What is noise induced hearing loss and when should you seek legal advice? | DBH Lawyers 04/06/2024

❓I think my hearing loss is a result of my work — what can I do?

According to the federal government, around 1.3 million people in Australia have a hearing impairment because of their work.

However, in many of these cases, hearing loss induced by workplace conditions only becomes apparent once someone has left a high-risk job or has retired.

Even in this scenario, you may still be entitled to compensation.

If you think your current or past work environment has caused your hearing issues, we recommend that you see us for legal advice as soon as possible.

Unsuspecting Fleurieu homeowners, like the O'Connell family featured in this article today were unknowingly sold road base by FRWA that contained asbestos.

In total, around 150 Fleurieu Peninsula families have received notification from the EPA that building material used in their homes contains asbestos.

Our team at DBH Lawyers is instigating a representative action against FRWA on behalf of these first homebuyers, retirees and others who have seen impacted.

❓Are both mothers and babies entitled to claim in the case of birth injury?

South Australia has recently seen some very large sums paid in compensation in cases involving birth injuries.

There are a number of different circumstances under which birth injury compensation can be paid. In the case of babies, these can include brain related injuries, physical injuries, or injuries related to infections.

However, mothers too may also be entitled to compensation, which could be either physical or psychological.

Unfortunately, these sorts of cases can be long, complex and expensive. This is why it is important to engage a law firm like DBH that specialises in medical negligence rather than a generalist, as we have the experience, resources and commitment to handle lengthy cases.

How birth injuries can be the result of what happens during pregnancy

Some birth injuries are the result of actions taken during pregnancy, rather than mistakes made at the moment when a baby is being delivered. This was the case for a boy who we acted for, whose mother was concerned about her baby’s lack of movement, but no action was taken by the midwife who owed her a duty of care.

In this article, DBH Partner Peter Jackson examines the way in which medical negligence can result from healthcare professionals not providing adequate advice, or taking action when it is needed.

Multiple SA homeowners caught in asbestos contamination fears 20/05/2024

Thank you to The Advertiser for highlighting our client’s pursuit of justice against Fleurieu Regional Waste Authority.

Unsuspecting homeowners, like the Varacalli family below, were unknowingly sold road base by FRWA that contained asbestos. They have been left out of pocket to the tune of $180,000, and after three years have still not been able to move into what they hoped would be their dream home (subscribers can click on the link to read more).

❓Can I claim workers’ compensation if I am not an employee?

The legislation in South Australia regarding workers compensation says that only employees and genuine independent contractors in prescribed industries are entitled to claim compensation when injured at work.

However, this does not exclude labour hire workers from being able to claim compensation.

If you are engaged by a business that provides labour hire to other organisations, and are injured at work, you should be covered by the insurance of the hire company.

We specialise in workplace and employment law, and regularly represent labour hire workers who have suffered workplace injuries.

If you have any questions about the compensation to which you might be entitled, get in touch with DBH’s employment law specialists.

How medical negligence can result from what is not done

Medical negligence is not always the result of actions taken by medical staff — it can also be the result of inaction, or a failure to act, by medical professionals.

In this article, DBH Partner Peter Jackson examines a case where failure to act on the part of two GPs led to our client suffering catastrophic birth injuries that will require round the clock for the rest of his life.

❓Is No Win, No Fee a good solution for me?

The provision of No Win, No Fee legal services is crucial because it facilitates greater access to the legal system for all.

This is especially important in the sort of complex, lengthy cases that we are very often involved in at DBH, such as birth injuries, which can only be fought on this basis.

Likewise, these sorts of cases can really only be fought by a law firm that specialises in this area, and which has the resources and commitment to meet the costs until compensation is awarded.
