LAND BUYING TIPS CLASS 1 OF 2024.
The very first step of buying a land, is going to the location where the land is physically located. You ensure you go to the land yourself or you have sent a reliable and honest representative if abroad that is.
Going to the land helps you in knowing each other with the buyer too.
When in the location ( with the help of Registered surveyor), identify the beacons and ensure that the land is accurately measured ( cases of plots)
2. Second step is asking for that land documents. Ask for the plot/ land Title deed or the Land Mutation Form ( Must be Registered with the Land Survey Department.). With the copy of TD , fill Official Search Applications forms ,attach your ID,KRA pin & pay the Search Fee on the Ardhisasa Platform.
Upeleke hiyo search forms kwa lands registry offices where the land is located. K**a shamba iko nyeri peleka nyeri lands registry.
After you have Applied for the Search, the Certificate will show:
1. The Real owner of the land.
2. Size of the land.
3. Signature of the land Registrar
4. Seal of the Land registry
5. It will show when that plot was registered at the lands green card
6. The names of who owns the land must match With the names at the search form.
After/If you are satisfied enough that the land is okay,Now with you, you have Official search ya hiyo land that you're purposing to buy.After that,before you even pay. Buy a Map/mutation . Map is bought at the land survey office. Make sure you buy a map. The map will tell you very well whether that land exists or not in that region. Ili ujue k**a ni public reserve, community land, restricted lands, etc etc..... Take it to your lawyer or the officials at the lands Registry and ask whether it is okay to proceed. If okay, go back to the owner. Mkae chini mkiwa watu watatu au wanne.

This step, The lawyer will draft The sales Agreement. You enter into a contract with the buyer. Make sure you carry a copy and the other one is left with the seller and your lawyer.

After that, we have something we call LAND CONTROL BOARD.
Land control board is a very important step. Hapa ndipo the seller & the buyer meets infront of team of government officials. This board meets once per month . So the buyer and seller must ensure it is booked before. Board will cost you. After this the consent is given to you. Hii ni important sana. This document gives permission to the seller to transfer that land to you.
So far you have the:

2. The search
3. The sales Agreement
4. The Receipts
5. The Consent Forms
Let's proceed. Don't we?
After the consent is out and okay, You as the buyer prepare the following to facilitate transfer process.
1. Copy of ID card / Passport
2. Copy of KRA pin certificate
3. Coloured passport size photographs
Same case the seller will prepare the same documents.
Then from here...we have a document called Transfer of Interest in Land. This is the last document we have in Land Transfer process.
This document shows all the details of the seller & the buyer, spaces for passports, signatures, title number.This is the document that the Land registrar shall use to print you a copy of New Title deed. This document must be properly filled and any ommission or mistakes should be avoided properly.
After this document is prepared. It is then taken to the valuation department.
We proceed?
After the valuation is done, the stamp duty is paid. You can agree with the seller on who should pay the stamp duty. But most of the times the buyer pays the stamp duty. The stamp duty is paid in percentages depending with the location of the land. Payment of stamp duty is done at the ardhisasa platform.
From there. Ensure the following documents checklist is attached, signed by lawyer and certified:
1. Copy of TD
2. Copy of seller & buyer ID & KRA
3. Copy of Transfer forms
4. Copy of Valuations forms
5. Copy of Registration Forms
You attach all of them, then pay New Title Fees, Registration of Title Deed Fee and attach all Receipts.
Hiyo document ikiwa yote sasa, upeleke au uhakikishe imepelekwa na Seller ( k**a mtaelewana) kwa LANDS REGISTRY.
After the transfer documents zimepelekwa huko, Wait for the Documents proper scrutiny by the Registrars Office. It will take time, give them time, if any mistakes of signatures or any documents missing, they will reject it for you to correct or attach what is needed.
land registries can process your new title deed within 2 to 3 months. Give them time and let the government do their work.
BUYING LAND IS A WHOLE PROCESS, NOT AN EVENT!
