Supreme Court’s Justice Ayesha A. Malik on Friday observed that Pakistan was bound by the United Nations conventions that protected the rights of refugees.
She passed these remarks as a three-member bench of the apex court took up a petition seeking restraining orders against the caretaker government’s decision to deport illegal Afghan nationals.
The bench also comprises Justice Sardar Tariq Masood and Justice Yahya Afridi.
In November, the government initiated a nationwide campaign to deport illegal foreign nationals, the majority of whom are Afghans. While the decision had prompted criticism from Afghanistan and several other quarters, the caretakers refused to budge, insisting the move was not aimed at any particular ethnic group.

A five-judge bench led by Justice Ijazul Ahsan has given an unprecedented ruling by declaring a 56-year-old law to try civilians in military courts as unconstitutional.

آج لاہور ہائی کورٹ میں جسٹس فاروق حیدر کی عدالت میں ایک 19 سالہ لڑکی کا مقدمہ پیش کیا گیا جس نے اپنی پسند کی شادی کی تھی اور اسکے والدین کی طرف سے 491-سی آر پی سی کے تحت ہیبیس کی درخواست دائر کی گئی تھی۔ لڑکی نے عدالت میں بیان دیا کہ یہ شادی اس کی رضا مندی سے ہوئی ہے اور وہ لڑکے کے ساتھ رہنا چاہتی ہے۔ مزید لڑکی نے اپنے والدین کی طرف سے تشدد کا خدشہ بھی ظاہر کیا جس پر عدالت نے یہ یقین دہانی کروائی کہ پولیس اپنی حفاظت میں دونوں میاں بیوی کو چھوڑ کر آئیں گے لیکن جیسے ہی عدالت کاروائی کے بعد دونوں میاں بیوی ہائی کورٹ کی عمارت سے باہر نکلے، لڑکی کے والد نے کچھ غنڈہ عناصر کے ساتھ مل کر لڑکی کے شوہر پر تشدد کیا اور چلتی شاہراہ پر لڑکی کو مکمل برہنہ کر کے تشدد کا نشانہ بنایا۔ یہ سارا واقعہ لاہور ہائی کورٹ کے مسجد گیٹ کے سامنے پیش آیا جہاں پولیس اہلکار بھی اُن کی حفاظت کے لیے موجود تھے۔
Case Brief of SC verdict in petitions against SC Practice & Procedure Act 2023
The Act upheld by SC with a majority of 10:5:
1. A committee of CJP and two senior most judges will decide on fixation of any matter, formation of benches and whether to hear a case in Article 184(3) / Suo Moto; it will not be a one person discretion anymore just like all previous CJPs did.
2. There we be a right of appeal to all future decisions to be passed in Article 184(3) / Suo Moto Jurisdiction after the date of todays verdict.
Note: Retrospective Right to Appeal, as provided in the Act, for all previous decisions passed by SC held ULTRA VIRES and UNCONSTITUTIONAL with majority. So past decision under Article 184(3), eg. NS disqualification or NAB Amendments Judgment, before this decision will not have a right of appeal.
A case was registered under section 506, 352 in the Abpara police station on the request of Senator Afnanullah Khan. Senator Afnanullah applied for the registration of a case against Sher Afzal Marwat.
The Intelligence Bureau (IB) has filed an application in the Supreme Court to withdraw its review petition against the court’s verdict on the 2017 sit-in by the Tehreek-i-Labbaik Pakistan (TLP) at Faizabad in Islamabad.
Headed by CJP Isa, a three-judge bench, which includes Justice Aminud Din Khan and Justice Athar Minallah, will take up the review petitions on September 28 (Thursday).
However, the bureau filed a civil miscellaneous application today in the apex court, saying that it did not want to pursue the matter and intended to withdraw its review petition.
The application requested that it be accepted and the review plea be allowed to be withdrawn.
With the Supreme Court (SC) facing a significant backlog of cases, Chief Justice of Pakistan (CJP) Qazi Faez Isa remarked on Monday that the trend of seeking another date for hearing would no longer fly.
The CJP made the remarks as a three-member SC bench heard a case related to a land dispute, during which one of the lawyers sought to adjourn the hearing for a later date.
In response, CJP Isa reprimanded the lawyer and told him to forget the idea of seeking a later date.
“Through you, this is also a message for everyone that the trend of seeking adjournments will no longer fly. The number of cases pending before the apex court is quite high,” he said.
He further said that “notice [should be issued] during one hearing while arguments should be heard at the next”.
Islamabad High Court (IHC) Chief Justice Aamer Farooq on Monday ruled that PTI Chairman Imran Khan be shifted to Rawalpindi’s Adiala jail from the Attock district jail, where he is currently incarcerated in the cipher case.
The PTI chief was sent to jail on August 5 after he was convicted in the Toshakhana case. The trial court had ordered the Islamabad police chief to arrest the PTI chairman, but he was instead arrested by the Lahore police.
Moreover, the court had ordered the Adiala jail superintendent to receive Imran but he was taken to Attock jail. Subsequently, the ex-premier had petitioned the IHC seeking transfer from Attock jail to a better class facility in Adiala jail.
Steps to follow while drafting a legal petition:
• Caption: Begin with the court's name, case number, and the names of the parties involved (claimant and defendant).
• Subject: Clearly state the relevant provisions of law under which the petition is being filed.
• Introduction: State the purpose of the petition and briefly summarize the issues at hand.
• Parties: Clearly identify the petitioner (or claimant) and respondent (or defendant) and their respective roles in the case.
• Statement of Facts: Present a clear and concise narrative of the events leading up to the legal dispute. Include dates, locations, and key details.
• Legal Claims and Grounds: Clearly outline the causes of action being asserted, providing references to relevant case laws and statutes.
• Prayer for Relief: Specify the remedies or relief sought from the court, such as damages, injunctions, or specific performance.
• Verification: Include a statement signed by the petitioner or their counsel affirming the accuracy of the petition's contents under penalty of perjury.
• Affidavit: An written statement signed by the petitioner on oath supporting the contents of the petition.
• Annexures: Attach any relevant documents or evidence that support your case. Label and reference them appropriately in the petition.
• Index: Make a table of contents, include page numbers, attachments, section headings and cross-references.
• Signature and Date: Sign the petition, and include the date of submission.
• Filing: File the petition with the appropriate court and follow the court's procedures for submission.

Supreme Court on Thursday fixed pleas against trials of civilians in the military courts, for hearing.
A six-member bench headed by CJP Justice Umar Ata Bandial will take up the pleas on July 18. Justice Ijazul Ahsan, Justice Muneeb Akhtar, Justice Yahya Afridi, Justice Sayyed Mazahar Ali Akbar Naqvi, and Justice Ayesha Malik will be the other members of the bench.
Notices have been served to the respondents for the hearing.

1 کسی کو اسکی مرضی کے بغیر ڈی این اے کروانے پر مجبور نہیں کیا جا سکتا جو کہ right of privacy آرٹیکل 14 آئین پاکستان کے خلاف ہے۔۔
2۔ نادرہ کے تمام ڈاکومنٹس یہ بتا رہے ہیں کہ لیلی عبدلقیوم یعنی مرحوم کی بیٹی ہے ۔۔اور آرٹیکل 128 قانون شہادت آرڈر کی اسے protection حاصل ہے۔
کوئی یہ تو دعوی کر سکتا ہے کہ میرا ڈی این اے میرے باپ سے میچ کروایا جائے کہ میں اسکی اولاد ہوں ۔۔لیکن کوی یہ نہیں کہہ سکتا کہ فلاں فلاں کی اولاد نہیں ہے اسکا ڈی این اے کروایا جائے۔۔لہزا بچوں کو سوشل stigma سے بچانے کے لئے ضروری ہے کہ ایسے دعوی جات کو بھاری جرمانے سے خارج کیا جائے۔۔reference
