THE RIGHT OF AN ACCUSED TO BAIL

Dear friends and fans,

I feel obliged and compelled to make this short post touching the subject matter.

It is very common and pathetic, the way and manner in which an accused person is treated by Law Enforcement Officers in Nigeria.

It is an affront and a total disregard to the rights and liberty of an accused person, guaranteed and protected by the 1999 Constitution of the Federal Republic of Nigeria as amended and the Administration of Criminal Just Act 2015.

By the provisions of Section 36(5) and 158-188 (depending on the nature of the crime) of the above mentioned Statutes, an accused person is presumed innocent until proven guilty.

But this isn't the case with the Nigerian Officers. They sentence an accused even before he/she is arraigned before the appropriate authority.
