The Basilica of Taal, completed in 1878, and dedicated to St Martin of Tours is the biggest church in the Philippines (and they claim in all of Asia). It is a testament of faith that this small town built so impressive a church. It should be better known and studied.
Compare the church circa 1900 (Top) with that in May 2023 (Bottom). I wish I knew how to take better pictures. Off-hand the new steeple resembles a baby bottle ni**le.
The church exterior shorn of its plaster covering or "palitada" is quite romantic because you see what is often hidden under whitewashed plaster, but I should ask my friends in the historical preservation sector if stripping a structure of its protective "skin" for aesthetics is good in the long run.
Instead of crying over structures long gone like the Jai Alai building or the recently burned Manila Post Office shouldn't we be more pro-active and take a second look at extant heritage at risk and not wait for disaster to strike.

We are alarmed by the news of an alleged hacking of COMELEC servers. We ask COMELEC to immediately confirm if it happened and the extent of the compromise involved.

Drilon defends SBN 1530 against OSG attacks, cites DOJ backs bill on non-expiration of franchise with pending renewal application in Congress


Senate Minority Leader Franklin M. Drilon raised the opinion made by Justice Secretary Menardo Guevarra, Solicitor General Jose Calida’s boss, to dispute and counter the Office of the Solicitor General (OSG) which called “unconstitutional and illegal” the proposed legislation that provides for the non-expiration of a license where the licensee has filed a timely and sufficient application for renewal, until a final determination by the agency is made.

“Justice Secretary Guevarra, on several occasions, has rendered an opinion which acknowledges a gap in the law concerning the grant of legislative franchises by Congress. Senate Bill No. 1530 simply seeks to address the gap in the law cited by our good justice secretary,” Drilon said in a statement on Friday.

Drilon also stressed that the Department of Justice, in its official position paper expressing support for SBN 1530, said that there is “nothing legally objectionable in the passage of a law of general application which allows the grantee of a franchise to operate while its application for renewal is being deliberated by Congress, it being an adjunct of its franchising, power which, in turn, is an adjunct of its legislative power.”

“It’s all a matter of equity that we want to address here, nothing else,” he added.

“Driven by nothing but the common good and the rule of law, the DOJ’s official position and the Justice Secretary’s opinion which he made public on various occasions carry a lot more weight and credibility,” he added.

Drilon called on Congress to immediately enact the measure when it resumes session on January 17 and takes a long break for the campaign period on February 4.

Drilon cited Guevarra’s statement during a Senate hearing in 2020 where the justice secretary expressly stated that ”When there is a gap in the law, equity comes in to fill the gap. Equity is the principle by which substantial justice may be a thing in cases where the prescribed or customary forms of ordinary law are inadequate.”

During that hearing, Drilon recalled, Guevarra even cited that “considerations of equity have apparently been applied in previous similar situations presented earlier namely, among others, PT&T, SMART Communications, Incorporated, Catholic Bishops Conference of the Philippines, Incorporation. All of whom were allowed to operate despite expired franchises as long as the application for the renewal of these franchises were lodged with the Congress before the lapse of their term.”

Drilon said the justice secretary’s position was cited in Senate Resolution No. 395, adopted by the Senate in May 2020, which expressed the sense of the Senate to reconsider its cease and desist order against ABS-CBN Corp.

“It is acknowledged that there is a gap in the law in cases as exhibited in cases where a franchisee, having taken all the steps to renew its franchise, is unable to do so not due to its own fault, but due to Congress’ failure to act on the application,” Drilon said.

“The amendment we propose would require the concerned agency or branch of government to act decisively on an application for renewal, and to express its decision in clear, unmistakable terms, to ensure that the applicant is not punished for the authority’s indecision or inaction,” Drilon said.

Drilon, who authored Senate Bill No. 1530, said the measure seeks to provide an immediate solution to dilemmas being faced by franchise applicants whose renewal of legislative franchises have been filed but remained pending in Congress.

The measure was passed on second reading before Congress went into Christmas break last December 14.

SBN 1530 seeks the non-expiration of legislative franchises that are pending in Congress by amending Section 18, Book VII, Chapter 3 of Revised Administrative Code, Drilon explained. The Revised Administrative Code provides for the non-expiration of a license where the licensee has filed a timely and sufficient application for renewal, until a final determination by the agency is made.

Drilon’s amendment only expands the said provision to also include franchises granted by Congress.

When the bill was tackled in the committee, various sectors including the Kapisanan ng mga Brodkaster ng Pilipinas (KBP) threw its support behind the measure.

“This bill addresses the unfortunate situation where renewal for franchise applications are filed before expiration but are not acted upon in time,” said KBP President Ruperto S. Nicdao Jr.

G*t Jose Rizal lost his life owing to the corrupt justice system at the time. But what emerged was his loyalty to and love for our country, which is why Emilio Aguinaldo ordered in 1898 the annual commemoration of Rizal’s ultimate sacrifice. Over time, the relevance of Rizal’s spirit and actions have grown even stronger.

This is not only because of his humility -- Rizal wanted a simple burial and a simple tomb with just a cross and his name on it, and the dates of his birth and death. This is what a real hero is: one who seeks neither fame nor the burial place of heroes.

Rizal becomes even more relevant in light of present challenges. We all need to stand up for what will benefit our country. With our every word and action, we are forging the future, not only for our family, but for all of us, especially our countrywomen and men who suffer from poverty and inequality. They are the ones who were closest to Rizal’s heart, and he sacrificed his life for them. Our time calls for an equally fervent commitment to justice and to doing things right.

How to unmask trolls?
Trolls, fake account users face up to 12-year imprisonment, P200K fine, Drilon says

With the proliferation of trolls, Senate Minority Leader Franklin M. Drilon proposed a quick-fix solution to unmask trolls and fight the anonymity in cyberspace by requiring real-name and phone number upon creation of social media accounts.

Drilon introduced the said provision in the proposed SIM Card Registration Act which the Senate passed on third reading Thursday. The bill mandates the ownership registration of all sim cards in the country to “deter the proliferation of SIM card, internet or electronic communication-aided crimes, such as, but not limited to terrorism; text scams; unsolicited, indecent or obscene messages; bank fraud; libel; anonymous online defamation; trolling; hate speech, spread of digital disinformation or fake news.”

Drilon expanded the measure to include the social media sector.

“This new provision will prevent anyone from making anonymous accounts online. We have to cure trolls that are spreading as fast as the virus that we are battling today. Troll is a virus that hides behind anonymity and continues to spread nothing but hatred and disinformation,” Drilon said Thursday.

Section 5 of the proposed measure, which Drilon introduced, states that “all social media account providers shall require real-name and phone number upon creation of account.”

“This provision is a solution to the anonymity that provides the environment for trolls and other malicious attacks to thrive in the age of social media,” he added.

With Drilon’s proposal to include social media in the proposed measure, trolls will soon face up to 12 years of imprisonment or a fine of up to P200,000 or both, along with those who use fictitious identities to register their SIM card.

Drilon said the practice of requiring a phone number to create an online account is already being done by other email providers such as Google’s GMAIL where a number is required for the implementation of a two-step verification procedure.

The Philippines is home to millions of troll accounts. In 2019, “Facebook took down a network of accounts that were engaged in inauthentic behavior, Drilon noted.

He added that the proliferation of trolls gave rise to suspicions of state-sponsored troll farms, especially that even the Commission on Audit flagged the Presidential Communications Operations Office for hiring hundreds of “contract of service” personnel, which was way above the total number of its regular employees.

Section 10 of the bill provides the penalties, including for using or using fictitious identities to register SIM cards and social media accounts. The provision states: “The penalty of imprisonment ranging from six (6) months and one (1) day to twelve (12) years, or a fine of up to two hundred thousand pesos (P200,000.00), or both, shall be imposed upon anyone who uses a fictitious identity to purchase and register a SIM card or social media account.”

Drilon also proposed that social media providers, apart from telecommunication sector, shall be required to provide information obtained in the registration process only upon the issuance of a subpoena of a competent authority pursuant to an investigation of a sworn complaint that a specific mobile number or social media account was or is being used in the commission of a crime.

Senate moves to solve franchise woes, says Drilon

The Senate passed on second reading Senate Bill No. 1530, authored by Senate Minority Leader Franklin M. Drilon, which seeks to provide an immediate solution to dilemmas being faced by franchise applicants whose renewal of legislative franchises have been filed but remained pending in Congress.

SBN 1530 seeks the non-expiration of legislative franchises that are pending in Congress by amending Section 18, Book VII, Chapter 3 of Revised Administrative Code, Drilon explained. The Revised Administrative Code provides for the non-expiration of a license where the licensee has filed a timely and sufficient application for renewal, until a final determination by the agency is made.

Drilon’s amendment simply expands the provision to also include franchises granted by Congress.

The bill provides that where a licensee or franchisee has made a timely and sufficient application for renewal of a franchise or license, the same shall not expire until after a final determination by the department, agency or branch of government.

The amendments, according to Drilon, also hope to address the unfair and iniquitous closure of their operations due to the issuance of cease and desist orders, after the expiration of a franchise pending renewal, which in turn result in job losses in the telecommunications and broadcast industries.

“It is acknowledged that there is a gap in the law in cases as exhibited in cases where a franchisee, having taken all the steps to renew its franchise, is unable to do so not due to its own fault, but due to Congress’ failure to act on the application. As the principle of equity has been deemed insufficient to fill that gap, the timely passage of this measure is in order," Drilon said.

Congress has applied considerations of equity in previous similar situations and the measure seeks to institutionalize that practice, he noted.

“The amendment we propose would require the concerned agency or branch of government to act decisively on an application for renewal, and to express its decision in clear, unmistakable terms, to ensure that the applicant is not punished for the authority’s indecision or inaction,” Drilon said.

“SBN 1530 can save jobs and prevent and fix franchise woes caused by the inability of the grantee, in this case Congress, to act on an application for renewal in a timely manner,” Drilon said.

“It will prevent the repeat of what happened to broadcast network ABS-CBN, a pillar of our media industry and pioneer of many innovations, whose franchise remained in limbo prior to the denial by a House of Representatives panel, in the meantime causing premature loss of 11,000 jobs. It is meant to protect both small and big franchise holders in the event that their franchise is not acted upon immediately,” Drilon said.
