2nd and final part. (Continued from 1st part)

In that confusion, Mr A summoned the Agent that showed him the initial plot, the Agent came and insisted it was the plot the Mandate showed him. Mandate was called, he came and insisted that was where the then PA of the owner showed him. Owner (seller) himself was called, he said he had never been to the plot, that it was his then PA that was shown the plot when it was allotted to him. The then PA, who had relocated out of Abuja at the time, was called, and he admitted that the person who showed him the plot stood at a distance and pointed the plot for him. He said they couldn’t get to the plot as the area was still a bush then. He said he noted the estimated boundaries of plot with trees as shown to him by that person, and it was those trees he showed the Mandate.

After everything,  Mr A regrettably settled to his reality, if he was shown the actual plot, he wouldn’t have bought it, or at least he wouldn’t have paid that amount he paid. He  couldn’t imagine himself pursuing a refund. The Agent and Mandate couldn’t say anything apart from begging Mr A to accept the actual plot. The plot seller was angry, especially at the Mandate whom he had known for long, for the embarrassment he has caused him, especially given the fact that he had already invested the sales proceed in other ventures, and so, refund would be so stressful and difficult. At the end, Mr A reluctantly took the actual plot, while the Agent and Mandate both lost their long standing relationships with their respective principals.

1st part.

Someone was searching for land to buy in Abuja (let’s call him Mr A). An estate agent he had known for a  long time showed him a particular piece of land at Gaduwa District. Mr A liked the plot. Although the neighbourhood roads were not yet tarred, it was very accessible and a few plots in the neighbourhood were already developed, some of them inhabited. The plot perfectly fits the profile of what he was looking for, in terms of location, price, size, level of development and title.

Mr A’s interest was further strengthened when he learned that the seller was the initial allottee, and that the seller in fact, was a respected top government official who had recently retired, and also was readily available to conclude the transaction and sign off the transfer documents. So there was no foreseeable risk. He then successfully conducted Legal Search and paid. Everyone was happy - the seller, the Agent, the Mandate and of course, Mr A.

Few weeks later, Mr A decided to construct a dwarf perimeter fence on his new plot, at least to show active possession pending when he is ready to develop or re-sell the plot. After bringing some of the materials to site – sand and blocks, He contracted a surveyor to establish the exact boundaries of the plot for the purpose of building the perimeter fence. THAT WAS WHEN CONFUSION SET IN.

The surveyor told Mr A and his workmen that the place they brought him isn’t the actual plot represented by the papers and coordinates at his hand. The surveyor further informed Mr A that if indeed the paper at his hand was the one he bought, then, his actual plot on ground was still farther inside, and not the place he intended to build the fence. He then proceeded to show the actual plot while Mr A reluctantly followed. It turned out that the immediate area of the actual plot was far less developed and less accessible.
