A Granville-based bricklaying company and its director have been fined $90,000 after one of its workers suffered from electric shock at a construction in 2012, bringing total fines for the incident to almost three-quarters of a million dollars.
The company and its director have been convicted after a 26-year-old bricklayer suffered serious electric shock injuries when he made contact with overhead power lines while installing vertical metal bars into brickwork at a residential and commercial construction site in Hammondville in April 2012.The worker was initially pronounced dead at the scene but was later on revived. He suffered electrical burns to his hands, arms, and torso.
SafeWork NSW charged the company for failing to comply with its duty under section 19 (1) of the Work Health and Safety Act 2011 (NSW). Its Director was charged for failing to comply with his duty under section 27 of the Act. Both were found guilty in the District Court.
The court found that the Director of the bricklaying company failed to exercise due diligence by not ensuring that the scaffold was a safe distance from power lines and verifying that a risk assessment had been conducted.
“There was a clear risk that the bricklayer could receive a potentially deadly electric shock if they came into contact with the power lines while working from the scaffolding,” said Executive Director of SafeWork NSW Peter Dunphy.
“The Director should have verified that a safety assessment had been conducted, ensured the scaffolding was a safe distance from power lines and advised the bricklayer of the risk.
“Unfortunately, this did not occur and the bricklayer almost died in an incident that completely preventable,” he said.
“Fines from this incident now total almost three-quarters of a million dollars, serving as a strong deterrent to those in the construction industry thinking about ignoring safety laws.”

Police have charged 15 drivers with drink and drug driving offences during a traffic operation on the Sunshine Coast overnight.
Sunshine Coast police coordinated Operation Lasso 27 involving officers from the Sunshine Coast, Road Policing Command, Brisbane Dog Squad, Moreton Tactical Crime Squad, the Department of Transport and Main Roads and the Department of Fisheries.
A total of 1870 random breath tests (RBTs) and 32 targeted drug driving tests were carried out during the operation at Beerburrum on the Bruce Highway between 7pm last night and 1am this morning.
Two drivers were caught drink driving with readings of .115 per cent and .086 per cent, while of the 32 drivers tested for drugs 13 people were charged with drug driving.
As part of the operation, two men aged 26 and 27 were charged with possessing dangerous drugs. Both are expected to appear in Maroochydore Magistrates Court later this month
Sunshine Coast District Inspector Jason Overland said the significant number of drug drivers endangering other motorists was alarming.
“It was certainly disturbing to see 13 drivers getting behind the wheel of a vehicle while under the influence of drugs,” Inspector Overland said.
“Drivers must realise that they have a responsibility for not just their own safety or their passengers but for every other road user.”

Police are disappointed with the behaviour of some road users following an intelligence led policing operation in the Sunshine Coast on Friday and Saturday night.
Sunshine Coast Police with assistance from Road Policing Command, Tactical Crime Squad, Drug Testing Unit and Department of Transport and Main Roads conducted approximately 2,100 random breath tests at Minyama, Beerwah and Maleny over the two nights.
The collaborative approach resulted in the detection of nine drink drivers, ten drug drivers, two unlicensed drivers, six supply dangerous drugs charges and three possess dangerous drugs charges.
There were also multiple traffic infringements notices issued, along with 37 defective vehicle notices and seven defective vehicle infringement notices.
Of particular concern to police was the reckless conduct displayed by inexperienced drivers, with one P-plate driver detected driving at 150km/hr in an 80km/hr zone on Steve Irwin Way. This resulted in the driver receiving a $1,099 fine with eight demerit points and a six month driver’s licence suspension. Police also intercepted two unaccompanied learner-drivers, one driving with a suspended licence, the other returning an alcohol reading of 0.122%.
Sunshine Coast Police Inspector, Jason Overland expressed disappointed with the behaviour of road users who continue to place the safety of road users at risk. “In line with current trends there were more drug affected drivers than drink drivers detected during the operation. Maroochydore Police Officer in Charge Gavin Marsh is once again disappointed in the number of offences detected from the weekend Operation Castnet.
Brisbane based units including the Roadside Drug Testing Unit, Road Policing Taskforce, Drug Detection Dog Unit and Transport Inspectors joined local officers in this large scale operation targeting Fatal Five offences in and around entertainment precincts.

“Police continually run these types operations so we are aware that high numbers of motorists still continue to drive whilst under the influence of alcohol or drugs,” Senior Sergeant Gavin Marsh said.
Police had earlier distributed over 800 pamphlets in and around Maroochydore warning motorists about the risks associated with drink driving as part of a road safety initiative.
Another concerning discovery was the interception of a learner driver who tested positive for a drink driving offence. Worse still was that the person accompanying the learner driver was also over the limit. Imagine the shock to police when they saw the ‘Don’t drink and drive’ pamphlet distributed earlier still attached to the windscreen.
This driver was one of 17 drink drivers, plus an additional 13 drug driving offenders caught over the Friday and Saturday night operation. The overall results were 3131 drivers tested along with 17 traffic infringement notices issued.

Police seized a large quantity of drugs following a search warrant in Cooroy yesterday afternoon.
At about 2pm on Thursday February 18, members from the Sunshine Coast Tactical Crime Squad and Cooroy Police attended a premises near Cooroy and executed a search warrant during which 195 cannabis plants were located along with a quantity of cannabis being dried for processing.
A 62-year-old Cooroy woman is to appear in the Noosa Heads Magistrates Court on Tuesday March 29 charged with possession of dangerous drugs and production charges.
Police encourage members of the community to report suspicious behaviour that may be linked to illegal drug activity as this information assists police in their investigations and can help solve drug related crime.
