We have not advised on the legal claims made in this petition, but support the efforts of employees to raise awareness about the mistreatment they endured while working at SNFW. Attention Steve Nash Fitness (Freeman) Class Action Members:

We extend our deepest sympathies over the sad news that SNFW has terminated all of its team members through a mass email on March 24, 2020. Like many SNFW employees we have been stunned over this sudden decision. This comes as a particular shock since SNFW management had earlier notified its employees just on March 17, 2020 that the clubs would be closed until March 31st, 2020 and would be offering virtual training and class options during that time.

We understand you may be wondering where this mass termination leaves our current class action. Legally the mass termination has no effect and can still proceed. However, the mass termination requires SNFW to pay notice and will give rise to another action if they fail to do so. Please contact Victory Square Law office at [email protected] or 604-684-8421 so that we can assess whether you have an individual claim or whether you could support a potential class action.

Employees are likely to fall under the following categories of employment contracts which are relevant to your specific notice entitlements. If you still have your employment contract, you can check if you fall under one of the following categories:

1) Employees who have an employment contract that incorporates the Employment Standards Act;

Example contract language:
Termination - The company may terminate employment at any time for cause. Following the probationary period, the company may terminate employment for reasons other than cause by providing the required notice under the Employment
Standards Act of BC. This payment shall constitute the employee's entire entitlement arising from termination. Following termination of employment the employee must return all company property.

2) Employees who do not have any language in their contract limiting or discussing termination pay/severance;

All employees should know that in addition to their contract of employment, they have a right to notice under section 63 and 64 of the Employment Standards Act. If you pursue your right through employment standards, make sure you speak to a lawyer before you sign any release.

Our class action continues to make progress! The Honourable Madam Justice Tucker has been assigned as the Judicial Management and Trial Judge.
