We are so lucky to work with amazing family lawyers who provide legal advice, prepare legal documents and help our clients to finalize their separation and divorce.
As mediators, we do not provide legal advice - so we are very happy when we hear that our clients are working with counsel.
We also love working with family lawyers to facilitate mediations with their clients.

Very often a relationship change results in the sale of the family home and the need to buy another one. However, most people do not plan for divorce, so their financial situation is often not ideal and many people have trouble finding properties and qualifying for mortgages.
We are so lucky to work with mortgage brokers and realtors who specialize in divorce!
Having professionals who know the process specific to divorce is hugely helpful to clients who are going through an enormous change in their lives.

Emotions get so confused and mixed up during relationship change, like a big ball of yarn that is knotted and messy.
We are not qualified counsellors. While we can empathize with our clients' experiences, we do not have the tools to help them work through the emotions that come up.
We always recommend that our clients have a counsellor that they can work with to deal with the emotions and feelings that come up during mediation or other relationship change.
It provides a safe place to work through big feelings and we are so in favor of that!!

This week we are talking about all of the other professions that play a part in a family mediation.
We pride ourselves on knowing enough to know when to call in the professionals and that is so very accurate with anything numerical.
Accountants help in family resolutions by filing tax returns, giving valuations on family businesses, determining how much capital gains is due on sold rental properties and generally giving us all those numbers that we use when dividing family assets or determining support.
Without them, we would be completely lost! We so appreciate accountants for their silent and important contribution to what we do.
If you have your own accountant, we would be happy to work with them. If you don't have an accountant, we will help you find one.

From helping family members decide how they are going to transfer responsibility from one generation to the next to helping beneficiaries who are fighting over how an estate should be distributed.

Last week we spoke about our mediation process - this week, we want to chat about the types of mediations that we offer.
While the bulk of our experience is in the area of family mediation, we also have a wealth of experience in corporate mediations. Some examples include:
1. Partners who want to renegotiate their partnership agreement;
2. A shareholder in a company wants to be bought out and the shareholders are trying to agree on fair market value;
3. Multiple shareholders want to negotiate terms of a shareholder's agreement; or
4. Stakeholders in a small business are trying to come up with a succession plan.
Essentially in any instance where people are in business together and need some help resolving issues - we can help!
Throughout the mediation process, we refer people to professionals that can help them. These referrals are often to counsellors for therapeutic support, financial planners or accountants for financial advice or lawyers for legal advice on issues that come up in mediation.
Once the parties have reached resolution on the outstanding issues, we put those terms into a Memorandum of Understanding.
We then send that Memorandum of Understanding to one party's lawyer to be made into a separation agreement. If our clients don't have lawyers, we introduce them to one of the many amazing family lawyers in town.
We will usually schedule a follow-up call with our clients to check in and see how things are doing - because, well, we really enjoy what we do and who we get to do it with!

Now we mediate!!!
We like to do our mediations in two hour blocks. While we can do all day mediations if requested, we find that two hours is a long time to be working hard at resolution.
We also like to do multiple short mediations as opposed to one long mediation because there are many times that something comes up during mediation that requires further investigation. With multiple short sessions, we can table that topic until the next session and allow the parties to do some research or get further information. We would then circle back to that issue first thing in the next session.
We are virtual, so all of our sessions take place over zoom at this time. We recommend that parties call in separately and in different physical locations.
We recommend our monthly packages which include four 2 hour mediation sessions a month plus unlimited coaching throughout the month. This enables the parties to really get into the issues over a specific time period.
Now that both parties are on board with the mediation process, the next step is the intake process.
We have a detailed intake form that we ask both parties to complete which includes financial disclosure, details on the relationship and information about the children of the relationship. We use this information to guide how our mediation process moves forward. We also use this information to make sure that both parties are providing appropriate financial disclosure.
In addition to the intake form, we also have the parties sign an Agreement to Mediate. This is your agreement to move forward with mediation as well as a commitment to certain behaviors during the process.

STEP ONE - give us a call!
Our first step in any mediated process is to speak with the person (or people) who are interested in mediation. In that first call we discuss your particular situation and determine if mediation is a good option for you.
We have done initial calls with one or both parties. If one party calls us and we determine that mediation would be a good solution, we work with that party to bring the second party into the conversation.
Remember, mediation is voluntary - so this step is essential in making sure that everyone is on board and willing to participate.
