MAEd - Legal Aspects in School Management and Supervision

Problem: A teacher marries her student, and the school administrator terminates her appointment on the grounds of immorality. Is the management's decision proper?

The Supreme court said:

The management utterly failed to show that the teacher took advantage of her position to court her student. If the two eventually fell in love, despite the disparity in their ages and academic levels, this only lends substance to the truism that the heart has reasons of its own which reason does not know. But, definitely, yielding to this gentle and universal emotion is not to be so casually equated with immorality. The deviation of the circumstances of their marriage from the usual societal pattern cannot be considered as a defiance of contemporary social mores (Chua-Qua vs Clave, G.R. No. 49549 August 30, 1990).

To all my MaEd students enrolled in the course in "Legal Aspects in School Administration and Supervision" be ready to answer the following case problems next meeting:

1. The Department of Education issued a department order requiring all students to attend the flag ceremony, salute the flag and sing the National Anthem. However, a parent from the religious sect "Jehovah's Witness" approach you to exempt her children from saluting the flag for it is against their religious beliefs. The parents invoke her Constitutional right regarding religious freedom. The DepEd Order commands all school officials to strictly implement the order without exemption. How will you handle the situation?

2. Ms. Teacher A is a teacher of the Tabako University teaching English under the Senior High School Department. When Teacher A was hired, she got pregnant without contracting marriage. At the middle of the School year, the Ethics Committee recommend, after complying with due process requirement of the law, to the Office of the President her immediate termination of her employment based solely on the ground of pregnancy outside marriage. If you are the President, will you approve the recommendation? Why or Why not?

3. Professor XYZ was hired as an Assistant Professor IV at Wanbol University, a private Higher Education Institution, on August 1, 2020, with a probationary status. On August 1, 2023, he earned his PhD and was granted "Permanent" status. Concurrently, he was promoted from Assistant Professor IV to Associate Professor II and his hourly rate increased from 700 to 900 per hour. However, during the semestral break, Professor XYZ noticed that he was not entitled to pay. He subsequently demanded that the university administration provide him with pay during breaks, arguing that his permanent status should entitle him to continuous remuneration regardless of his teaching load. Do you agree with the demands of Prof. XYZ? Why? Or Why not?

4.On November 8, 2023, Dr. Pre Dentist was appointed as University/College President with a Salary Grade of 29 while Professor Enrico Chavez was appointed as Professor IV with Salary Grade of 27 at the Pamantasan ng Tabuko.
The appointment papers were submitted to the Civil Service Commission on November 15, 2023. On November 16, 2023, Mr. Department Head filed a protest with the Civil Service Commission contending that the appointment of Dr. Dentist and Prof. Chavez must be disapproved for the reason that the salary grade of Prof. Chavez is higher than the City Department Head of the City of Tabuko while the Salary Grade of Dr. Dentist was higher than that of the Vice Mayor of Tabuko. Mr. Department Head contends that the highest salary grade to be given to any employee of Pamantasan ng Tabuko cannot exceed the salary grade of 25.

Assuming that all other requisites are complied, if you are the Regional Director of the Civil Service Commission, will you approve the appointments? Why or why not?

5. Mr. Arnold Cansicio is a permanent faculty member at Tabuko State University, holding the rank of Assistant Professor IV-SG 18. According to university regulations, the regular teaching load for permanent faculty members is 21 units. However, Mr. Cansicio has a total teaching load of 30 units, with 9 units exceeding the standard 21 units. Notably, all of Mr. Cansicio’s teaching units are scheduled between 8:00 AM and 5:00 PM.
When the faculty overload pay was released, Mr. Cansicio's name was not included in the payroll. Upon inquiring with Mr. Armie Suclag, the HR Head, Mr. Cansicio was informed that he is not entitled to overload pay because it would constitute double pay. Mr. Suclag explained that to qualify for overload pay, the additional teaching units must be scheduled beyond 8:00 to 5:00PM or on Saturdays.
Mr. Suclag invoked Civil Service Commission (CSC) Memorandum Circular (MC)19 Series of 2005 entitled “Model Merit Systems for Faculty Members of State Universities and Colleges (SUCs) and Local Colleges and Universities (LCUs). The said MC stated in part:
“Faculty members, except those covered by special laws, shall render not less than 8 hours work per day for 5 days a week of a total of 40 hours a week, exclusive of time for lunch. The 40 hours shall include time for teaching, student consultation, research and extension work and other activities relevant to teaching, e.g. preparation of lessons, checking of papers, etc.”
Hence, the HR Head opined that his month rate is paying him 40 hours per week. If he will be paid additional compensation, he will be receiving double compensation.
Mr. Cansicio, without any knowledge of existing laws, gave his opinion based on the equity and fairness that any unit(s) assigned to faculty member beyond 21 units should be considered an overload and hence, must be entitled to overload pay.
Who is correct? Mr. Cancisio or Mr. Suclag? Give legal bases.

6. On August 1, 2020, Dr. Alexander Batios was appointed as President of the Dalubhasahan ng KalanBanga, a local college established by the Municipality of KalanBanga. He was appointed by the BOT Chairman, Mayor Timoteo Chipemo. However, during the May 2022 local election, Mayor Sampaguita Bonifacio was elected as Mayor of KalanBanga.
On July 1, 2022, Mayor Bonifacio sent a letter to PresBatios urging him to submit his courtesy resignation. According to Mayor Bonifacio, the position of a LUC President is based on the trust and confidence of the Mayor and hence, can be terminated anytime at the pleasure of the mayor.
Is the Mayor correct? State your legal basis.
