The Private Security Regulation (Amendment) Bill 2024 is a strategic initiative aimed at amending Section 53 of the Private Security Regulation Act No. 13 of 2016. Once this legislative proposal is approved, the law will authorize the controlled issuance, ownership, and operational use of fi****ms by private security officers (security guards) assigned to high-risk tasks and critical infrastructure.

In their daily roles and routine performance of their duties, private security personnel (security guards) form the initial barrier and frontline defence against criminal threats, including acts of terrorism, robbery and armed aggression. However, the absence of defensive capabilities and security equipment significantly compromises their ability to protect themselves and the public effectively.

Message from the Authority’s Director General.

In the coming weeks and as I prepare to transition from my role as the Director General of the Private Security Regulatory Authority (PSRA), I reflect on the incredible journey we have undertaken together. From the very outset, I had an uphill task of building an institution and establish a regulated sector from ground zero - a task that required vision, dedication, courage and unwavering commitment.

From day one, my mission was clear - to elevate the private security industry in Kenya, ensuring that it stands on a solid foundation of professionalism, improved working conditions, better wages, opportunity for growth and an economically empowered 1.3 Million Kenyans working as private security officers.

These cornerstones we laid bestowed respect and honor to the security guards. Private security guards are no longer invisible; they are essential contributors to our nation’s safety. Their dignity and adherence to minimum wage - is no longer negotiable !

As and when I pass the torch to my successor, I am confident that they will carry forward with our noble commitment of ensuring the industry commits to professionalism and remain steadfast with the ultimate objective of economic empowerment of the over 1.3 Million Kenyans working as private security officers.

The Authority has been closely monitoring the concerns raised by private security guards regarding unauthorized deductions from their salaries to cover the costs of mandatory security training.

Pursuant to paragraph (c) of the Second Schedule of the Act, private security service providers are under legal obligation to provide basic and continuous training for their employees - private security officers.

In light of the above legal provisions, the Authority has firmly anchored its decision and has issued a legal advisory to the effect that it is the private security company and NOT the private security officer that SHALL cover the cost of the mandatory security training.

Therefore, effective immediately, no private security company shall deduct monies from private security officers (security guards) to cover security training costs. In addition, any security company that has already deducted monies from the security guard for mandatory security training must promptly refund the deducted amount.

Our Compliance Department yesterday burnt the midnight oil and is currently working around the clock, to review the compliance status of the private security companies with the set minimum wage directive of KES. 30,000/= for over 1.3Million Private Security Officers (Security Guards).

PSRA is committed to advocate for the enhanced welfare and uplifted dignity of Security Guards. These over 1.3 million Kenyans, risk their lives daily to protect us. For them, the KES. 30,000/= pay is not just about money; it represents dignity, honor, respect, and fair compensation for the immense dangers and harsh conditions they face in the course of their work. They deserve to be treated with honour, fairness and respect for their critical role in maintaining our safety and protecting lives and properties.

Any private security company that has failed to submit a duly signed and commissioned Legal Commitment to pay the Government set minimum wage of KES 30,000/= for Private Security Officers (Security Guards) by the close of business on 18th JUNE 2024 (17th was a Eid Public Holiday) will face IMMEDIATE CANCELLATION of their Certificate of Registration and subsequent DEREGISTRATION from the register of licensed private security service providers.

We shall compile and publish a list of compliant and non compliant companies with the set minimim wage of KES. 30,000.

In their daily roles and routine performance of their duties, private security personnel (security guards) form the initial barrier and frontline defence against criminal threats, including acts of terrorism, robbery and armed aggression. However, the absence of defensive capabilities and security equipment significantly compromises their ability to protect themselves and the public effectively. This limitation not only endangers the safety of these security guards but also impedes their capacity to execute their responsibility of protecting lives and property. In the recent past a number of security guards have been killed while on duty by armed criminals.

As part of the ongoing private security sector reform agenda, the Authority has proposed ammendments to the Private Security Regulation Act No.13 of 2016 with a view of empowering and sufficiently equiping the private security guards to posses and use fi****ms - The primary intent of these ammendment is to equip the private security officers with knowledge, skills, tools, equipment and capacity to detect, deter and effectively respond to security threats within their area of jurisdiction.

The Proposed Private Security Regulation (Amendment) Bill 2024 is a strategic initiative aimed at amending Section 53 of the Private Security Regulation Act No. 13 of 2016. Once this legislative proposal is approved, the law will authorize the controlled issuance, ownership, and operational use of fi****ms by private security officers (security guards) assigned to high-risk tasks and critical infrastructure.

Such high risk assignments include public spaces characterized by high human traffic, Shopping Malls, Cash in Transit, Maritime Security, Critical Infrastructure, Government Institutions and Institutions identified with elevated vulnerabilities and security risks.

This measure will be implemented under stringent regulatory supervision, ensuring adherence to established safety protocols for handling fi****ms and related operational use of fi****ms.

The Authority has consistently engaged and partnered with The National Assembly, with the primary intent of proposing the enactment of regulations and legislation aimed at enhancing professionalism and empowering the lives of over 1.3 Million Kenyans working in the private security sector in the country.

Yesterday, Parliament dedicated time from its demanding agenda of debating Kenya’s Budget for 2024/2025, to deliberate on the welfare and wellbeing of private security officers in Kenya. The debate focused on the established PSRA minimum wage of KES. 30,000 for security guards and the empowerment needs of the more than 1.3 million Kenyans employed in the private security sector.

The Authority is convinced that adopting this comprehensive, whole-of-nation approach and national strategy is crucial and will certainly shape the future of the private security industry in the country, in addition to ensuring that both the professionalism and welfare of private security personnel are effectively addressed.

The Authority has today issued a FINAL notice to all private security firms regarding the enforcement of the KES.30,000 minimum wage for private security officers.

As of June 10, 2024, many companies have complied and submitted their legal commitment to pay a minimum wage of KES 30,000. However, some firms are yet to submit their legal commitment to the wage standard as set by PSRA.

The Authority has issued a final notice and further warns that any private security company failing to submit a duly signed and commissioned Legal Commitment to pay the government set minimum wage of KES.30,000 for Private Security Officers (Security Guards) by the close of business on June 17, 2024, will face IMMEDIATE CANCELLATION of their Certificate of Registration and subsequent DEREGISTRATION from the register of licensed private security service providers in Kenya.

The stay order issued by The Honourable Court on PSRA Circular dated 15th April 2024 pertains to deductions and remittances of Private Security Officers’ Trade Union Fees and does NOT affect the legal provision for mandatory training, registration, licencing and issuance of Guard Force Numbers (GFN) to private security officers.

IN THE ABSENCE OF A COURT ORDER from a court of competent jurisdiction stopping the training, registration, licensing and issuance of Guard Force Numbers (GFN) as provided for under Sections 21, 22, 23, 24 and 25 of the Private Security Regulation Act No. 13 of 2016 - The Legal Notice No. PSRA/005/2023 dated 2nd November 2023 is still valid and in force and strictly requires ALL private security service providers to ONLY employ, hire, or otherwise engage private security officers (security guards) who have undergone training, security vetting, are registered and in possession of Guard Force Numbers (GFN) issued by the Authority.

The Guard Force Number is the ONLY proof that a Private Security Officer has been duly trained, registered and licensed by the Authority in accordance with the provisions of Sections 21, 22, 23, 24 and 25 of the Private Security Regulation Act No. 13 of 2016.

TAKE NOTICE: Our compliance and enforcement department is currently undertaking robust countrywide; assignment to assignment, door to door, client to client enforcement visits and field compliance operations to ensure that all users and prospective users of private security services only engage security companies whose private security officers meet the statutory requirements of training, registration and are in possession of Guard Force Numbers.
