MERCADO TRADE COUNTER SCRATCH CARD PROMOTION
TERMS AND CONDITIONS

These Terms and Conditions apply to the ‘Mercado Trade Counter Scratch Card Promotion’ (the "Promotion"). The Promotion is entered by account holders in the UK over the age of 18 who are registered (hold an account) at any one of the following Mercado Trade Counters; Richards (Bristol and Southampton), LGS (Newcastle), Alvin Morris (Hull, York, Derby and Leeds) and Anderson Grant (Chelmsford).

To enter, account holders must make any purchase from a Mercado Trade Counter between 28th November 2022 and 31st January 2023 in return for one scratch card. If the scratch card reveals the message ‘WINNER: the prize stated below the ‘WINNER” will be awarded.

1. TERMS AND CONDITIONS

1.1 By entering this Promotion, you confirm your acceptance and agree to these Terms and Conditions.
1.2 The Promotion is hosted by Mercado Thornes Farm Business Park who are a trading company of HFD Limited (CRN: 02674152) (the “Promoter”). The Promoter’s correspondence address is Thornes Farm Way, Leeds LS9 0AN.
1.3 These Terms and Conditions apply so far as the law permits so please read them carefully before entering.
1.4 These Terms and Conditions are available in store at the Mercado Trade Counters listed in condition 2.1 and online at https://www.facebook.com/Mercadouk (on Facebook).
1.5 We reserve the right to disqualify any entry which does not comply with these Terms and Conditions or if your conduct is contrary to the spirt or intention of the Promotion.
1.6 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize Promotion where it becomes necessary to do so.
1.7 These Terms and Conditions shall be governed by and construed in accordance with English law. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to deal with any dispute or claim that arises out of or in connection with these Terms and Conditions and the Promotion.
2. CAN I ENTER THE PROMOTION?
2.1 This Promotion is open to those who are eligible (see condition 2.2), who are registered account holders (“Account Holders”) at any of the following Mercado Trade Counters:
(a) Richards (Bristol and Southampton);
(b) LGS (Newcastle);
(c) Alvin Morris (Hull, York, Derby and Leeds); and
(d) Anderson Grant (Chelmsford).
2.2 The Promotion is only open to all Account Holders who are residents in the UK aged 18 years or over, except:
(a) employees of the Promoter or its holding or subsidiary companies;
(b) agents, employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Promotion or its administration; or
(c) members of the immediate families or households of (a) and (b) above (“Family Members”).
“Family Members” means the parents, children, siblings, aunts and uncles, grandparents, and grandchildren of an employee, agent or supplier of the Promoter.
2.3 The Promoter will not accept Promotion entries that are:
(a) illegible, have been altered, reconstructed, forged or tampered with;
(b) photocopies and not originals; or
(c) incomplete.
2.4 Proof of the Account Holder’s details and age will be required from all Promotion winners.
2.5 In entering the Promotion, you confirm that you are eligible to do so and eligible to claim any prize you may win. It will be the Promoter’s sole decision as to whether any eligibility requirement has or has not been met and we may require evidence or confirmation from Account Holders before awarding prizes.
3. HOW TO ENTER
3.1 The Promotion will run from 28 November 2022 at 07:00 hours and closes on 31 January 2023 at 16:00 hours (the “Closing Date”) inclusive (together the “Promotion Opening Period”).
3.2 The Promotion requires Account Holders to make any purchase (no minimum spend) at and any of the Mercado Trade Counters listed in condition 2.1. A list of participating Mercado Trade Counters can also be viewed via the following link: https://www.facebook.com/Mercadouk.
3.3 Upon purchase, a Promotion scratch card will be given to the Account Holder (“Scratch Card”).
3.4 Scratch the card to reveal the word ‘Winner’, only cards with the word ‘winner’ win a prize (the “Prize”) (the Prize will be one of the Prizes as defined and listed in condition 4.4).
3.5 Account Holders may make more than one transaction at any of the Mercado Trade Counters listed in condition 2.1 during the Promotion Opening Period and may therefore be issued with more than 1 (one) Scratch Card. Account Holders may, therefore, win more than one Prize throughout the duration of the Promotion Opening Period.
3.6 Account Holders may submit their winning Scratch Cards up to 1 (one) month after the closing date, until 28th February 2023 at 16:00 hours (the “Scratch Card Submission Period”). Winning Scratch Cards submitted by Account Holders after the Scratch Card Submission Period will not be counted or eligible to win.
3.7 The Promoter does not take any responsibility for incomplete entries or entries that are lost, mislaid, or damaged.
3.8 Entries on behalf of another person will not be accepted and joint submissions are not allowed.
3.9 Scratch Cards cannot be returned.
4. THE PRIZE
4.1 An Account Holder who has scratched the Scratch Card to reveal the word ‘winner’ will be the Promotion winner (the “Winner”).
4.2 To claim the Prize, Winners must hand in the Scratch Card to an employee of the Promoter at any of the Mercado Trade Counters listed in condition 2.1.
4.3 The names of the Winners who have presented valid, winning Scratch Cards will be final.
4.4 The Winner will win one of the following Prizes:
(a) 1 x Trip to New York
This prize is valid for a holiday for 2 to New York. The Prize Winner will receive a £3000 holiday voucher for Virgin Atlantic.
(b) 24 x Trade Counter Vouchers
8 x £500 tool voucher (Only redeemable at Mercado trade counters before Monday 31st July 2023 )
8 x £250 tool voucher (Only redeemable at Mercado trade counters before Monday 31st July 2023)

4.5 There are 1,675 prizes in total to be won (each Prize at the quantities listed above).
4.6 The Prize displayed on your Scratch Card is the Prize you will be issued. Prizes cannot be swapped or substituted for other Prizes in the tables above.
4.7 There are no cash or credit alternative prizes and the Prize is non-transferable and non-negotiable.
4.8 If the Promoter subsequently discovers the Winner is ineligible, has breached these Terms and Conditions, or any foul play or unethical conduct is suspected under these Terms and Conditions then the Promoter reserves the right to not award the Prize.
4.9 If any part of this Promotion, including the Scratch Cards and the Prizes offered, is unavailable, cancelled or suspended for any reason whatsoever due to circumstances beyond the control of the Promoter, the Promoter will not be able to offer an alternative and will not owe any further liability to the Winner and/or Account Holders. The Winner will not be entitled to any monetary equivalent or compensation for costs or expenses incurred or suffered in connection with taking up the Prize.
4.10 Winners accept that the Prize could be cancelled or suspended for any reason whatsoever beyond the control of the Promoter.
4.11 In the event that any Winner is unable to take up the Prize for any reason they must notify the Promoter immediately. In this circumstance, the Prize will not be granted to an alternative Account Holder. The Promoter does not accept any responsibility if they are not able to take up the Prize.
4.12 You acknowledge and agree that the Promoter will not be responsible for any travel costs/expenses incurred by Account Holders when visiting Mercado Trade Counters to collect or submit their Scratch Cards and/or when collecting the Prize.
4.13 In all circumstances, the Promoter's decision is final and no correspondence will be entered into.
4.14 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of major Prize Winners and, if applicable, their winning entries on the Mercado page (https://www.facebook.com/Mercadouk) providing that the Prize has been claimed by the Scratch Card Submission Period (“Announcement Date”).
4.15 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter via the Mercado page (https://www.facebook.com/Mercadouk). In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
4.16 Please allow 28 days for delivery of the prize
4.17 The prize may not be claimed by a third party on your behalf.

5. LIABILITY
5.1 Neither the Promoter or its affiliates, agents, officers or employees will be liable (to the extent permitted by law) for any loss or damage arising out of organising or holding this Promotion or as a result of an Account Holder's participation in it, participation in any of the activities or as a result of the Winner winning, participating in, collecting or enjoying the Prize and/or the Promotion, or if the Promotion does not run as planned. This paragraph does not seek to exclude the liability of any party listed in this paragraph for (a) death or personal injury caused by their negligence, (b) fraud or fraudulent misrepresentation, and/or (c) any other matter for which it would be unlawful for them to exclude or attempt to exclude their liability. Your statutory rights are not affected.
5.2 The Promoter may change these Terms and Conditions or cancel the Promotion at their absolute discretion and without incurring liability as a result unless the Prize has been awarded.
5.3 The Promotion is in no way sponsored, endorsed, administered by, or associated with any third party.
6. OWNERSHIP OF PROMOTION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
6.1 All Promotion entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
7. DATA PROTECTION AND PUBLICITY
7.1 The Promoter will only process your personal information as set out in the Privacy Policy (https://mercado.b2b-payments.co.uk/privacy.aspx). See also condition 4.14 and condition 4.15, regarding the announcement of Winners.
7.2 By entering this Promotion, you understand that the Promoter (and its agents, contractors and group members on its behalf) may process, store, distribute and/or use the information (including personal data) you provide in your Promotion entry and in the process of entering:
(a) to enable them to administer your entry in the Promotion, including deciding whether it accords with these Terms and Conditions; and/or

(b) to share with organisations assisting with the conduct of the Promotion and fulfilment of the Prize.
