FIDIC joined two significant events hosted by the European Bank for Reconstruction and Development (EBRD) in London, focused on advancing sustainability and collaboration with Multilateral Development Banks (MDBs).

📅 17 September: FIDIC presented its Carbon Management Guidance to the HOPs at the Sustainable Public Procurement Forum. Key discussions led by experts centered on reducing carbon emissions and promoting sustainable practices in global infrastructure projects

📅 20 September: FIDIC President Catherine Karakatsanis and FIDIC General Counsel Daduna Kokhreidze met with the Heads of Procurement to discuss strengthening the FIDIC-MDB collaboration. This important dialogue focused on capacity building, driving sustainable procurement and enhancing infrastructure delivery across the globe.

Both events were hosted by Heads of Procurements held in EBRD’s new sustainable building in London, recognised for its cutting-edge, eco-friendly design.

Session 6: Navigating Conflict Management, Dispute Avoidance, Dispute Boards and Arbitration
This session emphasised the importance of internal company policies and practical tools for early dispute management and settlement facilitation:

✅ Early Warning Systems: Proactively managing risks by implementing early dispute warning systems and internal review mechanisms.
✅ DB Decisions: Compliance with Dispute Board decisions is influenced by financial considerations, reputation and the risk of project delays​.
✅ Mediation Windows: Mediation and settlement windows are most effective when introduced early in arbitration​.

Session 7: Disruption
This session explored disruption in construction projects and how to prove disruption claims successfully:

✅ Clear Documentation: Accurate records are critical to proving loss of productivity and disruption​.
✅ Proving Disruption: Demonstrating a clear link between disruptive events and loss of productivity is essential for a successful claim.
✅ Disruption vs. Delay: Disruption relates to inefficiency and increased costs, while delay impacts the project timeline.

Session 5: Part I – Recent ICC and FIDIC Highlights
This session focused on updates in FIDIC contracts and ICC arbitral awards, as well as best practices for conflict management and dispute avoidance.

✅ Global Reach: FIDIC contracts are used in 170 countries and translated into 28 languages, including Korean.
✅ Construction Leads ICC Cases: about 46% of ICC expert cases from 2018-2023 involved construction.
✅ Dispute Avoidance: FIDIC's new Practice Note aims to prevent disputes and improve resolution through Dispute Boards.

Session 5: Part II – Application of FIDIC Contracts and Arbitration Practices Under Korean Law

This session delved into how FIDIC contracts operate under Korean law, with expert insights on the intersection of civil law and common law principles.

✅ Legal Systems: Korean law (civil law) differs from FIDIC’s common law basis, leading to unexpected outcomes for common law practitioners.
✅ Contractor Liability: Korean courts may reduce contractor liability using contributory negligence, unlike stricter common law standards.
