Reducing legal liabilities for RPs: Irrespective of the lack of action by the Government regarding the Grenfell Tower Inquiry recommendations, the LGA legal view in their EEIS+ response makes it clear that PEEPs are legally required for all buildings under existing equality legislation.

Providing evidence of due diligence with the Fire Safety Order (FSO) is going to be essential to reduce an RP’s personal legal liabilities moving forward. This also provides an opportunity for fire professionals to offer their customers a new service providing high-quality, cost-effective PEEPs.

Triple A Solutions has a background of delivering PEEPs in the workplace and general needs accommodation. Since 2011, Triple A developed a suite of eLearning courses for RPs with a toolkit of worked examples and fillable form PEEPs templates for different scenarios. PEEPS for Professionals Foundation Course:
Accredited by the Institution of Fire Engineers (IFE), with an award of 6 hours CPD, an in-depth course aimed at fire professionals and those responsible for advising Board Members and Directors internally and externally.

Strategic Planning:
Aimed at those setting the PEEPs strategy for an organisation with 2 hours CPD covering how the FSO, Equality Act and Health & Safety at Work Act overlap, as these are all relevant to the delivery of PEEPs. Also covered are Approved Documents, British Standards and Codes of Practice in addition to practical strategic solutions.

Practical PEEPs:
This course is in five parts and is aimed at building managers and RPs incurring responsibility for preparing and delivering PEEPs. 2 hours CPD awarded for successful completion of this course.

PEEPS & Neurodiversity:
A supplementary course to Practical PEEPs with a focus on how to develop a PEEP for a person with neurodiversity with 1.5 hours CPD awarded.

A sin of omission or a sin of Commission?

The exchange below which took place in the House of Commons yesterday during Michael Gove’s statement highlights why disabled residents in multi-storey buildings are terrified.

The question is, are the lack of PEEPs “a sin of omission or a sin of commission” by Local Authorities and Managing Authorities given the clear LGA legal advice (see below)?

I want to draw the Secretary of State’s attention to an area that is often forgotten: safety for disabled residents.

We know that the death rate for disabled residents in high-rise buildings is quite high. This delay has had a catastrophic effect. In December, a constituent emailed me to say that his young relative, who was in a wheelchair, had died when a fire broke out in her flat because she had no way to escape.

Avoidable tragedies such as that will keep happening until we make the change. How can this be acceptable?

The Hon. Lady is completely correct. There are some inherited structural problems with high-rise buildings in this country, which make life more difficult for residents living with disabilities. For example, we tend to have one staircase only, whereas other countries tend to have two.

Critically, one recommendation from the inquiry—the need for personal emergency evacuation plans—is one that the Government have not yet met. I have been working with my colleagues in the Home Office to make sure that we do, but I understand her exasperation. We need to move more quickly to give disabled people the certainty that they will be safe.

“Part 3 of the Equality Act 2010 imposes an anticipatory duty on councils and housing associations in relation to allocation of tenancies and the management of let properties: see Nur & Ors, R (On the Application Of) v Birmingham City Council [2021] EWHC 1138 (Admin) (04 May 2020) (Nur). This means that they are under an anticipatory duty to consider the requirements of their disabled residents without those residents having to ask.”

“This duty to disabled residents applies in all blocks, not just those with simultaneous evacuation.......... We have shared with government details of Leading and Junior Counsel’s opinion which explain the Part 3 Part 4 Equality Act legislation.”

Pete Apps, the deputy editor of Inside Housing has been covering building safety since before Grenfell. His book “Show me the bodies How we let Grenfell happen” is a must-read and explains clearly and succinctly what led to the horrendous fire.

'Prisoner in my own home’: Disabled people's lives still at risk after Grenfell | ITV News 07/12/2022

Two disabled people, Sarah and Georgie, were in the High Court yesterday at the start of a Judicial Review about the Government's refusal to implement PEEPs.

We were very pleased to develop both Sarah’s and Georgie’s PEEPs, identify the best assisted escape device and recommend Evaccess as a supplier who also trained their buddies.

Sarah Rennie’s managing agent completely supported the development of her PEEP and purchased the device ensuring that the legal requirement was met. On the other hand, Triple A was forced to setup a crowd-fund for Georgie as her managing agent, Scanlans, refused her a PEEP or a device. The crowd-fund achieved the total within three days with a number of international donations who were horrified that the UK took this approach to fire safety for disabled people.
