Questa volta un giovane studente del Senegal potrà viaggiare nei prossimi giorni verso l’Italia per continuare i suoi studi. Dopo aver impugnato il rigetto alla sua richiesta di Visto, l’Ambasciata ha cambiato decisione e ha riconosciuto il Visto. Oggi dunque abbiamo chiuso la causa aperta presso il tribunale di Roma.

We did it again!
Despite the decisions of the Italian embassies that continue to hinder student visas, this time too a young student from Senegal will be able to travel to Italy in the next few days to continue his studies. After appealing the refusal of his visa application, the embassy changed its decision and granted him the visa. Today we have closed his open case in the Rome court.

Dedicheremo un corner a “KIDDO”, un progetto di artigianato tutto siriano: cinque donne di Swaida che hanno dato valore allo studio attraverso il divertimento; libri di stoffa per bimbi e bimbe, premiato tra i tre migliori progetti educativi del Medio Oriente nel 2023.
🎶🍸Tra musica e stuzzichini, potrete sostenere la campagna di Crowdfunding di Yalla, la raccolta fondi a sostegno delle spese per le azioni legali che portiamo avanti per ottenere i visti di ingresso per gli studenti che vogliono studiare in Italia: un visto in più è un posto in meno sui “barconi”.

في الأشهر الأخيرة، استقبل فريق يلا ستادي بعض الطلاب الذين تم رفض تأشيراتهم الدراسية إذ بدأنا عملية الاستئناف والاعتراض على قرار السفارة أمام المحكمة الإدارية.
ولم يوقف القاضي قرار السفارة بالرفض واستغرق وقتاً طويلاً للبت فيه.
من المتوقع في القانون الإيطالي أن القاضي هو الذي يتخذ القرار بشأن الاستئناف، لأسباب جدية، ويمكنه أن يقرر تعليق الرفض الذي أصدرته الإدارة، وفي هذه الحالة الإدارة هي السفارة الإيطالية.
ومن خلال تعليق قرار الرفض يصبح بإمكان الطلاب الذين طلبوا الحصول على تأشيرة, الحصول على نتيجة أسرع لطلبهم من القاضي.
وكما أوضحنا في البداية، فإن بعض الأحكام الأخيرة الصادرة عن المحكمة الإدارية التي لجأنا إليها بسبب رفض التأشيرة، لم تقم بتعليق الرفض، مما استغرق وقتًا طويلاً لاتخاذ قرار حاسم وموضوعي.
ولذلك طلبنا من مجلس الدولة (وهو هيئة قضائية أعلى من المحكمة الإدارية) تقييم ما إذا كانت هذه الممارسة الجديدة صحيحة.
وقد وافقنا مجلس الدولة بمطالبة السفارة الإيطالية، في الحالات التي تعاملنا معها، بتقييم الرفض بشكل أكثر عمقاً، نظرا لأنه في رأينا ليس لديهم أي أسباب لرفض التأشيرة.
الآن سيتعين على السفارة فحص القضايا مرة أخرى، وفي هذه الأثناء سيتعين على القاضي أيضًا أن يقرر ما إذا كان قرار السفارة صحيحًا.

Negli ultimi mesi il team di Yalla stadi ha preso in carico alcuni studenti a cui era stato rigettato il visto per motivi di studio proponendo un ricorso al tribunale amministrativo.
Il giudice non ha sospeso il rigetto prendendosi molto tempo per decidere.
Nella normativa italiana è previsto che un giudice nel frattempo che prende la decisione su un appello, per gravi motivi può decidere che sospendere il rigetto decretato dall’amministrazione in questo caso l’amministrazione è l’ambasciata italiana.
Questa possibilità di sospendere un decreto di rigetto aiuta gli studenti che hanno chiesto il visto ad avere più velocemente un esito della loro richiesta da parte del giudice.
Come abbiamo spiegato all’inizio alcune recenti sentenze del tribunale amministrativo a cui c’eravamo rivolti per altrettanti rigetti di visto, non avevano previsto di dover sospendere i rigetti prendendosi molto tempo per decidere nel merito.
Abbiamo dunque chiesto al Consiglio di Stato (che è un organo di giudizio superiore al tribunale amministrativo), di valutare se fosse giusta questa nuova prassi.
Il Consiglio di Stato ci ha dato ragione chiedendo all’ambasciata italiana nei casi che abbiamo trattato di valutare il rigetto in modo più approfondito, visto che secondo noi non avevano ragioni per rifiutare il visto.
Ora l’ambasciata dovrà esaminare di nuovo i casi e nel frattempo il giudice dovrà anche decidere se era giusta la decisione dell’ambasciata.

In recent months Yalla study team has taken in charge some students’s cases who had their study visas rejected by appealing to the administrative court.
The judge did not suspend the rejection and took a long time to decide.
In Italian law it is foreseen that a judge who in the meantime takes the decision on an appeal, for serious reasons can decide to suspend the rejection decreed by the administration,in this case the administration is the Italian embassy.
This possibility of suspending a rejection decree helps students who have requested a visa to have a faster result of their request from the judge.
As we explained at the beginning, some recent sentences of the administrative court to which we had turned for as many visa rejections, had not foreseen having to suspend the rejections, taking a long time to decide on the merits.
We therefore asked the Council of State (which is a higher judicial body than the administrative court) to evaluate whether this new practice was right.
The Council of State agreed with us by asking the Italian embassy in the cases we dealt with to evaluate the rejection in more depth, given that in our opinion they had no reasons to refuse the visa.
Now the embassy will have to examine the cases again and at the same time the judge will also have to decide whether the embassy's decision was correct.

The ‘Yalla, the right to study’ initiative by Forum per Cambiare l’Ordine delle Cose is supporting foreign individuals aspiring for a university education in Italy, facing obstacles in the process.
Forum assists students from Lebanon, Syria, and Palestine, helping them overcome bureaucratic hurdles imposed by embassies.
Since 2021, Forum has successfully initiated five litigations against Italian embassies abroad, resulting in victories for the students.

On the night of Feb. 25-26, 2023 a few dozen meters off the coast of Steccato di Cutro, Calabria, a boat that had departed from Turkey sank. In the accident 94 refugees from and other nationalities, died, while the number of missing is still unknown. In such cases people often speak of tragic fatality, but the Cutro shipwreck can be considered a state massacre in light of Italian and European policies on immigration, which are not based on reception but on containment.

BASTA MORTI NEI CPR: Chiudiamo Ponte Galeria!

🇮🇹 Il 4 febbraio, Ousmane Sylla, un ragazzo della Guinea di appena ventidue anni, si è tolto la vita in quella gabbia a cielo aperto che è il CPR di Ponte Galeria, nella periferia della nostra città.
Ousmane Sylla viveva da mesi la violenza della detenzione amministrativa: era stato recluso, a ottobre, nel CPR di Trapani e poi trasferito, a gennaio, in quello di Roma Ponte Galeria.
L’ennesima morte di Stato, che si aggiunge a quella di Hossain Faisal, Aymen Mekni, Orgest Turia, Moussa Balde, Wissem Ben Abdelatif e di tutte le persone che hanno perso la vita nei CPR e negli altri luoghi istituzionali dove sono recluse le persone migranti.
Non si contano più le violenze e i soprusi in queste strutture dell’orrore disseminate sul territorio italiano, periodicamente denunciati dalle persone recluse, che si ribellano alla violenza istituzionale del confinamento razzista.
I CPR sono luoghi di privazione della libertà personale in cui sono detenut3 i cittadin3 stranier3, perché privi di permesso di soggiorno, oppure dopo aver scontato la pena in carcere, o ancora perché considerati “finti” richiedenti asilo, detenut3 in condizioni disumane, espost3 alla violenza poliziesca e privat3 dei diritti più basilari: dal diritto alla salute a quello di comunicare con l’esterno.
La responsabilità per la morte di Ousmane Sylla e per le violenze quotidiane contro le persone recluse ricade sull’intera filiera istituzionale che gestisce i CPR: dal Governo alle Prefetture, fino alle Questure e agli enti gestori privati.
Per chiedere verità e giustizia per Ousmane Sylla, il rispetto della sua volontà di ritorno in patria del corpo, il rilascio e l’archiviazione della accuse contro i 14 solidali arrestati a Ponte Galeria, e in solidarietà con le proteste che continuano nel centro, mercoledì 7 febbraio alle 15.30 saremo in Piazza Santi Apostoli, sotto la Prefettura di Roma.
Questa sarà la prima tappa di un percorso cittadino che vuole la chiusura del CPR di Ponte Galeria, l’abrogazione di tutte le norme sulla detenzione amministrativa e la libertà di movimento per tutt3.

🇬🇧NO MORE DEATHS IN CPRs: Let's close Ponte Galeria!
On February the 4th, Ousmane Sylla, a Guinean 22-years-old boy, committed su***de in Ponte Galeria CPR, the open-air cage in the outskirts of our city.
Ousmane Sylla had been experiencing the violence of administrative detention for months: he had been imprisoned, in October, in the Trapani CPR and then transferred, in January, to the Rome Ponte Galeria CPR.
Yet another state death, in addition to those of Hossain Faisal, Aymen Mekni, Orgest Turia, Moussa Balde, Wissem Ben Abdelatif and all the people who have lost their lives in the CPRs and other institutional places where migrants are detained.
It’s becoming always harder to count the violence and abuses in these horror facilities scattered across the Italian territory, periodically denounced by detained people, who rebel against the institutional violence of their racist confinement.
CPRs are places of deprivation of personal freedom where migrants are detained, either because they lack a residence permit, either because they have served their sentences in prison, or because they are considered "fake" asylum seekers. They are detained in inhumane conditions, exposed to police violence and deprived of the most basic rights: from the right to health to the right to communicate with the outside world.
The responsibility for Ousmane Sylla's death - and for the daily violence against detained people - falls on the entire institutional chain that manages CPRs: from the government to the prefectures, up to police headquarters and private management companies.
We will be in Piazza Santi Apostoli, under the Prefecture of Rome, on Wednesday, February the 7th at 3:30 p.m. to ask for justice and truth for Ousmane Sylla; to keep his wish to return his body to his homeland; to claim the release and dismissal of the charges against the 14 supportive people arrested in Ponte Galeria; and in solidarity with the protests that continue in the center.
This will be the first stage of a citizen's path that demands the closure of Ponte Galeria CPR, the revocation of all regulations on administrative detention and freedom of movement for all.

في الرابع من فبراير/شباط، انتحر عثمان سيلا، وهو شاب من غينيا يبلغ من العمر 22 عامًا فقط، عثمان كان محتجزاً في "القفص المفتوح" في مركز احتجاز الترحيل في بونتي جاليريا، على مشارف مدينتنا.
وكان عثمان سيلا يعاني من عنف الاعتقال الإداري لعدة أشهر، فقد احتُجز في مركز الشرطة في تراباني، في أكتوبر/تشرين الأول، ثم نُقل، في يناير/كانون الثاني، إلى سجن بونتي جاليريا في روما.
ضحيةٌ أخرى تحمل مسؤوليتها الدولة، تضاف إلى وفاة حسين فيصل، وأيمن مكني، وأورجيست توريا، وموسى بالدي، ووسام بن عبد اللطيف وجميع الأشخاص الذين فقدوا حياتهم في مراكز إعادة التأهيل والأماكن المؤسسية الأخرى حيث يكون الأشخاص المهاجرين مسجونين.
لم يعد من الممكن إحصاء أعمال العنف والانتهاكات في هذه المؤسسات المروعة المنتشرة في جميع أنحاء الأراضي الإيطالية، والتي يتم الإبلاغ عنها بشكل دوري من قبل السجناء، الذين يتمردون على العنف المؤسسي للحبس العنصري.

تقع المسؤولية عن وفاة عثمان سيلا والعنف اليومي ضد السجناء على عاتق السلسلة المؤسسية بأكملها التي تدير اللجان الشعبية: من الحكومة إلى المحافظات، وحتى مقر الشرطة والهيئات الإدارية الخاصة.
للمطالبة بالحقيقة والعدالة لعثمان سيلا، واحترام رغبته في إعادة الجثة إلى وطنه، والإفراج عن المعتقلين وإسقاط التهم الموجهة إلى الـ 14 معتقل في بونتي جاليريا، وللتضامن مع الاحتجاجات المستمرة في المركز، ندعوكم يوم الأربعاء 7 فبراير الساعة 3.30 مساءً، لنكون معاً في ساحة سانتي أبوستولي Piazza Santi Apostoli، تحت مبنى الولاية Prefettura في روما.

من المهم أن تعلموا أن المستندات التي تطلبها السفارة في الرفض الأول للحصول على تأشيرة الطلب، هي مستندات لا ينص عليها القانون.
في معظم حالات الرفض الأولى التي رأيناها، تمت الإشارة إلى المستندات التي لا ينبغي السؤال عنها بشأن طلب التأشيرة والأسباب المكتوبة للرفض ليس لها أي أساس قانوني.
