Product Liability Insurance – What is it and Who needs it?
 
🟢 Product Liability insurance provides cover for compensation and legal costs if someone makes a claim for injury or damage as a result of a defective product that your business designs, manufactures or supplies.
 
🟢 Product Liability is not required by law, however, you should consider this cover if your business has any involvement in a physical product’s life cycle – regardless of what stage.  Whether you design, manufacture, supply or sell – you have an exposure.  Not just manufacturers or retailers but contractors too who may source and fit parts within a repair or service.  Even those who give away products for free!

🟢 Public Liability insurance provides cover for compensation and legal costs associated with personal injury or property damage claims from your clients, visitors, or the general public.

🟢 Whilst it’s not required by law*, you should consider this cover if your business interacts with the public such as customers visiting your own premises, off-site such as at a customer’s premises or even at events/activities.

⭐️ Client Story ⭐️
 
🟢 Our client suffered damage to tenants improvements, contents and stock. They also had to close for a period of time impacting their ability to trade.

🟢 We liaised with their insurers, sending emergency contractors to make safe the premises and made arrangements for their losses to be submitted.
 
🟢 It was during a conversation with our client, that we realised that their insurers hadn’t discussed making a claim for the Business Interruption caused by closing the premises.

👉🏻 We promptly assisted the client, again liaising with the insurers as well, to obtain an additional payout covering this additional loss.

🟢 October Recap 🟢
 
I usually fill my weekends away from the office spending time with family & friends - October was absolutely that! 
 
I went to Leicester v Stoke with a friend of mine who’s a Leicester fan.  We agreed at the start of the season that he’d take me Leicester and I would take him Stoke – so it was great to catch up and have a few drinks together even if Stoke lost!  Let’s hope we win when I take him to the bet365 next year.  
 
It was our niece’s birthday last month and we went out to in Stone, for a Happy Potter (her favourite) mocktail!  They do some stunning drinks with effects and you can have an unlimited nacho table!  It’s a really nice place to visit if you are local to the area, I can recommend going. 
 
We also had a family day trip to Blackpool, unfortunately we didn’t make it through the famous illuminations due to the size of the queue, has anyone managed to go this year?
 
Beth and I also went out with some friends for their birthday, we went to in Congleton, it turned out it was their opening night!  It is a great themed bar with more fancy cocktails to visit if you are in the area.   
 
So, a busy month in the end – what did you get up to?

Employers’ Liability Insurance - do you need it?

🟢 Employers’ Liability insurance provides cover for compensation and legal costs associated with claims from employees, labour-only subcontractors, temporary staff including work placements and volunteers in relation to injury or illness caused by their work due to an employers’ negligence. 
 
🟢 Many businesses are required, by law, to hold Employers’ Liability insurance.. 

🟢 If you do not hold Employers’ Liability insurance where required by law, you can be fined £2,500 every day you are not properly insured!
 
We always recommend talking to us if you have any employees, volunteers or use subcontractors within your business.

What is Professional Indemnity Insurance – and do you need it?
 
🟢 Professional Indemnity insurance provides cover for the cost of compensating your customers or third parties for loss or damage including legal costs as a result of your negligent advice or services provided. 
 
🟢 A good Professional Indemnity policy will also include exposures such as defamation, intellectual property and breach of confidentiality.
 
🟢 Whilst Professional Indemnity insurance isn’t required by law, often professional bodies or regulators will stipulate this is required to trade and they will usually give a minimum indemnity limit too.

This happened to one of our clients 😤

One of our commercial clients, who runs a Bed & Breakfast, needed to make a claim for accidental damage.

After dealing with the insurer, providing the information and evidence required, they took the stance of declining the claim stating it was excluded from the policy.

Through discussions with our client, we became involved, reviewed the policy and challenged the insurer on their behalf, highlighting it should be covered under a different section of the policy.

In the end, the insurer agreed, overturned their decision and settled the claim at the new replacement value less the client's excess.

Not only do we help with arranging insurance policies it's also important to remember that we will be here if you needed to make a claim.

At the end of the day, this is why we all purchase insurance and so we feel it's key that we provide that support to our clients.

We can also use our knowledge and expertise to interpret, negotiated and assist you during the process.

Without our support and knowledge of policy coverage, this client wouldn't have had their claim paid.
