You don't have to comply with a police request but you must comply with police commands. “Consent” is often a police officer’s only lawful option to support a search. Whether the police ask to search your home, your vehicle, or your pockets, don’t consent. If the police ask for your permission, they probably have no other legal basis for the search.
“Negligence” means “unreasonable carelessness.” More specifically, “negligence” means acting with unreasonable carelessness or failing to act the way a reasonably careful person would.

The “reserve” is the amount of money the insurance company has set aside (or “reserved”) to settle a claim. A reserve is established at the outset of a claim, but it can be (and often is) adjusted and re-set as new information about the claim becomes available (through your medical records, witness interviews, the police report, etc.).
The “statute of limitations” is the time limit for filing a lawsuit for a particular injury or wrong. This is important to know because, because the statute of limitations is a hard deadline. With few exceptions, if you miss the deadline to file suit, that opportunity is lost forever. Insurance companies know this, and it gives them even more incentive to delay settling a claim.
“Tort” is the legal term for any wrong that is unrelated to a contract or contractual relationship. A personal injury action, for example, is a tort because it arises out of negligence, not a breach of a contractual relationship.
Before you decide to plead guilty, you need to consider all the potential consequences of that decision. A guilty plea may have unintended ramifications, wholly apart from the sentence imposed by the judge. Depending on the facts of your case and your personal situation, a guilty plea may result in one or more of seven significant collateral consequences.

In a personal injury case, “damages” has two meanings: (1) the harm you have suffered as a result of the injury accident, including economic harm (e.g., medical bills, lost wages) and non-economic harm (e.g., physical, mental, and emotional pain and suffering); and (2) the sum of money you may be awarded in a personal injury lawsuit.
Comparative negligence is a defense to a personal injury claim. It is a way to apportion (compare) fault and measure each party’s legal responsibility for the accident and its consequences.

If you've been in an injury accident, don't let the insurance claims adjuster for the other party stonewall you. "Stonewalling" is a negotiating technique used by insurance claims adjusters. It is a deliberate, calculated effort to delay settling your personal injury claim. We explore the different ways adjusters try to use this technique against you.
The criminal justice system is a collection of individuals and agencies working together to fight crime on the streets and dispense justice in the courtroom. When you are arrested, this big and powerful system goes to work against you, in an effort to obtain a criminal conviction. Having an experienced criminal defense attorney on your side – one who understands the system, knows the (written and unwritten) rules, and speaks the language of the prosecutor – will help to level the playing field.
The police are knocking at your door. Do you know what to do? Do you know your rights? In the American criminal justice system there is a long and solemn tradition of respecting the privacy of a person’s home. Law enforcement agents are not allowed to enter your home to conduct a search or make an arrest unless they have a valid warrant. But what should you do if the police show up without a warrant?
If you want to boost the settlement value of your personal injury case, keep an injury journal, which you can use to log the impact of injuries from your accident on your daily life.
In a personal injury case, if you can’t prove it, you can’t recover compensation for it. So, the more evidence you have of the harm you have suffered (or, in legal terms, your “damages”) the stronger your case will be. Here are 6 things you can do to build a strong damages case:
You might be a target for insurance company surveillance if some common "red flags" apply to you or your claim.

To recover the full value of the harm done to you in a personal injury accident, you and your lawyer must present reliable evidence of your losses. Neither the insurance company nor the court will simply take your word for it. The best and most efficient way to gather the evidence you will need to prove your damages is to keep good records. Here are three record-keeping tips you can implement starting today.

If you are involved in an injury accident, it won’t be long before the insurance company for the person or entity who caused your injuries reaches out to you. If you have been charged with a criminal offense, you may be offered a plea bargain that includes a sentence of probation, in lieu of jail time. While you may be immensely relieved by this offer, it is important that you understand the hard reality of probation before you enter into this agreement and your sentence begins. Most defendants have no idea how difficult it can be to successfully complete probation.

If you ever have watched a television crime drama or taken a high school civics class, then you probably know that the Fourth Amendment to the United States Constitution prohibits unreasonable searches and seizures by the government. The general rule is that law enforcement must have a warrant – written permission from a judge – to search or seize any place or thing in which you have “reasonable expectation of privacy.”
Respect and Safety go well together.
