| Activist files FIR against Bengali Sahitya Sabha for stitching Bengali wearables with Assamese Gamosa

An activist named Hirak Jyoti Borah from Assam has filed an FIR against the Bengali Sahitya Sabha for combining the Assamese 'Gamosa' with a Bengali wearable, which sparked controversy. The FIR was lodged on March 28 at the Chandmari Police Station. The FIR stated that the case is a clear instance of criminal conspiracy and hurt religious sentiments among a significant section of people, and should be investigated under sections 153A/295/295A of the Indian Penal Code. The Bengali Sahitya Sabha had stitched the Assamese 'Gamosa' and the Bengali wearable as a message of unity, but some people found it disrespectful and offensive.

Today I, SHRI. HIRAK JYOTI BORA (HUMAN RIGHTS ACTIVIST, REPRESENTATIVE-INDIA (UNITED NATION HUMAN RIGHTS COUNCIL, GENEVA), lodged an F.I.R against Bengali Sahitya Sabha, Maligaon, Guwahati, Assam represented by its President and General Secretary or other executive/committee members in absence of such.

That, I am a citizen of India and a permanent resident of Assam having all the rights, privileges, and remedies under the Constitution of India.

That, I begs to state that, a two days, i.e; dated. 25th and 26th March, 2023, the first state level conference had been organized of Bengali Sahitya Sabha at the Hiteshwar Saikia Auditorium, Maligaon, Guwahati, Assam where Hon’ble Education Minister, Government of Assam Dr. Ranoj Pegu, Hon’ble Advisor, Department of Education, Government of Assam Dr. Nanigopal Mahanta, Hon’ble Rajya Sabha MP Pabitra Margherita along with other honorable guest grace their presence. (according to media footage).

That, in the said event, the cultural identity of Assamese Society, i.e; the Assamese Gamusa had been chopped off in between and a Bengali Gamusa stitched along which was presented to all the delegates and other guest aforementioned as Galabastra (Neck Cloth).

That, the Assamese Gamusa is a holy and an honorable fabric which is even presented to gods in temples and naamghar along with guest to show our immense love and respect. But defaming and insulting Assamese Gamusa in between such huge public gathering is intolerable and unacceptable by the entire Assamese society which is shameful as well.

On the otherhand, recently the Assamese Gamusa achieved Geographical Indication (GI) tag from Government of India which is not only a proud moment for Assam but for the entire nation. As such, the Assamese Gamusa protected under few legal norms according to Geographical Indication of Goods (Registration and Protection) Act, 1999 and Geographical Indication of Goods (Registration and Protection) Rules, 2002, where it was clearly mentioned that a Geographical Indication (GI) is a sign use on products that have a specific geographical origin and possess qualities or a reputation that are due to that origin.

Moreover, Section. 22 of the aforementioned acts states the laws relating to infringement of geographical indications. It also states about few punitive responsibilities for violation of various laws relating to the geographical indications.

In addition, as Intellectual Property (IP) Rights, GI provides protection against acts of misappropriation and unfair competition. These products have an exclusive right to use the GI and to prevent its use by third parties whose products do not originate from the same geographical area or do not conform to the certified standards of production.

Most importantly aforementioned accused violates the international obligations as enshrined in UNITED NATIONS DECLARATION ON THE RIGHTS OF INDIGENOUS PEOPLES. It has violated articles of UNDRIP. To be specific,
1. Indigenous peoples and individuals have the right not to be subjected to forced assimilation or destruction of their culture. (Article 8(1) of United Nations Declaration of Rights of Indigenous Peoples)
2. States shall provide effective mechanisms for prevention of, and redress for:
(a) Any action which has the aim or effect of depriving them of their integrity as distinct peoples, or of their cultural values or ethnic identities;
(d) Any form of forced assimilation or integration; (Article 8(2)(a) & (d) of UNDRIP)

Hence, the entire case is a crystal-clear matter of criminal conspiracy, hurt of religious sentiments in between huge sections of people which should be investigated U/S. 153A/295/295A of Indian Penal Code. (IPC)

It is therefore I lodged an F.I.R to get it investigate and take necessary actions according to the sections abovementioned or any other stipulated sections as the Officer-in-Charge may think deem fit and proper.

I had also noted COPY TO: 1) President, United Nation Human Rights Council, Geneva, Switzerland and mailed the same. Hope for a positive response as soon as possible. At last but not the least I request the distinguished guest present up there and accepted the thing to return it as a gesture of respecting both the culture as well as ethnic identity.

The right to life and liberty, freedom from slavery and torture, freedom of opinion and expression are basics Human Rights.
I was informed by a daughter that her paralysed mother was being tortured, was not taken proper care, she was not being heard and was bo***ge by her elder brother at his house. As it violated the basic human rights, as a human rights activist and being a United Nation Human Rights Deligate from India ,I along with the old lady daughter, a Supreme Court lawyer and with the help of the locals of Besseria, Tezpur rescued the victim-the old lady and took her to her eldest daughter house with the old lady’s consent without any coercion and warned the accused son to not to repeat the same act of violations of human rights in future. I thank the daughter for believing me and my team members for helping me in this case.
