This responsibility will persist even if the employer contracts the work through an intermediary."

Article 93 Income Tax Law, Fraction III: "Income tax shall not be paid for the receipt of the following income: Compensation for work-related risks or illnesses, granted in accordance with the laws, collective labor agreements, or statutory contracts."

Article 27 Income Tax Law, Fraction I: "Be strictly indispensable for the purposes of the taxpayer's activity."

Article 475 Federal Labor Law, Title IX: "Occupational disease is any pathological condition derived from the continued action of a cause originating or motivated by work or the environment in which the worker is obliged to provide services."

Flow of the strategy.

Proposal for payroll redistribution is made.

Contract for IERP (Income and Risk Redistribution) Administration is signed, establishing compliance with the Constitution and the collective agreement in accordance with the Income Tax Law.

Application of the medical questionnaire and psychosocial risks to all workers. With the information obtained and an analysis of job positions, the IERP catalog is created.

Operation

Submission of resources as a contribution to the IERP Portfolio.

Corresponding CFDIs are issued.

Dispersion of compensations based on the payroll redistribution layout (point 1 implementation).

Issuance of CFDI to each worker, with the concept of Payment for Work-Related Illness.

Monthly preparation of the medical report based on the IERP catalog.

Beware of contractors!

So, what is the worst thing that can happen if the contractor fails to give the client a factura?

When you decide to sell the property, you cannot deduct construction costs, and the notary will consider such costs to be one (1) peso.

One case where the client is left in a bad situation:

"I purchased a home and had a contractor build me a 2nd floor and a pool; I plan to sell the property. Are there any negative consequences if I do not get a factura from the contractor?"
Yes, when you sell the property, the notary will report the cost of construction to be one (1) peso.

This applies to EVERY peso invested to upgrade the home. Even if you purchased a lot and built a home on it, no factura, no deductions.

Do you see now why you must always demand a factura?

How DONATIONS work in México.

There's a lot of different types of donations, however in general:

The organization or person RECEIVING the donation MUST be able to issue a fiscal receipt that's tax deductible.

In order to be able to do so, the person or organization must have or be involved with a CIVIL ASSOCIATION, AC for short.

People traveling and offering activities (SUCH AS YOGA CLASSES) in exchange for donations that end up in their pockets hardly fall into this category.

The donations received are supposed to be to help someone else, not an exchange for services rendered without a price tag.

This is how the government closes loopholes:
SAT is going for landlords accepting cash and deposits abroad without declaring the income here.
How?
If you have a controversy with your renter, (if he stops paying the rent for instance) and you want him out, the judge WILL require you to show your fiscal declarations of income.
If you don't have them it (your claim) WILL NOT PROCEED, and the judge is required to notify SAT.
If you're having one of those rental companies "take care of everything" for you and you're not declaring your income here, you may end up loosing your property for a few years if not forever to a lousy renter that won't leave.
Is it worth it?

About 35 years ago I became an expat, migrating from CDMX where I was born to the US. My career led me to become a Minnesota Supreme Court Spanish Interpreter, as well as a medical Interpreter. I also got my Real Estate License.

Mexico’s Tax Administration Service to Strengthen Its Supervision of Entities with VAT and IEPS Certifications

Through communication number 030/2023, published on the website of Mexico’s Tax Administration Service (SAT per its initials in Spanish) on July 5, 2023, the SAT agency reported that during the first half of 2023 it detected non-compliance by more than 500 companies in relation to their value added tax (VAT) and special excise tax (IEPS) certification obligations, consisting mainly of entities in the textiles, aluminum, steel and automotive sectors.

Per the foregoing, the SAT indicated that as a result of its findings it has quadrupled the number of inspection visits to companies that have such certifications. These inspections have resulted in the cancellation of 75% of the certifications held by the visited companies, and the imposition of tax liabilities amounting to more than 8.3 billion pesos.

Additionally, the General Administration of Foreign Trade Audit of the SAT reported that it will strengthen the supervision of companies which hold a VAT and IEPS certification in order to combat the improper use of tax benefits granted by such certifications.

Based on the above, companies should promptly review their correct compliance with applicable VAT and IEPS certification obligations, particularly with regard to the timely return of temporarily imported goods, as well as the registration of their operations in Annex 30, to avoid the cancellation of their certifications or the potential levy of tax liabilities.
