Today we are giving you a quick rundown on Dower Rights. - Dower rights protect the spouse of a registered owner of real property (house or land). The Dower act requires the spouse who is not on title to consent to any selling of land. - Dower only applies if you are actually married, Common law relationships do not have the same protection. If the sole person in title is legally married, then dower rights apply. - There is a BIG misconception that because one spouse may need to sign off on dower that they are entitled to a portion of the money from the sale proceeds, that is incorrect. Today we are discussing the importance of a larger deposit cheque. - A deposit cheque (usually a bank draft or certified cheque) is held in trust with the listing real estate brokerage unless otherwise agreed upon and becomes part of the purchase contract. - The deposit cheque that is held in trust stays in the listing brokerages trust account until the deal is firm or until the deal collapses. Once a deal is firm (all conditions have been lifted) the money is then transferred to the sellers lawyers trust account which becomes part of the money owing towards the purchase price. If the conditions aren’t for the purchase contract the money is returned back to the purchasers within 2-5 business days. - Once a deal has gone firm the deposit now becomes collateral or an insurance that the purchaser(s) will not walk away from the deal or they forfeit the deposit to the sellers.
