With the increase in expenses, credit cards are becoming a common form of payment. However, this comes at great expense to the borrower. A card is considered "maxed out" once it reaches its credit limit - this applies to all sectors, and ages, of the population. Specifically, Gen Xers are maxed out at a rate of 15.3%, 12.1% for Millennials and Boomers are at a low 4.8%. This doesn't mean Boomers are more responsible, they just have higher credit limits which impact the percentages (for Gen Z credit limits average $4,500.00 vs $22,000.00 for Boomers). Throughout all age groups, credit cards are 8.9% 90 days delinquent, or more. This is the highest since 2011. Here are some little known facts about debt settlement:
If using an agency, your monthly fee to the provider includes a significant "servicing" fee that does not get applied to your debt.
The debts are not actually settled until enough money accrues to pay a single card. During this time, the debt will go into collection and you are subject to civil litigation.
The vast majority of creditors will only accept a single lump-sum payment as settlement.
Any "forgiven" debt will be considered earned income and you will be sent a 1099. This MUST be declared on your tax return.

An individual can certainly file without their spouse on their own debts. If a debt is in both names, and only one spouse files, the automatic stay would protect both during the bankruptcy (for example, to stop a foreclosure). However, the non-filing spouse would ultimately remain responsible on the joint debt. Keep in mind that even if only one spouse files, the bankruptcy code still requires that income for the entire household be reported.
