REMINDER: PAIA Report Deadline - 30 June 2024

Attention all private and public entities: The deadline for submitting your report on all requests for access to information, as mandated by the Promotion of Access to Information Act 2 of 2000 (“PAIA”), is rapidly approaching. This mandatory report must be submitted by 30 June 2024.

The submission of the PAIA report is compulsory for both public and private entities. Failure to comply with this requirement could result in penalties or legal consequences.

The Promotion of Access to Information Act (PAIA) allows for access to information by both natural and juristic persons, as guaranteed in the Constitution. The Information Regulator has a responsibility to monitor compliance with PAIA by both public and private bodies, which involves getting private and public bodies to report to the Information Regulator.

The Information Regulator recently issued a notice which requires all public and private bodies to report on requests for access to information that they received and processed in the 2023/2024 financial year.

This is to comply with certain sections of the Promotion of Access to Information Act (PAIA) which require Information Officers of public and private bodies, respectively, to submit such reports to the Information Regulator.

Pursuant to the Employment Equity Act, designated employers must develop and implement their Employment Equity Plans effectively.

The Compensation for Occupational Injuries and Diseases Act (COIDA) is a crucial aspect in the realm of employer responsibilities, with the annual procedure known as Return of Earnings at its core. Employment and Labour Minister TW Nxesi announced that the National Minimum Wage (NMW) for each ordinary hour worked will increase to R27.58 with effect from 01 March 2024.

Should an employer unilaterally change wages, hours of work, or other conditions of employment in connection with the implementation of the national minimum wage, it would be deemed an unfair labour practice. An employer may also be required to reimburse an employee retrospectively for a period of non-compliance. A fine may be imposed on an employer who pays an employee less than the National Minimum Wage as stated in section 76A (1) BCEA.
