The Central Government introduced three bills in the Lok Sabha to replace the IPC, CrPC and the Indian Evidence Act, which are British-era laws.

The new laws are called the:

Bharatiya Nyaya Sanhita, 2023 (Criminal Law Code)

Bharatiya Nagarik Suraksha Sanhita, 2023 (Code of Criminal Procedure)

Bharatiya Sakshya Bill, 2023 (Evidence Law)

The Bharatiya Nyaya Sanhita, 2023 introduces a number of new offences, such as cybercrime, human trafficking, and acid attacks. It also increases the punishment for existing offences, such as r**e and murder. The law also has special provisions for the protection of women and children.

The Bharatiya Nagarik Suraksha Sanhita, 2023 introduces a number of new provisions for speedy trials. It also has special provisions for the protection of witnesses, and recognizes electronic evidence as admissible in court.

Supreme Court: Prolonged incarceration in NDPS cases can override statutory embargo on bail.

The Supreme Court has ruled that in cases where the accused has been in jail for an unduly long period, conditional liberty will override the statutory embargo on bail under Section 37 of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act).

The Court held that prolonged incarceration is against the fundamental right to life and personal liberty guaranteed under Article 21 of the Constitution. The Court also noted that the NDPS Act does not provide for a minimum sentence for offences punishable under the Act, and that the accused is entitled to bail unless there are reasonable grounds for believing that he is guilty of the offence and that he is likely to commit a similar offence if released on bail.

The Court's ruling is a welcome development, as it will help to ensure that the rights of the accused are protected in NDPS cases. The ruling also sends a message to the authorities that they should not unduly delay the trial of NDPS cases, as this could result in the accused being denied bail.

Delhi High Court today reiterated that the Subordinate Courts/ District Courts in Delhi are bound to permit the hybrid or VC hearing facility to the parties at their request. A Division Bench of Delhi High Court observed that once the Full Bench of the Delhi High Court has permitted the subordinate courts in Delhi to allow hybrid or VC hearing facilities at the request of parties, the courts are bound to follow the said direction.

Supreme Court has directed the All India Institute of Medical Sciences (AIIMS) to postpone the INI CET 2021 exam - which was scheduled on 16th June, 2021 by at least a month in view of the COVID-19 situation.

Sh. Subodh Kumar Jaiswal, IPS officer of 1985 batch has finally been appointed as the Director of CBI. He is currently serving as DG of CISF. His appointment is for a period of two years from the date of assumption of charges. A high level committee consisting of Prime Minister Narendra Modi, Chief Justice of India and Adhir Ranjan Chowdhury, leader of largest Opposition Party, cleared the appointment. Chief Justice NV Ramanna opined to avoid officers with less than six months to retire for appointment as DG CBI, which as per him is a simple 'statement of law'. He said that the selection of officer should be able to withstand the 'scrutiny of law in future'. For this, officers with a few days left in service should not be considered. In this context 10 of senior most officers of 1984 batch, scheduled to retire soon, were not considered. The six month minimum residual tenure rule was introduced by Supreme Court in its order passed on 13 March 2019 in Prakash Singh case, although the said case pertained to appointment of DGPs. The judgement of Supreme Court in UOI Vs. C. Dinakar reported 2004 was also referred. It was extended to CBI Director too. As on date, the CBI has jurisdiction to investigate offences pertaining to 69 Central laws, 18 State laws and 231 offences in IPC.

CLAT 2021 has been postponed due to second wave of COVID-19. It was earlier scheduled ot be held on 13 Jun 2021. Now the deadline for submitting application for CLAT 2021 exams has been extended till 13 June 2021.

A very sad news is pouring in. The Registrar General of National Green Tribunal (NGT), Sh. Ashu Garg has left for heavenly abode today morning, due to COVID. Earlier, the two Judicial Officers of Delhi Judiciary, Sh. Kovai Vengugoapl, Judge Family Court, South East District and Sh. Kamran Khan, Metropolitan Magistrate, South West District Dwarka Court had succumbed to this lethal virus COVID. Our heartfelt condolences. May the departed soul rest in peace.

Delhi High Court has issued notices to Government in a plea seeking extensions for filing compliances under Income Tax Act, 1961, GST Act, 2017, the Employees Provident Fund & Miscellaneous Provisions Act, 1952, the Employees State Insurance Act, 1948, and other Labour Laws, owing to the second wave of the Covid-19 pandemic.

Supreme Court has declared the West Bengal Housing Industry Regulation Act of 2017 (WB-HIRA) "repugnant" to the Parliamentary law of Real Estate (Regulation and Development) Act of 2016, saying the State wanted to create a "parallel regime" and encroached upon an identical Central law .

Supreme Court has set aside the Bombay High Court order and stuck down the reservation to Marathas in government jobs and admissions in Maharashtra, stating that amendment granting reservation of 13% to Marathas to education and employment is ultra vires to the Constitution of India, 1949.

Making the most out of the present lockdown:
The second wave of the COVID-19 outbreak has once again impacted almost all the industries of our country and law industry, more specifically the litigation sector is no exception to it. We are once again forced to remain confined within the walls of our home. We can utilize this time in knowledge sharing with law students and fresher lawyers. While doing so, we would have occasion to refresh our own knowledge. Even otherwise, we are students of law till our last breath, and thus, we need to continue learning. During the first lockdown last year, I provided more than 150 hours online classes to law students and fresher lawyers on various law subjects focusing on judicial services examinations. This time, I have thought of guiding fresher lawyers and law students about the nuances of practical aspects of litigation, more specifically the litigation on criminal side. Focus would remain on procedural aspect. The criminal litigation has huge potential, so far as career therein is concerned. Be it a trial court lawyer or appellate jurisdiction lawyer on criminal side, one has the opportunity not only to earn pretty well but also to serve the poor, downtrodden and oppressed. The criminal litigation encompasses within its ambit the crimes relating to NDPS, PC Act, PMLA, various other white-collar crimes in addition to traditional crimes, i.e. the offences against human body and property etc.
