Conducting a workplace investigation as part of a disciplinary is critical; if the disciplinary process leads to a dismissal, the investigation and whether this was carried out sufficiently can determine whether the dismissal was fair.

In some instances, employers do not have the resources available to conduct investigations and they may decide to outsource their investigation process. Employers may also outsource this process due to internal conflict.

Preventing Sexual Harassment in the Workplace | Nockolds 08/04/2024

Under the current Worker Protection Act 2023, there is a duty on employers to take reasonable steps in preventing sexual harassment in respect of their employees during the course of employment. From October 2024, there are changes to The Worker Protection Act 2023. The changes will put more responsibility on employers to prevent sexual harassment in the workplace.
