CAN PROPERTY RENTAL PRICES BE REGULATED? A question that often comes up in Real Estate and Property Development is with regards to cost of rent. In this month's YouTube installment Chedza asked, "Is it time to have a regulation framework?" This is a really important question that touches on some complex issues and here are my thoughts on it: Ideally, government intervention in the housing market would aim to control rental prices and protect tenants from excessive rent increases. It’s important, however, to note that while it can provide some benefits, such as preventing displacement and stabilising communities, it can also create distortions in the market, such as reducing incentives for landlords to maintain properties. Given the challenges associated with rent regulation, it's important to carefully consider whether it would be an effective tool in Botswana's housing market. One important factor to consider is the availability of affordable housing. If there is a shortage of affordable housing, rent regulation may be necessary to prevent displacement and protect vulnerable tenants. If Botswana decides to pursue rent regulation, there are a few potential approaches: 1. Rent control: This involves setting a maximum rent that landlords can charge for a specific type of property or tenant. 2. Rent stabilisation: This involves setting a maximum rent increase for a specific type of property or tenant, typically tied to inflation or another index. 3. Vacancy decontrol: This allows landlords to reset rents to market rates when a unit becomes vacant, which can encourage investment in rental properties. Upon the likelihood of the implementation of this regulation my answer would be it would definitely require significant political will and resources to implement and enforce. In Botswana, we have faced great challenges in terms of bogus or unqualified people posing as agents: this is problematic because real estate involves complex transactions such as legal and financial processes, therefore if the agent is unqualified they may obviously lack necessary skills to navigate these complexities and all these may lead to costly mistakes for the client. According to the law of Botswana, there are strict legal and ethical standards and regulations. Unqualified agents may expose clients to legal and financial risks.
