Whangarei councillor proposes rejection of fluoridation directive
Councillor Gavin Benny will be proposing at the 28 November 2024 council meeting for the council to reject the Director-General of Health’s (Dr Diana Sarfati) directive to fluoridate Whangarei.
Cr Benny is calling on his fellow councillors to do the right thing and refuse to add a neurotoxin to the public drinking water.
In his Notice of Motion, Cr Benny outlines the harms associated with fluoridation, the Court ruling by the Federal Court in the US that “fluoridation poses an unreasonable risk to human health” and the fact that all new evidence is finding fluoridation has very little or possibly no benefit at all.
The Whangarei District Council are one of 14 councils that have been ordered to add fluoridation chemicals to their drinking water, despite the lack of evidence of benefit or safety, or potentially face severe fines – $200,000 plus $10,000 per day they continue to not fluoridate.
However, as stated by Justice Radich in the June 2024 High Court ruling, they do have the option of seeking an Interim Injunction until the New Health New Zealand (NHNZ) vs the Director-General of Health (DGoH) case is heard. NHNZ is challenging the legality of the directives. A Point of Clarification in November 2023 found the directives were unlawful because the DGoH had not completed a Bill of Rights analysis. However, the directives are still considered “valid”.
Recently, Tauranga City Council voted to start fluoridation under what appears to be incorrect legal advice. It appears they were told that even if they had an Interim Injunction, they could still be held liable, even personally liable, if the NHNZ failed. This is completely not true. Justice Radich would not have mentioned it if it was.
Cr Benny is calling on other councils to also reject the directives. It is hard to fathom how forcing councils to add an undisputed neurotoxin to their community’s water supply can be happening. Councillors must stand up to this tyranny as they have a legal obligation to do so under section 23 of the Health Act.

New Zealand First passes remit to put fluoridation decision making back to councils
Last weekend (12 Oct), at a packed conference of 275 delegates, New Zealand First overwhelmingly passed a remit to advocate for the repeal of the Amendment to the Health Act that gave decision making to the Director-General of Health (DGH). This Amendment, made in 2021, provides no right for communities to be consulted in any way and, in fact, threatens huge fines for councils who endeavour to prevent fluoridation.
History is littered with health professionals refusing to accept new information. One of the hardest to comprehend is the case of doctors refusing to try washing their hands before attending births, which was often after doing autopsies, as Dr Ignaz Semmelweis advised them to do in the mid-1800s. At the time, 18% of mothers were dying after childbirth from contracting a bacterial infection. It took a few more decades of mothers dying before doctors would incorporate this simple protocol.
The Tauranga City Council decision from Monday this week, where a majority of the councillors voted to start fluoridation despite serious reservations, highlights why decision making for fluoridation needs to be with the community. People who are not so invested in the political ramifications about a particular decision are much more capable of making an objective decision. Threatening people with huge fines to do something that goes against their conscience is straight out bullying.

Tauranga City Council voted by majority to add a developmental neurotoxin to their community water supply.
On 14 October the Tauranga City Council voted by majority to add a developmental neurotoxin to Tauranga’s water supply, permanently damaging the brains of the next generation of the children to be born in Tauranga. They did so because they voted to follow, rather than challenge, the directive from the Director-General of Health, Diana Sarfati, to fluoridate the city's water supply.
We applaud Mayor Drysdale and councillors Glen Crowther and Marten Rozenboom for doing their utmost to prevent fluoridation from starting.
However, from the discussion it was clear that councillors had received seriously false legal advice which led to the other councillors being too afraid to take a stand.
Councillors were clearly under the misbelief that even if they applied for and received an interim injunction against the directive, they could still be breaking the law. This is not the case They also seemed to believe that the Council, and perhaps themselves personally, could be fined under these circumstances.
They seemed to have been led to believe that following due legal process put them in the same category as residents who refused to pay rates without going through such a legal process. It does not.
The privilege in the legal advice received belongs to the elected members, not the executive. Therefore, we call on the elected members to release the legal advice they received, in the spirit of open democracy.
The real culprit here is the Director-General of Health. She has refused repeatedly to look at the latest science that shows, without any real doubt, that fluoridation is not only ineffective in reducing tooth decay but is seriously damaging health. This has been known since at least 2006. Instead, she quotes a WHO decision (from thirty years ago), and New Zealand reviews that were cursory in nature and contain serious flaws. The 2014 Chief Science Advisor’s Report contains a serious error where it claims the 7 IQ point loss from higher fluoride (described as “less than one standard deviation”) as “of no functional significance”. The 2021 follow-up review carried on the misconception.
To put this in perspective, the Ministry of Health kept insisting that Lead -in petrol and paint was safe for 20 years after the rest of the world had stopped it. The Ministry has never admitted that 245T (which it endorsed) caused cancer. The Ministry continues to proclaim Mercury amalgam tooth fillings are safe when Sweden (for example) banned it in the 1990s, and the rest of the world is about to ban it, and our Food safety Authority tells us not to eat more than 250gm of fish a week due to ovoid overexposure to Mercury. The Ministry continues to support the poisoning of our forests with 1080 when the rest of the world has banned it.
Councillors have the legal means to push back– they just need sound (rather than unsound) legal advice and the moral fortitude to do so.

Tauranga City Council has adjourned this morning's meeting to get legal advice. We assume the advice is on what their options are around seeking an Interim Order, although we won't know this for sure until they reconvene. They think that will be around 1.30 today but depends on availability of lawyers.

Fluoridation ruling could turn tide of public opinion Less than half of Wairarapa’s population consume fluoridated water and a recent overseas ruling brings the spotlight back on to the controversial issue.
Tane spoke to Kane Titchener from Fluoride Free NZ at the recent NZDSOS conference in Auckland.
“The news out of the US that the court has determined that fluoride is an unreasonable risk to put into the water supply, this is a huge ruling because it means to mitigate that risk we now need to stop fluoridation.
We expect this to spill over from the US into NZ, because we’ve got exactly the same situation here. We actually fluoridate at a higher level, so between 0.7 and 1 part per million, the average is about 0.85.
It means that the effects that the judge has ruled on in the US , which is that it is an unreasonable risk regarding the neurotoxicity of fluoride, in particularly infants and babies, shows that it can no longer stand in NZ”.
