The changes in attributes of any society require the change in formulation of rules to be adopted by such society which if analysed from distilled wisdom of past is nothing much than the very effect of change in socio-economic and geographical conditions. The foremost step to understand the law is to understand the meaning of morality. I am bitterly scronful of pretension that morality has nothing to do with law. The very essential of every legal system came from morality of such society wherein the morality perpetuated in form of usages & customs. What is just and humane is moral. - Anup Singh

Decided on July 14 2021

1. Father In Law and Mother in Law were charged for 304 B ( Dowry Death) but were discharged for 306 IPC ( Abetment to Su***de).

2. It was contended before the Apex Court by the Father of the Victim that in a given case where charge under section 306 IPC is framed a party could be discharged under Section 304 B but not the reverse.

3. It has been held that 306 IPC is much broader in its Application and takes within its fold one aspect of Section 304 B IPC. These two sections are not mutually exclusive. If a conviction for causing su***de is based on Section 304 B IPC it will naturally attract 306 IPC. However converse is not true.

4. Discharge under Section 306 IPC set aside.
