: Following Continuous Violation Of Human Rights, Murder & Brutality, Ugandan authorities have been warned
UN human rights experts today expressed serious concerns about the violence ahead of Uganda’s presidential election and urged authorities to put an end to the arrest, detention and judicial harassment of political opponents, civil society leaders and human rights defenders with immediate arrest.
According to the UN, there have been reports that three journalists were hurt on Sunday after being hit by tear gas canisters in Masaka. Opposition leader Robert Kyagulanyi, also known as Bobi Wine, said one of his bodyguards died after being hit by a military truck later the same day. The military has denied this, saying he fell from a speeding car.
“We are gravely concerned by the election-related violence, the excessive use of force by security personnel, as well as the increasing crackdown on peaceful protesters, political and civil society leaders and human rights defenders,” said the experts.
“Since the publication of the guidelines on the conduct of elections during COVID-19 in June by the Uganda Electoral Commission, we have witnessed gradual shrinking of civic space, and misuse and abuse of health-related restrictions to curb dissent in the country ahead of the election on 14 January. Time and again, we have emphasised that the fight against the COVID-19 pandemic should not be used as a pretext to infringe on fundamental freedoms.”
On 23 December 2020, Nicholas Opiyo, a prominent human rights defender, was arrested along with four other individuals. According to the official statement made by the authorities, he is accused of money laundering and will be tried accordingly.
Opiyo was involved in the defence of four NGOs whose assets were frozen on 12 December by the government on charges of financing terrorism and was vocal against actions taken by the State security forces amidst the electoral context.
The Uganda Women’s Network (UWONET), the National NGO Forum, the Women International Peace Centre, and the Alliance of Finance Election Monitoring (AFEM) have been active in election campaigns encouraging the participation of women and youth.
“Combatting terrorism should never be used as a justification to undermine the credibility of associations or to unduly impede their legitimate work,” the UN experts said. “We are gravely concerned about this attack on human rights defenders, civil society actors and those who defend them. The prosecution of Nicholas Opiyo and other lawyers, as well as the judicial harassment of those who express dissent, appear to be strictly related to the electoral context, and fictitious charges being used to justify them.”
This repressive trend has also targeted opposition leaders. On 18 November, Kyagulanyi was arrested while addressing National Unity Platform (NUP) supporters. Police said he was arrested for defying the guidelines issued by the Electoral Commission by gathering more than 200 supporters.
“Although released, we are concerned that he risks being prosecuted under section 171 of the Penal Code, for negligent act likely to cause the spread of an infectious disease,” said the experts. “We warn against the impact of the actions taken by the police and the judicial system, which may have a chilling effect on dissent and on civic space in the run-up to the elections. The repression can in turn instil widespread fear, and discourage an open and transparent campaign as well as free and fair elections.”
The UN experts have expressed their concerns to the authorities and urged them to drop all charges against all those who have been arrested during the election campaign period and to put an immediate end to judicial intimidation of human rights defenders, journalists, civil society leaders, peaceful protesters, political parties and those who express dissent.
The experts called on the authorities to take all necessary measures to ensure an environment conducive to peaceful and transparent elections. “Any action which may fuel further social tension must be avoided, and the voices of people and their representatives must be fully taken into account,” they said.

Independent candidate for Mawogola North in Sembabule District, S**o Aine Kaguta, has sued the National Resistance Movement (NRM) party for not endorsing him as the party’s flag bearer for the parliamentary seat.
Aine is a younger brother of President Museveni.
He filed a suit filed before the High Court in Kampala on November 25, challenging the decision of the NRM electoral commission not to declare him winner of the party primaries.
He said the decision of the NRM party to declare that there was no winner of the National Resistance Movement flag bearer for the Mawogola North constituency elections and refer the matter to the Central Executive Committee of the respondent for a decision, is …tainted with illegality, procedural impropriety and is null and void.
His rival, Shartsi Musherure (daughter to Foreign Affairs minister Sam Kutesa), on October 2, petitioned the party elections tribunal, challenging his victory.
On October 6, the NRM electoral disputes tribunal summoned Aine and Musherure for a hearing to be held on the October 8, on which the hearing was conducted and ruling reserved.
On the October 15, Aine was verbally informed that the chairman of the NRM election disputes tribunal had delivered the decision on the petition and wherein he has held that the petition had succeeded and that, however, without the proper exercise of voter franchise, the tribunal is not able to pronounce a winner of the election and recommended the parties to the Central Executive Committee for directions.
Aine contends that the decision was an abdication of the mandate of the NRM election disputes tribunal, which is illegal and irregular.
“On the same night of the October 15, I was similarly advised that the secretary general of the respondent, by letter addressed to the chairman of the Electoral Commission of Uganda and copied to me, notified the chairperson that the NRM would not endorse any candidate to contest and carry its flag for the position.”
The two candidates have since been campaigning as independents.
Aine now wants the court to quash the election tribunal’s decisions and declare him as the NRM’s flag bearer.

***Kyagulanyi storms lugazi***
Traffic was brought to a standstill this afternoon after police blocked the NUP presidential candidate Robert Kyagulanyi and his convoy at Namagumba, Lugazi from proceeding to campaign in Buikwe.
Bobi wine was stopped halfway through his journey by the police and military on grounds that his convoy was too large and he needed to get rid of a few vehicles before being allowed to continue.
Police say a presidential candidate must not be escorted by more than 2 cars. However , Bobi’s convoy 2 cars, a public address system car,2 ambulances, and many press vans.
This didn’t ogre well with Bobi as he decided to park in the middle of the road, blocking the movement of other cars hence causing a heavy traffic jam.
The Jam lasted close to 2hours as Bobi stood at the top of his car pending stern action while police and military did nothing but kept busy on their phones as if waiting for an order from above.
Bobi lashed out at the security of acting in a criminal manner and illegally frustrating his campaign process by blocking the road with ambulances.
He also accused them of knocking dead 5 NUP supporters at trading centers in Mukono.
By the time of filing this story, Bobi had vowed not to move until police let all the cars in his convoy to proceed with him.

Veteran opposition leader Dr Kizza Besigye has reacted to President Yoweri Kaguta Tibuhaburwa Museveni’s threats to crush opposition protests, reminding the 76-year-old former bush war commander he broke the law to ascend to power.
On November 29, Museveni used his address to the nation to comprehensively speak about protests that erupted over 10 days ago following the arrest of Robert Kyagulanyi aka Bobi Wine.
In the November 18 and 19 protests, 54 people were killed, 32 of them rioters, according to a report from Museveni received from police CID director Grace Akullo.
Museveni warned that his government would defeat any opposition plan to overthrow him from power.
He reiterated his claim that the protests were planned, with opposition forces only using Bobi Wine’s arrest as a ruse to execute their plot.
Making a mockery of democracy, Museveni reviewed video clips from the protests condemning protesters.
He cautioned against a repeat of the violence that happened just over 10 days ago, reminding Ugandans that the National Resistance Movement (NRM) government was strong on the security and defence fronts.
He further assured Ugandans nobody would destabilize the country, adding that those who thought security just meant Uganda Police Force (UPF) would be in for a shock.
But veteran opposition leader Dr Kizza Besigye, who has contested against Musveni four times, quickly reacted to the president’s threats, accusing him of forgetting that he had used non-democratic means to ascend to power.
Besigye reminded Museveni that protests were less violent than guns that Museveni used to win power after the 1980 election which he had lost.
“Mr Museveni’s selective memory doesn’t allow him to remember that he came to power by breaking the law for five years; not rioting with stones but guns!” said Besigye.
Between 1981 and 1986, Museveni commanded a bush war that left hundreds of thousands dead. Besigye was part of the war, and served as Museveni’s personal physician.
He is not the only one to have fallen out with his former boss. In the 2021 presidential election, Museveni is facing his former bush war comrades: former army commander Maj Gen (Rtd) Gregg Mugisha Muntu of the Alliance for National Transformation (ANT) and former security minister Lt Gen (Rtd) Henry Kakurugu Tumukunde.
Besigye is, for the first time in two decades, off the ballot. His party, Forum for Democratic Change (FDC), is fronting Patrick Oboi Amuriat as Besigye embarks on Plan B which reportedly involves rallying Ugandans to rise up and remove Museveni from power without waiting for an election, which the party believes won’t be free and fair.
The former FDC leader says it is possible to remove Museveni, who has ruled Uganda since 1986 and is now seeking to extend his rule to four decades, from power using non-violent means.
