You were asked to vote and here are the results. 33% voted that your REALTOR® never mentioned gratuity or Bird Dog Fee. 33% voted that you did not know about and 33% voted I expect to receive a gift. Nobody voted that it was all verbal.
Gratuity or Bird Dog Fee in a real estate transaction is prohibited unless you are a client of a brokerage and it is specified in the Buyer Representation Agreement (BRA) or Seller Representation Agreement (SRA). The brokerage is obligated to issue T4 Tax Slips to the client receiving the funds. That income must be reported to CRA in your T1 General. Similarly, a referral fee is not allowed for unregistered persons unless the recipient is a licensed practitioner in real estate by RECO. All compensation arrangement between brokerages and clients needs to be documented so that disbursement made is reported to CRA and is declared in the Income Tax by the recipient.
