❗️ How do I protect myself from scams as a freelancer?

Scams are unfortunately a fact of life in business whether you’re a large multinational corporation, a small-to-medium enterprise (SME) or a freelancer. The impact on a freelancer, however, is probably much harsher than on the other two for two reasons:

1. Many if not most freelancers don’t have much of a financial buffer to absorb these sorts of events which directly impacts their quality of life; and
2. Freelancers need to resolve these situations on their own which compounds the problem as the time taken to resolve the matter takes away from time that can be spent earning revenue.

There are several different ways in which a freelancer can protect themselves from scams and these can be broken down into two broad categories:

1. Self-managing risk measures: for example, asking for a partial upfront payment from the client, withholding work until payment is made and other commercial tactics to protect against scams. These measures (while better than doing nothing) only manage the risk but don’t mitigate it.
2. Using freelancer platforms: there are plenty of them out there that offer an escrow and dispute resolution process which are far more effective than self-managing the risk.

Obviously freelancing platforms provide a better level of protection than self-managing risk and this is reflected in the significant commissions they charge on freelancer earnings of up to 20%.

These platforms exist for one purpose and that is to generate profit which is not a problem per se. What does become a problem is where these centralized platforms have a conflict of interest which will influence how they operate. An easy way to find the conflict of interest is to follow the money.

The money, in the case of a centralized platform, almost entirely comes from clients who are paying for work to be done. This fact is not lost on platforms who recognize that if they alienate clients, they are putting their revenue at risk. This is the real reason they insist on all communications taking place on platform – the platform believes they own the client and by extension the money.

Consequently, in the case of any conflict there is a good chance that the platform will find in favor of clients – and plenty of freelancer forums have stories where freelancers have been unfairly treated by platforms.

So, the question becomes this: what does your day look like if you had access to the same scam-mitigating infrastructure that platforms provide but where you own the client – i.e. a decentralized model?

Firstly, you would wake in the morning, knowing that you have direct relationship with your client and be empowered to run your own business the way you see fit and without arbitrary rules placed upon you.

You would log onto Vleppo, look at your proposals and see which ones have been accepted because the funds for the jobs are held in escrow protecting both you and your client.

You can negotiate variations in scope directly with your client and update the contract accordingly along with the escrow amounts.
As you have a more personal relationship with your client you will be less likely to have contracts move into dispute saving you time and money.

If they do move into dispute, you will have access to a mediator (either Vleppo as a default or a mediator of your choice) who is paid a fixed fee to mediate an agreement. In this way, the mediator is independent as they are paid a fee regardless of whether you or the client are successful.

Most importantly, as a decentralized system, the costs of the escrow are less than 5% which is a saving of 10-15% by comparison to other platforms. With annual inflation running at around 8.6% in the US (and probably higher in other countries) the reduction in escrow fees can offset this either fully or in part and preserve your standard of living.

Hi. My husband Eugene and I are Ukrainian citizens, we are representing our law firm - BELKOVY LAW FIRM (belkovy.com). Currently our company is involved in the volunteering activities in Ukraine as our clients are expats, so we can find some required equipment etc abroad.

Guys from the territorial defense are engaged in demining cities and villages around Kyiv, especially a lot of mines were left near kindergartens and schools(

Now foreigners need a notarised passport translation for residence registration.

On December 1, 2021 the new law of Ukraine «On provision of declaration and residence registration (an electronic public) services» entered into force.
The new law also establishes new rules for residence registration of foreigners in Ukraine.

As a general rule, all foreigners have to register a place of residence within 30 calendar days after obtaining a permanent or temporary residence permit or after a deregistration.
For residence registration foreigners have to submit a temporary or permanent residency permit. The owner of the apartment has to come personally or issue a power of attorney and submit a passport and document of title.

Now pursuant to the new law additionally foreigners have to submit a notarised translation of their passport while residence registration.

Non-visa stay in Ukraine: 90 days rule

If you are planning to come to Ukraine, you have to be aware of a 90 days rule upon visa-free regime.
The above rule mainly applies to citizens of the USA, Canada, and EU countries.

Pursuant to the Ukrainian legislation, foreigners have a right to stay in Ukraine for 90 days within 180 days period.
What is this «90 days within 180 days period» rule, and how it is calculated?

To calculate 90 days of your stay in Ukraine, you must do the following:

a) Select a control date from which period of your staying will be calculated: you can identify  the date of a trip to Ukraine; or given that you are in Ukraine and want to figure out how many more days you can stay in Ukraine, at that rate, you need to select the date of checking the length of stay (as of today).
b) 180 days period is calculated backward from the selected control date. It will be the period during which you can legally stay in Ukraine for a maximum of 90 days.
c) Next step is to check the stamps in your passport of entries and exits to Ukraine for the period of the last 180 days, calculated from the control date.
d) Having counted all the entries and exits, you will understand how many days you stayed in Ukraine, and how many days you still have in stock.

If, as a result of a miscalculation, it turns out that you have been staying in Ukraine for more than 90 days, this means that you have overstayed and will have to pay an administrative fine and leave Ukraine.

Work permit in Ukraine

Pursuant to the Ukrainian law foreigners can get a work permit and a temporary residency permit in Ukraine if they are employed by a Ukrainian company/PE or if they register their own company in Ukraine.

Work permit is a document allows you to work legally in Ukraine at the position and for the company indicated in the work permit. Besides, in the event you work for several companies, you are obliged to get work permits from each company.

The easiest way to get a work permit and 3-years temporary residency permit is to set up your own company, where you will be a shareholder and a director (CEO).

How to obtain a visa type D to Ukraine?

Prior to applying for a temporary residency permit in Ukraine, each foreigner is obliged to get a visa type D (except for citizens from 6 post soviet countries: Georgia, Belarus, Azerbaijan, Armenia, Turkmenistan, Russian Federation).

Visa D can be issued only abroad in the Ukrainian embassy.

You have to schedule an appointment and provide a Ukrainian embassy with the following documents:

1. Passport;
2. Photo 35*45 mm;
3. Insurance policy covering 30000 Euro issued by the insurance company registered in Ukraine;
4. Documents confirming the sufficiency of funds on your bank account;
5. Visa application form;
6. Documents confirming the purpose of stay (e.g marriage certificate, work permit or invitation from a Ukrainian NGO etc.).

HOW TO GET A BUSINESS TEMPORARY RESIDENCY PERMIT IN UKRAINE?

If you want to launch a business and stay legally for more than 1 year in Ukraine, you can get a 3-years temporary residency permit.

The whole procedure consists of the following steps:
1️⃣Obtaining a tax ID.
2️⃣Company registration.
3️⃣Get a 3-years work permit.
4️⃣Get visa D-04 in the Ukrainian consulate abroad, except citizens of 6 post soviet countries: Georgia, Belarus, Azerbaijan, Armenia, Russia, Turkmenistan.
5️⃣Obtain a 3-years temporary residency permit.

Joyous news for those foreigners who apply for a permanent residence permit!

An immigration permit will be valid for 2 years.

On July 21, 2021 the Cabinet of Ministers supported amendments to the resolution of the Cabinet of Ministers of March 18, 2020 № 259: "Some migration law implementation issues for the period of quarantine throughout Ukraine."

Resolution № 259 establishes an extension for up to 2 years of decisions on granting immigration permits to Ukraine, taken within one year before the establishment of quarantine or during the quarantine period.

It’s a big deal that the extension of the immigration permit will give the opportunity to issue a permanent residence permit in Ukraine to those foreigners and stateless persons who due to the introduction of quarantine measures could not apply to the State Migration Service of Ukraine within the statutory period.

Since August, 7, 2021 foreigners will no longer be able to apply for a temporary and permanent residence permit, exchange a residency permit and extend their stay in Ukraine in violation of the terms, as was possible earlier, due to the establishment of quarantine.

May we remind you that Resolution of the Cabinet of Ministers of March 18, 2020 № 259: "Some migration law implementation issues for the period of quarantine throughout Ukraine” provided for the possibility to obtain temporary or permanent residency permit even if the foreigner did not have time to do so 15 business days before the expiration date of the document; as well as to extend the period of stay in Ukraine in violation of the term "not earlier than 10 and not later than 3 business days."

However, the exemption from administrative liability of foreigners who have overstayed in Ukraine due to quarantine remains in force.

That is, fines will still not be applied to foreigners.

GROUNDS TO OBTAIN A TEMPORARY RESIDENCE PERMIT IN UKRAINE?

Pursuant to the law of Ukraine foreigners and stateless persons can obtain a temporary residence permit on the following grounds:
• Official employment;
• Participation in international projects for technical support;
• Performance of religious activity in a religious organisation;
• Working at affiliated companies or representative offices of non-governmental organizations of foreign countries;
• Working at representative offices of foreign business entities, banks;
• Participation in international cultural, educational or scientific activities, prescribed in international contracts of Ukraine or specific programs, participants of international or regional volunteer programs, or participation in work of Ukrainian organizations that are permitted to involve foreign volunteers (there is a special governmentally approved list of such organizations);
