THE RIGHT QUESTIONS TO ASK BEFORE EMBARKING ON YOUR BUILDING CONSTRUCTION PROJECT
A lot of resources are being lost in the real estate sector because of lack of knowledge. There are just too many people who think all they need to do when they want to build a house is to purchase a piece of land, mold blocks, and hire labourers! You will hear them ask questions like โhow many blocks will I need to build a 3-bedroom bungalow? Is it cheaper/better to mold blocks or buy? How much will it cost to dig a well so the labourers can have water for their work?โ These are good questions if you are building in a rural area but for urban areas, they are not the questions you should be asking at the beginning.
You should be asking questions such as:
Is it safe to purchase this land?
Will I have any issues with the government if I purchase this land?
Will I be able to get a good title?
Is this land outside the minimum setback of the closest public utilities?
Will I be granted a building permit for a 3-storey building here?
Will the cost of the foundation be too high because of the terrain/topography that it may be better to look for land elsewhere?
In this location, can I start building immediately after purchase?
These are questions that professionals can answer for you. And it is after you are satisfied with the answers that you should start worrying about blocks! This year alone I have seen someone who was denied a building permit (setback issueโpower line), another one was given a demolition notice (setback issue-canal) and the last one was asked to stop construction work with immediate effect (8 mini-flats with no parking space).
Asking the right questions before embarking on a building project will save you precious time and money.
LAND BELONGS TO GODโฆโฆโฆ.AND THE GOVERNMENT
Recently, I had a conversion with a lady whoโs into real estate sales and I found myself trying to explain to her that in Nigeria, by law, all land belongs to the government. She was surprised and said, โthat may be true in Lagos but itโs not so in Portharcout. I have done deals in Portharcourt that had nothing to do with the governmentโ. The truth is, the law recognizes indigenous ownership of land but all land belongs to the government.
It is for this reason that the government gives you a Certificate of Occupancy and not a Certificate of Ownership. You are given exclusive rights to the land and allowed to occupy it for a period of time. So, what you have is a right of occupancy and nothing more. This right can be revoked if you do not abide by its terms and conditions and if the land is needed by the government for the benefit of the public. And, even when you decide to sell the land, you canโt sell it legally without the consent of the government. Thatโs why the government issues every subsequent owner of the property a Governorโs Consent title.
This law is not unique to Nigeria. It is the same in most countries. And I think its origin is ancient because in the Old Testament book of Leviticus God said, โThe land shall not be sold permanently, for the land is Mine; for you are strangers and sojourners with Meโ.

Requirements for Regularization of Title on Federal Government Grant in Lagos state
If your property falls under federal government acquisition and you want to get a C of O from Lagos State through regularization, these are the requirements. Please note that not all federal government lands can be regularized like this so you need to find out for your area first.
1 Formal letter addressed to the Executive Secretary, Land Use and Allocation Committee Block 12 Room 5, Lands Bureau, Alausa
2 Standard Allocation Form (Free)
3 Purchase Receipt
4 Passport Photographs 5cm x 5cm with white background in case of applications for individuals
5 Tax clearance certificate of the applicant
6 Development Levy
7 Copies of Form C07 (Company)
8 Two Directors Tax Clearance Certificates and Development Levy(Company)
9 Attached Survey Plan in CTC (must be clear and chartable)
10 All payment receipts of Land Charges for the Federal Government Allocation
11 Certified True Copy of the root of Title
12 Picture of the site showing adjoining properties (left & right)
13 Letter of indemnity (in favour of Lagos state government)

STEPS TO OBTAINING C of O FOR STATE OWNED LAND
The Applicant should obtain a form from the Ministry (Land Use and Allocation Section) or download same from their website and submit the application form with the following attached;
Tax clearance or Evidence of being domiciled abroad.
Passport Photographs (3 copies)
An official receipt for application fees of #5,000 for residential land use or #10000 for Commercial land use.
Applicant collects an acknowledgment slip as Evidence of payment.
Applicant collects Letter of allocation.
Applicants pay for allocated land (In a period not less than 90 days)
The Letter of confirmation is issued to the Applicant with a plot and block Number.
The Scheme Officer begins processing the application for the C of O, signs off on the file, and forwards the files to the Executive Secretary of Land Use Allocation
Commission. (LUAC)
The Surveyor General provides Scheme Officer with a digitized survey copy.
The Executive Secretary to LUAC approves processing and signs a letter of allocation.
The Executive Secretary LUAC signs off on the file.
The Executive Secretary LUAC sends the file to the Senior Special Assistant (SSA) to the Governor.
The Senior Special Assistant, Lands examines the entire file and sends it with a covering memo to the Permanent Secretary (PS) Lands Bureau
Should the file have a query, the message is relayed back by notification for correction.
The Permanent Secretary Lands Bureau signs off on the memo and sends the file to the Governor.
The Governor then approves the file and electronically signs the C of O.
If the file has a query, a message is relayed back by notification.
Once the C of O has been approved and signed, the Governor signs off and sends the file to the Deputy Registrar for further processing.
The Deputy Registrar processes the file further, signs off, and send the file to the Registrar of Titles for final registration.

WOES OF ACQUIRING LAND IN LAGOS STATE โ OMONILE ISSUES
Over the years I have seen and heard stories of people who struggled to acquire land, acquired land and struggled to keep it, acquired land and lost it, acquired land and never set eyes on it. The stories are just too many. Investing in real estate is usually straight forward but in Lagos, sometimes, it can be unnecessarily difficult. You need to investigate, use professionals and pray! Yes, pray.
The majority of land issues is caused by dishonest land owners popularly known as omoniles. The honest ones will not give you any problems at all. They will always be available to help with whatever you need. But may you not fall into the hands of the dishonest ones. One experience with them can discourage you from investing in real estate ever again.
There should be a way to curb the excesses of these omoniles. One thing I believe can be done without delay is to make it illegal for them to sell their lands directly to individuals. Every property transaction with an omonile will be null and void. They should be made to do business with approved real estate companies only. The business relationship/partnership between them (omonile and the real estate company) will be registered with the government and the real estate companies will deal directly with them, shoulder the risks and help them sell their lands. This will help eliminate problems like paying for the same land twice, paying for land that several other people have paid for already, moving your land from one place to another because someone offered more money, forcing clients to use their family surveyor, thuggery, etc. It will also help reduce land-related court cases and unnecessary wasting of time and resources on property investigations.

A Survey plan is a document that measures the boundary of a parcel of land to give an accurate measurement and description of that land. The people that handle survey issues are Surveyors and they are regulated by the office of the Surveyor general in Lagos as it relates to survey issues in Lagos. A survey plan must contain the following information:
1. The name of the owner of the land surveyed
2. The Address or description of the land surveyed
3. The size of the land surveyed
4. The drawn out portion of the land survey and mapped out on the survey plan document
5. The beacon numbers
6. The surveyor who drew up the survey plan and the date it was drawn up
7. A stamp showing the land is either free from Government acquisition or not
