Another key witness in the drug cases of detained Senator Leila de Lima has retracted his allegations that the lawmaker was involved in the illegal drug trade at the New Bilibid Prison (NBP).

In his affidavit, notarized on April 30, and shared with the media on Monday, Rafael Ragos, a former officer-in-charge for the Bureau of Corrections (BuCor), said he was “forced” to execute affidavits implicating de Lima in the illegal drug trade in NBP as he received “threats of being detained.”

He also alleged that then Justice Secretary Vitaliano Aguirre II, who was appointed by President Duterte, had “coerced” him into testifying against De Lima. Aguirre II is currently the National Police Commission (Napolcom) commissioner.

In 2016, Ragos told a Senate hearing that he delivered, along with aide Jovencio Ablen Jr., P5 million in proceeds from the illegal drug trade inside the New Bilibid Prison to De Lima’s house in Parañaque City in 2012.

He also testified then that the kickbacks came from Peter Co and other drug lords to support De Lima’s senatorial bid in 2013.

De Lima, who has been in detention since 2017 on allegations that she used drug money to fund her 2016 senatorial bid, denied the allegations.

“As far as I know and based on my professional relationship with Sec. De Lima, she is incapable of doing anything illegal, much less engage in the illegal drug trade or accept money from Bilibid inmates. All of my allegations to the contrary in my affidavits and House and court testimonies are all fiction, false, and fabricated,” Ragos said in a statement.

Ragos also said then-Justice Undersecretary Raymund Mecate “persistently pressured” him “to further implicate and manufacture lies” against De Lima.

“I am executing this affidavit freely, voluntarily, truthfully, and without any mental reservation whatsoever, in order to absolve Sec. De Lima and Ronnie Dayan, who are completely innocent, from entirely false and absolutely fabricated criminal charges,” he said in the affidavit.

Ragos also apologized to De Lima for testifying against her.

Two days before Ragos signed his affidavit, confessed drug lord Espinosa retracted his allegations against De Lima, saying he only invented stories of their dealings because he was “coerced.”

But unlike Espinosa, Ragos is a principal witness on record in one of two cases against De Lima pending at the Muntinlupa Regional Trial Court.

De Lima was charged with three counts of conspiracy to engage in the drug trade, but she was acquitted of one count in 2021, and the two remain on trial.

Calls to free De Lima, who is seeking reelection in the May 9 polls, and hold accountable those responsible for her five-year detention continue to mount after Espinosa and Ragos retracted their allegations.
