From May 2024 Probate Registry Fees will increase from £273 to £300 per application.

HMRC crackdown on digital platforms.

HMRC has, from 1st January 2024, introduced new reporting rules for digital platforms that facilitate the sale of goods i.e. Ebay, Vinted, Airbnb, Etsy.

It has created a new team to investigate income generation that is not reported to HMRC and upon which income tax has not been considered or applied.

These platforms must record and report the income of sellers directly to HMRC . Platforms that will continue under the new rules are likely to be seeking additional personal information from sellers to assist HMRC in matching up new sales with existing tax payers.

If you are regularly using these platforms to sell goods, please review your income tax threshold and take appropriate advice to avoid a visit from the tax man.

UK MPs begin inquiry into continuing probate delays | STEP 24/11/2023

The House of Commons Justice Select Committee has launched an inquiry into the HM Courts & Tribunal Service’s probate registry performance following continuing significant delays in the issue of grants.

This significant problem is still affecting bereaved families at a most difficult time in their lives.

Autumn Statement

No reduction announced for inheritance tax rates.

You still have a Nil Rate Allowance per individual of £325,000. If all relevant criteria are met an individual can also claim £175,000 Residence Nil Rate Band.

Spouses and Civil Partners can transfer allowances. It is therefore possible for a married couple or Civil Partners to shelter up to £1m of assets against inheritance tax when the second of the couple dies.

If you are at all unsure of your own position in relation to inheritance tax, please seek independent legal advice.

Registration of Lasting Powers of Attorney delays to continue:-

It is “unlikely” that lasting power of attorney (LPA) application timescales will return to eight weeks anytime soon, the Office of the Public Guardian (OPG) has said.

Current registration time is at least 5 months so you must take this extra time into account when initially setting up your Powers of Attorney.

Residents of Bishop's Stortford - please note that I have today sent a letter to our MP asking her to investigate the current issues that all estate administration practitioners and the general public is having when dealing with HM Revenue & Customs and HM Courts & Tribunal Service.

It is an unfortunate truth, at the moment, that dealings with either of the above departments or any department with the pre-fix HM, is likely to cause significant headaches, delays and stress.

I will provide any updates received.

PROBATE UPDATE

Just to let everyone know that HMCTS still has a significant backlog of cases. Grants of Representation (Grants of Probate and Grants of Administration) are currently taking up to 5 months to be issued.

If you have instructed a lawyer to deal with this for you, please be patient. We are unable to chase updates until 16 weeks have passed since the date the application was completed.

CAPITAL GAINS TAX

In the recent Budget capital gains tax was cut from £12,300 per person to less than half, £6,000, for this financial year 23/24. From April 2024 that will be cut again to £3,000.

My advice - if capital gains tax is going to be an issue seek advice from an accountant. There are allowances and exemptions that can be taken into account when calculating capital gains tax that may help reduce the overall tax due.

Update for Probate Registry paper applications:-

Whilst most probate applications are submitted digitally there are sometimes more complex cases that require paper applications.

I am advised today that Probate Registry is working on paper applications received in mid October. This is causing significant delays to the issue of Grants of Probate.

If possible applications should be made digitally to reduce the time it takes for a Grant to be issued.
