Forensic report clarifies no r**e with victim: UP ADG on Hathras case 02/10/2020

“The report of the FSL has also come. It says clearly that samples did not have s***m. It makes clear that there was no r**e or gang r**e," ADG (Law and Order) Prashant Kumar said.

With such statements, the police attempted to contradict the dying declaration given by the woman on September 22 that she was r**ed by four men. The statement made by ADG (Law & Order) is completely contrary to the provision of Law.

Section 375 of IPC clarifies that to prove the offence of r**e it is not necessary to establish the presence of s***m samples in the body of the woman. In State of UP vs Babulnath (1994) 6 SCC 29, the SC observed :

"...to constitute the offence of r**e it is not at all necessary that there should be complete pe*******on of the male organ with emission of semen and rupture of h***n. Even partial or slightest pe*******on of the male organ within the l***a majora or the v***a or pudenda with or without any emission of semen or even an attempt at pe*******on into the private part of the victim would be quite enough for the purpose of Sections 375 and 376 of IPC. That being so it is quite possible to commit legally the offence of r**e even without causing any injury to the ge****ls or leaving any seminal stains".

https://www.indiatoday.in/india/video/forensic-report-clarifies-no-r**e-with-victim-up-adg-on-hathras-case-1727377-2020-10-01

Forensic report clarifies no r**e with victim: UP ADG on Hathras case Uttar Pradesh ADG law and order Prashant Kumar said that forensic report has clarified that no r**e was done with the victim. He added that even no s***m was found in victim's body.

Criminological Research & Development Organisation

Criminological Research & Development Organisation (CRDO), India is a Non-Profit Organization. CRDO, India was founded by the Founder and Managing Trustee (Advocate & Criminologist) Mr. Rishabh Shrivastava with other co-founders Mr. Yashwant Narayan & Mr. Pratiksh*t Tiwari in 2019. CRDO, India is registered under Trust, 1882. CRDO, India was established with the dream of minimizing and reduce the crime rate in society by using special skills & knowledge.

The problems connected with crime and crime prevention are complex and subtle. The prevention of crime and crime control cannot be managed solely by the police, the prosecution, the courts, and the correctional institutions but require the fullest co-ordination and co-operation of all the sections of the society. For effective crime prevention, it is necessary to make every effort to create maximum awareness and secure the participation of the people in all aspects of the crime problem. The need, therefore, of voluntary agencies for this purpose cannot be overemphasized and it is towards fulfilling this need that Criminological Research & Development Organisation (CRDO), India was established in the year 2019 and is registered in Bihar, India.

Along with the preventive approach we are focusing on a curative approach for a wide change. This curative approach is to reduce the crime rate and to make a crime-free society. To achieving our goal we especially work on effective policing and its modernization, crime pattern and criminal behavior, victim role, and participation. We are not only providing the opportunity to the victim of a crime in rehabilitating themselves but also facilitate the offender to reintegrate into society because we believe criminals are made, not born.
