Woman sold the wrong house wants more regulation of property transactions 12/09/2024

You may have read the recent story about Queenslander Kay Van Pelt, who sold her property on the Gold Coast and relocated to Hervey Bay. Her move turned into a nightmare when she discovered she had been registered as the owner of the wrong property. Instead of acquiring the townhouse she had purchased, she found herself legally responsible for the neighbouring house - one she had never agreed to buy. She owned one property but was living in another.

The mix-up became apparent when Ms. Van Pelt received a letter from the council informing her of significant outstanding rates on the neighbouring property. Confused, she realised a paperwork error had resulted in her owning the wrong house. Despite alerting the law firm handling her settlement, she claims the mistake was not corrected before the sale was finalised.

Irrespective of who was to blame for the error, and it not being corrected before registration, Ms. Van Pelt’s experience highlights the importance of accuracy in conveyancing and the need for greater scrutiny in property transactions. In Queensland, where conveyancers are not licensed and solicitors sign off on the work, issues like this have the potential to arise more easily than in states that are more highly regulated.

Australian Institute of Conveyancers president Michelle Hendry noted that with less regulation in the state, the pressure to complete transactions at a low cost can lead to errors.

Ms. Van Pelt’s ordeal demonstrates the importance of choosing qualified legal professionals who prioritise accuracy over speed or cost-cutting measures. It’s important to engage your conveyancer early in the process, rather than treating that part of the buying process as an afterthought. While it might be tempting to choose the cheapest option, the long-term consequences of a conveyancing error can far outweigh any initial savings.

Ultimately, buying a home is a major financial decision, and it pays to invest in the best guidance to ensure the process is handled correctly from start to finish.
