This was the harsh reality that Palestinian citizen of Israel, Gosh, faced when he applied for permanent residency in Canada after being convicted of assault and dangerous driving back in 2006. Despite providing ample evidence of his rehabilitation, he was deemed inadmissible due to serious criminality and lost his permanent resident status.
Gosh was not ready to give up just yet, so he applied for permanent residency on humanitarian and compassionate (H&C) grounds in 2020. He hoped that his rehabilitation efforts would be enough to convince the immigration officer to grant him an exemption. Unfortunately, his application was refused, and Gosh found himself in a difficult situation.
But Gosh did not give up hope. He decided to take the matter to court, where the Federal Court ruled in his favor. The court found that the immigration officer had made an unreasonable decision in refusing Gosh's application, as he had not properly considered the evidence of Gosh's rehabilitation.

Canadian Immigration Strike 2023: Impact on Applicants
The Public Service Alliance of Canada (PSAC), a union that represents over 155,000 public servants in Canada, commenced a strike on April 19th, 2023. This labor action is one of the largest in Canadian history and will affect several public services in Canada, including Immigration Refugees and Citizenship Canada (IRCC). Due to this ongoing strike, there will be significant disruptions to Canada's immigration system, and processing times for various immigration applications will be delayed.
The IRCC Client Support Centre is experiencing service delays, and response times will be longer than usual. Additionally, the IRCC webform is experiencing delays, so applicants should expect delayed responses to their queries.
IRCC agents working in international offices are still processing applications that they can during the strike, with a priority on emergency situations where a person's life may be at risk. However, delays are expected, and the length of delays will depend on the nature of the work stoppage.
Applicants can still apply online or mail applications to IRCC during the strike. However, processing times will be slower than usual, including delays in the collection of biometrics. Foreign nationals who apply for a visitor visa, a work or study permit (excluding United States nationals), permanent residence, or refugee or asylum status are required to submit biometric data (fingerprints and a photograph). Any application without biometrics will be considered incomplete and may be rejected when IRCC resumes processing applications at normal service levels.
Furthermore, settlement services offered by non-governmental organizations are still available. These include settlement services from IRCC partner organizations, healthcare through the Interim Federal Health Program, and visa application centers outside of Canada. However, some citizenship events scheduled during the strike will be rescheduled, and urgent applications may still be processed.
Clients in Canada with immigration-related appointments will be contacted by IRCC to re-schedule or cancel appointments. However, during the strike, Service Canada is only processing domestic passport applications for emergency and humanitarian situations, and passport services are available only at specialized passport sites. If you are abroad and require consular or passport services, expect delays.
Applicants who have applied for citizenship grant, permanent resident family class, Express Entry, study permit, work permit, and temporary resident visa can still access their online self-serve tools for application status tracking.
The PSAC is seeking fair wages, better work-life balance, more workplace inclusivity, and reduced layoffs through the creation of more jobs rather than contracting positions to private organizations. One of the key issues is that Union members want to continue to work remotely. Throughout the COVID-19 pandemic, 75% of PSAC members moved to remote work (working from home). The PSAC says public service workers were as effective working remotely as when they were in the office and that 90% of workers want to continue working remotely. They are also seeking a wage increase that better reflects the high cost of living in Canada as interest rates remain high, and inflation is higher than the Bank of Canada's targeted 2% per year.
In conclusion, the ongoing strike by PSAC will have significant implications for Canada's immigration system. Applicants should expect delays in processing times, longer response times from the IRCC Client Support Centre and the IRCC webform, and disruptions in accessing certain services such as passport applications and citizenship events.
