Demands of Justice

The Supreme Court today issued notice to the Madhya Pradesh and Rajasthan governments on a plea seeking comprehensive guidelines to bar political parties from distributing cash and other freebies at the expense of taxpayers. The court sought a response from them within four weeks.

“You have to establish a chain. The money has to flow from the liquor lobby to the person. We know it is difficult to establish the chain as everything is done undercover… but that is where your competence lies,” Justice Sanjiv Khanna, who headed the Bench, addressed Additional Solicitor General S.V. Raju, appearing for the ED.

The Supreme Court today said it will not stop the Bihar government from publishing the details of the caste census, saying it cannot interfere in the state's policymaking decision.

A bench of Justices Sanjiv Khanna and SVN Bhatti issued a formal notice on a batch of pleas challenging the August 1 order of the Patna High Court that gave the go-ahead for the caste survey in Bihar. It listed the matter in January 2024.

The Assam State Consumer Disputes Redressal Commission, presided over by Justice Prasanta Kumar Deka, with Mrs. Soneka Bora and Mr. Tapas Kumar Ghosh ordered in favour of consumer of the famous Coca Cola company who found a dead fly in the bottle. The court ordered for a compensation of Rs 5000 to the consumer to be paid by the Coca Cola India Ltd.

Tushar Gandhi, The great grandson of Mahatma Gandhi filed a writ petition today in Supreme Court seeking an independent and time bound investigation against the teacher who made a student to slap their fellow seven year old classmates in Muzaffarnagar. The boy who was been bitten was a Muslim and a teacher intentionally made a Hindu Boy to slap him, thus creating a communal angle.
The case was registered against the teacher Tripta Tyagi u/s 323,504 of IPC.

A very good initiative by the Odisha Government to alleviate prison congestion by allowing house arrest to the under trial prisoners, which will limit the movement of prison in their homes. Also the tracking device will be installed on their body to navigate them and monitor their movements.

A very good initiative which can be adopted by other states also to decongest the prison in India.

Supreme Court while hearing the petition on Article 370 today asks Center government to ensure the timeframe to restore the statehood in the state of Jammu and Kashmir. Although the state could not give any satisfactory answers but ensures the court that a positive statements will be given on the next hearing.

Section 228 A of the Indian Penal Code lays down the provisions barring the disclosure of identity of the victim of certain offences.

We all are seeing the disturbing images and videos of victim of Hashrat going viral on social media, is this the ethics of media? , Is this the ethics of police personnel who cannot even stop the person making videos of the victim.

While laying down directions to protect the identity of r**e victims, the Supreme Court has already ruled against any disclosure and barred it even in cases where the r**e victim may have died or is of unsound mind and the parents have consented to such disclosure.

Accordingly, police and forensic authorities have been barred from disclosing the identity of a r**e victim after parental nod. Putting first information reports (FIRs) on r**e and those under the Protection of Children from Sexual Offences (POCSO) Act, 2012, in public domain also stands prohibited. Protection to the identity of r**e victims would also extend to social media posts on which any sort of identity disclosure has been barred.
