 2021) (“A-B- III”).
(2)The Board’s longstanding review practices that A-C-A-A- I apparently prohibited, including its case-by-case discretion to rely on immigration court stipulations, are restored.
Today the Attorney General issued two decisions vacating decisions of the previous administration that attempted to significantly restrict asylum eligibility.
In Matter of L-E-A-, the Attorney General vacated a previous decision calling into question the viability of family as a particular social group. The new decision “return(s) the immigration system to the preexisting state of affairs pending completion of the ongoing rulemaking process….” It supports the recognition of family as a particular social group.
In Matter of A-B-, the Attorney General vacated previous decisions calling into question the availability of asylum relief for victims of domestic violence or involving private conduct generally. The new decision also returns the law to the preexisting state prior to the previous administration’s ruling. It instructs that “pending rulemaking, immigration judges and the Board should follow pre A-B- 1 precedent, including Matter of A-R-C-G-.” Matter of A-R-C-G- recognized “married women in Guatemala who are unable to leave their relationship” as a cognizable particular social group.
