💛 The first time we talked about Sun life nung 2017, aliw na aliw ako sa mini note book mo na naka detalye all your monthly expenses at pano ka mag-allocate ng budget up to the last cent. Kaya when you decided to meet up with me, I felt honored that you valued my recommendations tungkol sa expense. Matalino at responsableng bata at sobrang mapagmahal ka sa mom mo. Nakakaaliw din na “ate” talaga ang turing mo sakin kasi even outside insurance napag-uusapan natin..mga goals mo, gaano ka ka-busy sa dami ng sideline mo. May time pa nga 3 sabay sabay work mo. Marami ka kasing pangarap.

🖤 Then a sad news came, magka chat pa tayo weeks before at nabanggit mo sakin na hindi ok pakiramdam mo. We thought its just a simple slip disc..kaso it worsened fast..until nagka infection…at 28yrs old Elaine you passed away…

Masakit din ma-reject syempre - yung mga “NOs at SEEN-ZONED” definitely may impact talaga. Ilang beses na may na release na akong claim para sa client na nagkasakit at nahospital pero iba pala epekto ng untimely death. Lalo na kung breadwinner at wala pa at the peak of her life at marami pang pangarap para sa sarili at sa mom nya..ni wala pang 30yrs old si Elaine when she passed away.

Boss Sam Fernandez has been one of my best mentors back when I was working at a Pharma Company.

From Tuguegarao Probinsiyana assigned Medical Rep hanggang sa mapush ako ni Lianne Santos na naging manager ko din to explore being promoted as product specialist assigned to Manila..Naalala ko na kailangan ko pang mag drive test ng gabi nun kasama si Papa to explore Timog area hospitals para lang di ako maligaw sa pag-cover ko the next day.

I was so insecure back then, hindi ko alam pano haharapin mga new work mates and customers aa Manila since 4yrs din ako nasa province..nakakapanibago, nakakatakot...ang alam ko lang, I have to do my best in my job.
And yes! We delivered the targets, my team then with my manager Marilen was one of those teams with the highest performance sa new product we launch - kaso its not enough.

One of the key learnings then - is not to be too transactional in my dealings. Because of being too task-oriented, i became too hard on my self, i forgot to be myself, to just be me & to prioritize the crucial component in being part of the team - PEOPLE. People buy people.

Boss Sam taught me how to balance being a manager and a leader, you will need each component to be successful. He knows how to lead with a heart at pinakita nya sakin how it’s done with 1 of the biggest mistake I made back then - pumalpak ako sa isang client, i totally forgot the scheduled activity! and to my surprise, hindi nya ko pinagalitan! He helped me worked it out with our client and never ako pinagalitan. Pero tumatak sakin yung 1 incident na yun. He did all the work, asked about the task on hand and just told me to enjoy my VL and back to work na lang kami pagbalik ko.

Because of that, i learned to be more responsible, to lead with a heart and be inspired to give more of myself and do more! He partnered with me to lead our team and asked me to assess and orient incoming account consultants joining our team.

From an outlier, na sobrang takot, daming palpak, hindi marunong mag balanse ng task and relationships hanggang sa more than a decade after na magkaiba na kami field.

Today, I still thank him for being a huge part of my leadership journey! Maraming maraming salamat Boss Sam! For mentoring me at pagttiyaga sakin noon! I Am forever grateful for your Trust & Respect to me as a person molding me to a be a leader.

DENIED LIFE INSURANCE CLAIM

The incontestability clause of a life insurance policy provides that after a policy shall have been in force during the lifetime of the insured for a period of 2 years from the date of its issuance or of its last reinstatement, the insurer can no longer deny a death claim by reason of fraudulent concealment or misrepresentation committed by the insured or his agent, no matter how patent or well-founded. It serves a dual purpose and regulates the actions of both the insurer and the insured. On one hand, it gives the insurer enough time to inquire whether the policy was obtained by fraud, concealment or misrepresentation. On the other hand, it forewarns a scheming person that any attempt at committing insurance fraud would be timely uncovered – thus deterring them from venturing into such nefarious enterprise. (G.R. 175666. July 29, 2013)

What if the cause of death is due to an accident and has nothing to do with the misrepresented statement in the insurance application? Can the insurance company deny the claim if the accidental death occurs within the two-year contestable period?

This is answered in the following case:

RB procured a 100,000 life insurance policy for himself from a Life Insurance Company with double indemnity in case of accidental death. The designated beneficiary was his mother.

Less than two years later, RB died in a plane crash. The mother filed a claim with the insurance company seeking the benefits of the insurance policy taken by her son. The company conducted an investigation and its findings prompted it to reject the claim after determining that the insured did not disclose material facts relevant to the issuance of the policy, thus rendering the contract of insurance voidable. A check representing the total premiums paid was attached to said letter.

In its investigation, the Company discovered that two weeks prior to his application for insurance, RB was examined and confined at the Lung Center of the Philippines, where he was diagnosed for renal failure. During his confinement, RB was subjected to urinalysis, ultra-sonography and hematology tests - facts that he did not disclose in his application for insurance. In fact, he answered in the negative to the question on whether he had ever sought advice for urine, kidney or bladder disorder.

The Court of Appeals sustained the decision of the RTC granting the petition of the mother-beneficiary stating that the insurance company cannot deny the claim because the cause of RB’s death was not related to the facts concealed by him.

Is this correct?

No.

The Supreme Court said that Section 26 of the Insurance Code is explicit in requiring a party to a contract of insurance to communicate to the other, in good faith, all facts within his knowledge which are material to the contract and as to which he makes no warranty, and which the other has no means of ascertaining.

Materiality is to be determined not by the event, but solely by the probable and reasonable influence of the facts upon the party to whom communication is due, in forming his estimate of the disadvantages of the proposed contract or in making his inquiries.

The argument that the facts concealed had no bearing to the cause of death of the insured cannot be sustained as it is well settled that the insured need not die of the disease he had failed to disclose to the insurer. It is sufficient that his non-disclosure misled the insurer in forming his estimates of the risks of the proposed insurance policy or in making inquiries.

In other words, the test is this: if the insurance company knew of the true health condition of the insured, would it have approved the issuance of the policy? Clearly, the answer would be in the negative. Thus the insurance claim should be denied.

I was not able to attend the session where Sun Life invited selected advisors with HNW (High Net Worth) clients due to a scheduled health check up.

Honestly, I was wondering why I was invited. Wala naman akong High Net Worth HNW client. Cause if you are wondering what is Sun Life’s qualifications to be included as HNW client, he or she needs to have at least 10 Million Premium a year. Hindi po yan Face Amount ng insurance … yan po yung premium na binabayaran ng client.

By the way out of 22,000 advisors … we have 1,833 advisors lang na nag ha handle ng HNW. And to date we have 2,994 HNW clients which amazingly grew last year by 31%. Kahit maliliit clients namin naiipon lang din 🙂 God willing … meron sana bigay samin na HNW client this year 🙏🏻

Allow me to share with you the highlights of the Market Update.

For 2023, we see Brighter days ahead of us as Inflation in US & PH starts to decelerate this year (more in PH than US). Consumption will continue to grow as revenge spending is not over yet. There is still the risk of Recession in US by probability of 51%. No recession for PH. PH GFP grew by 7.6% for 2022.

So, it will be the year of the Emerging Markets. And Philippines is one of the Emerging Markets especially that we are coming from a low P/E of 14X which means murang mura pa ang stock prices.

So we are bullish BOTH for Bonds (Fixed income) & Equities.

So anu ang strategy natin?

Look into your portfolio.
If you are down by 10-20% would you be willing to Risk MORE money to recover fast ? Depende lahat yan sa RISK APPETITE ng client and amount of his available investible assets.

Bond 5-7%
Equity 11 %
