In Ontario, the division of property and debts upon divorce is governed by the principle of equalization of net family property. This means that the value of any property that either spouse acquired during the marriage and still exists at the time of separation is to be divided equally, subject to some exceptions. Each spouse calculates their net family property, which is the difference between their property's value at the time of separation and their debts. The spouse with the higher net family property then owes the other spouse half of the difference between their net family properties.
It’s important to note that this process involves only the property acquired during the marriage, not property brought into the marriage, though increases in the value of such property might be shared. Given the complexities of property division, legal guidance is crucial to ensure a fair and equitable division.
