We’ve all heard of Mr Bean, the comedy icon who dominated European television in the 1990s. But did you know that there’s also a trampoline park in Lonavala named after him?

This might sound fun, but it’s actually being fought as a case of trademark infringement in the Bombay High Court. The court has noted that this is a perfect case of false endorsement. The park is taking advantage of the fame and adoration earned by Mr Bean to get customers.

As of right now, the Court has forbidden the trampoline park from using the name Mr Bean - spelt BEAN or BEEN - and also any artwork that is ‘deceptively similar’ to the registered trademark.

In one of the biggest cybercrime cases to hit Mumbai recently, a woman lost 25 crore rupees to scammers posing as police officers.

She first got a call from someone pretending to be part of the telecom department, who said that her three phone numbers would be deactivated. He connected her to one of his accomplices, saying he was a police officer and he could explain more.

The woman was told that there was a money laundering case against her, and she would have to transfer money into certain accounts. The scammers told her that the money would go to the RBI, and would be returned to her later. In this way, she deposited around 25 crores into over 31 accounts.

After realising what had happened, she immediately approached the police, who are now working to get the money back.

Pablo Escobar was a Colombian drug lord and politician, who was killed in 1993 while resisting arrest.

Why are we hearing his name in the news again?

Escobar Inc. recently tried to trademark the name ‘Pablo Escobar’ to sell a range of products. The European Union Intellectual Property rejected this trademark application. They stated that the name ‘Pablo Escobar’ is widely associated with crime and terror. So, the trademark went against the accepted principles of morality and public policy.

Escobar Inc. appealed in the General Court of the European Union. The court upheld the previous verdict. They said the rejection was based on the negative perception of Pablo Escobar by the Spanish people - given Spain and Colombia’s close cultural ties.

These are the top 3 cyber crimes we’re hearing about these days.

Number one: “Drugs have been found in a package in your name.” It doesn’t matter if you haven’t actually ordered or sent any parcel. Scammers will pretend to be with the police, and extort money from you. In fact, in just Pune, just one city in Maharashtra, India, people have lost 18 crores to this fraud in the last 4 months.

Number two: “Download this investment app, and you’ll make a lot of money.” Or, scammers will ask you to transfer the money to them so they can invest it on your behalf. They actually will give you some money in return to seem authentic. Then they’ll conveniently disappear and cut off contact.

Number three: “Your insurance policy is going to lapse today.” This is used to target a lot of senior citizens. Scammers send them a link to continue the policy. When they click on the link, their money gets stolen.

In a case last year, a Google user uploaded a picture to a private Google Photos album. It was of his grandmother bathing him as a child. Innocent enough, right? But Google marked this photo as ‘child pornography’. The user’s account was blocked and faced permanent deletion. This decision was taken by artificial intelligence, which had been used to examine his personal photographs.

This is one of the many ethical challenges posed by AI. Should we give up our privacy for increased security? And why is AI qualified to judge what’s “acceptable” and what isn’t?

The Delhi High Court recently issued a ruling in favor of Bollywood actor Anil Kapoor, restricting the use of his name, voice, image, and other personality aspects for commercial gain without his consent. This case arose after Kapoor sought legal protection against the unauthorized commercial exploitation of his persona, which included AI-generated images and voice clips. The court recognized the need to protect celebrities' personality rights, emphasizing that the unauthorized use of a celebrity's persona for commercial purposes can infringe on their right to control and monetize their own image and likeness.

The ruling underscores the importance of personality rights, which safeguard individuals against unauthorized commercial exploitation of their identity. This encompasses their name, image, likeness, and other unique characteristics. These rights are crucial for celebrities who rely on their persona for endorsements and other revenue streams. The court's decision aims to prevent damage and misuse of these elements, especially in the era of advanced digital technologies and AI that can easily manipulate personal attributes for commercial use.

Here's a celebration you probably didn’t know about - World Password Day! It's the first Thursday in May. It was started in 2016, and is still celebrated today.

Back in Ancient Mesopotamia, the word for “password” was the same as the word for “omen”. So, something that not everyone could decipher and the one who could, had power.

Today, passwords can confirm identity.

Unlike other festivals, World Password Day is not about sharing. So be sure to keep your passwords secure and don’t tell anyone about them.

In fact, here are some interesting ways you can celebrate today:

✅Look through old passwords, and change them if they seem weak.

✅Turn on two-factor authentication if you haven’t already.

✅Tell friends and relatives to strengthen their passwords.

Who hasn’t enjoyed a delicious snack from a Haldiram’s? Recently, even the Delhi High Court said that its origin is deeply rooted in India’s culinary tradition.

So, it’s no surprise that someone would try to use the Haldiram’s trademark to win people’s trust. A Haryana-based company called Haldiram Restro Private Limited was found using the trademark ‘Haldiram Bhujiawala’ to promote its products.

The court ruled that this was deceptively similar to that of Haldiram’s. The defendants were forbidden from using such marks in the future. The court also said that they were exploiting the trust given to Haldiram’s due to its national and international presence.

Have you ever heard of Nils Bohlin? No? Believe it or not, this man has saved thousands of lives - maybe even yours.

Nils Bohlin was an engineer working for Volvo. In 1959, he invented the modern design for the seat belt.

Earlier, a seat belt only crossed over your lap. That design was called the two-point belt, and it wasn’t effective.

Bohlin created the three-point belt, crossing over your lap and torso and keeping you much, much safer.

The president of Volvo at this time had himself lost a close relative to a car accident. That was his motivation behind wanting to create a safer car.

So, surprisingly, despite the fact that Volvo filed a patent for the seat belt design, they made this patent available to all their competitors as well. Safety for all, right?

So, every time you sit in a car, wear a seatbelt and thank Volvo for it.

Mule accounts are essentially bank accounts that receive funds from illegal activities and then transfer them elsewhere, acting as a bridge in the laundering process.

In November 2022, CoinDesk published a report that would set off an unimaginable chain of events, ultimately leading to the 25-year prison sentence given to FTX CEO, Sam Bankman-Fried.

FTX’s sister trading firm was called Alameda Research. CoinDesk’s report showed that Alameda Research had most of its assets tied up in speculative cryptocurrency tokens, including the native token of FTX, called FTT.. These tokens were risky, relying heavily on speculation and lacking stability in their value.

When this news came out, a lot of customers panicked and withdrew their money from FTX, causing the exchange to run out of money and declare bankruptcy.

It was also discovered that Sam Bankman-Fried and other executives had misused customer deposits, lied about the company's financial health, and engaged in fraudulent activities.

After a long court battle, Bankman-Fried was finally sentenced to 25 years in prison last Sunday.

French football player Kylian Mbappé has what you’ve just seen - a trademark goal celebration. It’s one of the most iconic celebration poses in the world. And now, it’s an actual trademark.

That’s right! This sports celebrity has registered a logo showing his celebration pose as a trademark in several countries. This makes him one of the most IP-protected football players, actually surpassing Ronaldo and Messi. Mbappé has also trademarked his surname, initials and two of his famous quotes to be printed on posters, handbags and footwear, among others.

🎯 Section 420 of the Indian Penal Code deals with Cheating and dishonestly inducing delivery of property - Whoever cheats and thereby dishonestly induces the person deceived to deliver any property to any person, or to make, alter or destroy the whole or any part of a valuable security, or anything which is signed or sealed, and which is capable of being converted into a valuable security, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

Blockchain & Cryptocurrency Law

A blockchain is basically a bunch of computers (nodes) connected to each other.

All of these computers have the same data stored in them (e.g. a ledger of transactions).

There are many blockchains in the world.

The Bitcoin blockchain records all transactions of the bitcoin cryptocurrency.

A cryptocurrency is a type of electronic money that is powered by advanced mathematics.

Cryptos can broadly be divided into 6 types:

1. Non-fiat-backed currencies

2. Fiat-backed currencies

3. Utility coins

4. Governance tokens

5. NFTs not backed by tangible assets

6. NFTs backed by tangible assets

Cryptocurrencies, especially privacy coins, are used in criminal activities:

1. Human Trafficking

2. Money Laundering

3. Narcotics Trading

4. Operation of illegal businesses

5. Ransomware payments

6. Scams, Rug-pulls & Hacks

7. Terrorism Financing

8. Trade of illegal drugs, weapons, malware, and other hacking tools

How to Register Cyber Complaints

METHOD 1

The easiest way to register cyber complaints is online at:

www.cybercrime.gov.in

Many Indian states also have a helpline number for this - 1930.

=====

METHOD 2

Go to the nearest police station and report the incident.

If the offence is cognizable, police will register under Section 154 of the Code of Criminal Procedure (CrPC).

=====

IF they don't,

Send the complaint in writing and by post to the Superintendent of Police (SP) under Section 154(3) of the CrPC.

SP will either investigate or give appropriate instructions.

IF still no action,

Approach the magistrate under Section 156(3) of the CrPC.

The magistrate will give appropriate instructions.

=====

METHOD 3

Approach the magistrate directly. The Magistrate may also take cognizance of an offence.

The magistrate can examine the complaint and give appropriate instructions.

=====

METHOD 4

If the matter of is great urgency, approach the High Court directly under Article 226 of the Constitution.

High Court may then give instructions to investigate.

China has now introduced its system of "smart courts".

AI decides the case and passes judgement!

If the judge disagrees with the judgement of the AI, then he has to give a written explanation !!

AI suggests new laws, drafts legal documents, and alters 'perceived human error'.

Can AI kill the legal profession in 5 Years?

* 6 Broad Types of Cryptos *

✔︎ Non-fiat-backed currencies e.g. Bitcoin (BTC), Monero (XMR)
✔︎ Fiat-backed currencies e.g. Tether (USDT)

* Virtual Digital Assets (VDAs) *

✔︎ Mileage points

* What are Non-Fungible Tokens (NFTs)? *

NFTs are digital proof-of-ownership of an underlying asset such as:

✔︎ digital art
✔︎ collectibles
✔︎ domain names
✔︎ virtual game items
✔︎ physical assets

* NFTs backed by tangible assets *

The Government has issued a notification that an NFT will not be considered a VDA if it meets 2 conditions:

✔︎ The transfer of the NFT results in the transfer of ownership of an underlying tangible asset.

✔︎ The transfer of ownership of such underlying tangible assets is legally enforceable.
