Imagine men barging into your office and asking you about your name.

As the onlookers look by, the terrorists target no one else but the bhatta and leave.

Killing specifically on the basis of identity is a crime worldwide but gets away with it because of our intelligentsia and our structures.

Does a 7 year old when she grows up needs to know that her father was killed for his white thread that lay in tatters soaked in blood while the majority, sitting at their homes, revelled in his pain.

How snidely the majority let it pass while a home was distraught and left in shambles.

When a new KP kid who comes to Kashmir to earn their bread and butter looks at this, they are moved by their very own helplessness.

Do these kids not deserve a soft touch? Was growing up with trauma not enough that the government, just to prove a point, would not transfer them to a safe place.

Does any kid deserve to have his life haggled while barter for glory.

Ponder and reach out. Take to the streets. Make your anger felt. This is not a passing matter for many. The trauma reverberates through ages. As we sit today, send out regards to the very grit and might of KP members in valley for standing up for our rights. We all will go down in history. This is a historic moment in the making for ages to come.

Whilst a Govt Job means a lot in the rest of India, for , it means nothing but Interestingly, GoI & JK UT Administration seems to be hell bent on sending KPs to their graves with lesser pay - half of what we are due and that too in a place with a known history of ethnic cleansing. Not just this, there are no provisions for proper housing and with zero security. Thanks for the rehabilitation/Re-Migration !The only joke that makes more sense is our meme about our problems.


Injustices of PM's Package:👇
1. Sign no transfer affidavit like bonded labour which is against fundamental rights.
2. Forced remigration to Kashmir with no settlement plans
3.Transit Accomodations are full and new ones will take atleast 2 to 3 years or maybe more. So everyone from our batch will go on rent.
4. No post death benefits(SRO43). Everone else who is a state or even central government employee gets job for next of kin if they die in service.
5. No hazard allowance. No where in this world is an employee sent to a security sensitive place without hazard allowance. Ask anyone in Army, CAPF etc. But we are being sent without hazard allowance.
6.No timely promotions. Some employees already fighting a case for this.
7. Security issues. We all know what this point is.

Now for all the above injustices, we were given full salary from day 1 of joining. Sadly that has also been taken away with SO 194/192.

Generic calculation of monetary loss we face with SO 194/192 (approximations only, don't start arguing about figures please).

1. For SI and AC an approximate gross of ₹43 K (includes predicted revised DA, HRA for tier 2, TA, MA, Govt., NPS contri etc.), we will get only approx ₹25 K. There will be 2 components of loss, 1 is direct which you can get by subtracting one from the other, the other is accrued which has to be calculated as the loss of government contri of NPS of 24 months till your service end.
2. Pay Level-2 posts have it worse with only ₹14 K per month for 2 years.
Rent kya denge aur khaenge kya?

When the matter is already subjudice how can they consider it in our fresh recruitments??

A few months before the harrowing incident on January 19,1990, Pandit and political activist was shot dead by armed men outside his residence on September 14, 1989. This was the first killing which eventually led the tone for the of fom the region on 19 January 1990.

Pandit Taploo’s killing at the hands of terrorists was a turning point in the conflict in the region as he was then the most prominent Kashmiri Hindu leader in the Valley. It also sparked the spree of terrorist attacks on Kashmiri Hindu leaders.

Pandit Taploo’s was arguably the biggest blow to the morale of Kashmiri Hindus who had dug in their heels to stay back in the Valley.

As you all know we tried political approach to get SO 194/192 revoked but are unsuccessful till now.Now the only option we are left with is legal i.e. CAT. But all of us have certain doubts going with this approach.

So in order to get more clarity on our doubts,we took of 2 lawyers.Following are the answers 👇

*1.Whether going to court will hamper our joining process by putting & can court/Administration by itself put stay on our matter? (Most Important controversial ques.)*
Ans. Lawyer said gauranteed "NO" & lawyer has taken full gurantee & responsibility of it on himself.
- Lawyer said stay is a type of relief & it is given only when one demands & requests for it via their petition ( ). In our prayer we'll not be asking/mentioning anything about stay or anything related to it.
-We will be framing our petition only to challenge the implementation of SO 194/192 i.e. Revocation of that particular order number.& there shall be no mention of recruitment process. can't Put a stay itself on the recruitment.Its impossible.
-We even asked him about the past experience where recruitment under was unnecessarily delayed due to court intervention in which we cited the case of 2017 which was filed by Non-Migrant Sikh community of Kashmir for their inclusion in PM Package to which he said that it was a totally different case. In that case there were 2 parties one was & another one was Kashmiri Sikhs & their inclusion would have definately effected the final selection list that is why it was stayed plus their lawyer had demanded stay on the recruitment process that is why it was stayed. But in our case only party interested i.e. selected candidates so how court can stay the recruitment process where there is only one single party effected & again he said that we should challenge only against on PM Package.

*CAT/Court gives judgement based on our Prayer clause only.It doesn't go over & above that.Court is bound to give judgement with respect to our prayer clause only*

*2.Can we join first and then file a case?*
Ans. No. Lawyer said because once you join you are accepting all T&C of govt.and then you can't file a case.You have already lost the fight there.Plus he said that the more you wait, more your case is getting weaker.If your are filing your case late court will clearly say it on your face "where were you when this order was passed, were you all sleeping then" & in that situation lawyer said he'll not be able to do anything.

*3. How much will it take to get the final verdict of court?*
Ans. 6 months to 11 months generally for these types of cases.
However works faster for service related matters.

*4. How many candidates should file the case?*
Ans. Lawyer said more the no. of petitioners, more is the pressure on court.Lawyer even said that more number of petitioners also puts psychological pressure on judiciary as well. Judges also think that large section of people are effected by this order of the govt. & court also tries to settle the case on immediate basis plus there is pressure on the govt. to file their response on fast track basis as interest of large no. of people is effected here.
(Don't think he is saying this for money,He said it will infact put less Financial burden on each one of u)

*5. Should we wait for the final outcome of Employees wala case i.e. wait till 20th September 2021 & will it be helpful for us if judgement comes in favour of employees i.e. sabhi par implement hoga ya nahi both employees & selected candidates?*
Ans. -Lawyer said this is not the case, court doesn't functions in your way. Relief is given only to those who have filed the petition & pleading the case & here in this case it is only Employees. & if court court gives judgement in favour of employees (which is the most expected outcome, as said by lawyer) you i.e. selected candidates will never get any benefit out of that judgement as you are not the party to petition plus they haven't added you as party in their petition. You'll have to file your own case .
-Employees in their petition haven't mentioned anything about you i.e. selected candidates so how do you expect that the judgement will favour you.
-Lawyer also said that employees have already got interim relief for themselves from Divisional Bench of HC where HC had clearly directed CAT & Govt that till the final outcome of this case employees will continue to receive full salary without any deductions & now they can keep on postponing the date of hearing of their case & they can do so.

* Discussion -*

Lawyer's said why you guys are afraid of filing the case against this order.This order is total violation of your rights. He said how the rules of service can be changed when the recruitment is in the final stage of completion why the administration didn't notified it in their notification when the advertisement was out. He confidently said that you guys are having strong & valid arguments & administration is at fault here. But if you keep on delaying it like this nothing will happen & you guys are bound to suffer to loss only.

* Important Point from discussion-*
Only those who'll file petition will get the benefit if they win the case. Rest of the candidates again will have to ultimately go to the court & file different petition to get the benefit. So, don't expect that you'll also be free from SO 194/192 if you haven't filed the petition.

Meanwhile guys you are free to ask us anything.It is everyone's common interest.Please everyone try & understand it is total of our here plus above all there is *huge monetary & financial loss to us ( For 2 years, SI & AC - around ₹4 Lacs & others around ₹3 lacs).
We request each & everyone of you to come forward, join us physically so that there is no communication gap between us & from day 1 itself we are disclosing each & everything even smallest of things & facts on public platform because it is everyone's battle & not of any single individual.

Also we'll try to meet other lawyers in the coming days as well to get their opinions on this matter & to make our arguments more valid & strong.

P.S - Even after this thorough discussion of more than 2 hour we aren't filing any case till 20th september coz for now we'll b trying to meet more lawyers & getting their legal opinion plus for now we are also not having enough individuals to file the case.

Note:We should not think that lawyers are there to grab money only & thats why they are trying us to motivate to file case by a a large group of individuals.Its a profession just like Doctor,CA etc etc.

In times like these where the community youth is feeling demotivated,instead of coming together & standing for community youth,It seems that the few of our so called community leaders are totally unhappy & losing their cool.

(not using Budgami here as we don't want to offend KP's of Budgam) is saying that ,we(Package selected candidates) are here for publicity stunts & to get face value among candidates,public and & trying to .This shows nothing but the filthy thoughts in your mind.
Calling us selfish because we didn't gave u undue credit ??
And we are not here for politics(Like u),we are here For a cause, i.e Revoke So that we can secure our future.

We are soon going to join & a Government Job holder isnt allowed to do all such acts.

Since we are uploading these on public platforms some of us might think that we are trying to prove that we are correct & he/they are at fault, but it is not so.They are our we'll always be their kids & we always try to learn things from them.But right now we are feeling that our is being

*A KP youth delegation,namely KP Solidarity representing all selectees affected by under PMSP, today welcomed 💐Hon'ble Relief and Rehabilitation Commissioner, Shri ji *

The delegation gifted Holy Krishna Book on the upcoming occasion of and also submitted a 📄 to Shri AK Pandita and apprised him of the ongoing issues with regards to KP youths.

"We apprised him about the need for revocation of of 2020 from pm package ,the controversial provision that curtails the salary of KP employees during probation period"said the selectees.The order of GAD 586JK (GAD) of 2021 dated 07/07/2021 making S.O.194 applicable to all those recruits who joined or are going to join on or after 17/06/2020 is completely arbitrary, full of contradictions and is irrational and was taken up by the delegation.

In past DMRR&R Civil Secretariat, Srinagar had already issued clarification vide OM No. DMRRR/MR/ Sel/44/2019 dated 09.09.2020 stating that “these posts are not governed by SRO 202 rules, then on similar analogy S.O 192 of 2020 and S.O 194 of 2020 shall not apply to the posts created under Hon’ble PM Package for Kashmiri migrants, as posts created under Honourable PM Package are in nature and are not borne on the establishment of any department or service.

The RC sir patiently lent his ear to the delegation members and assured of resolution to all the problems faced by prospective PM Package employees.
