šØMeasure 114 Update: Motion to Dismiss DeniedšØ
I take āBased on all the circumstances present in this caseā to mean āBecause this case and the parties you moved against are too important.ā
So the State got an extra week to prepare their opening brief despite having an army of DOJ attorneys, a small army of mercenaries at Markowitz Herbold, and millions of dollars at their disposal. We are, as we were at trial, at technical handicap based on personnel and funding.
Lucky for us, weāre used to going up against government officials who think theyāre special. We didnāt beat them on the procedure, so now weāll have to beat them on the merits.
This is just another chip on our shoulders!

Here is our Reply in support of our Motion to Dismiss - this is in Reply to the State Defendantsā Response and Objection to our Motion to Dismiss.
Not only do I think our position is legally sound, but I hope Iāve captured at least some of our shared frustrations with the State Defendants thinking theyāre special in this Reply.
At a minimum, we are holding the State Defendantsā feet to the fire and taking the fight to them!

šØMeasure 114 Update to my UpdatešØ
We received an email from opposing counsel today indicating that our motion to dismiss is unlikely to succeed.
We have been committed to transparency with everyone who is supporting this case. The ups and the downs, the good and the bad. So I wanted to do an immediate update with this new info.
Apparently the Court is saying that they suspended the timeline they set at Defendantsā request because Defendants wanted edits to the transcript (to be fair, the transcript was BAD). Both the order setting the timeline and the order allowing amendments to the transcript were entered the same day (4/12/2024)ā¦ and there is no indication in anything on the docket that the timelines were suspended. Therefore, I stand by our motion and weāll see what the Court says. But if the Court says that the timeline was suspended, then we will lose that motion.
This is disappointing, but it does not mean that āthe fix is inā or Defendants are getting breaks because theyāre the state. It means that apparently the left hand doesnāt know what the right hand is doing in the Court of Appeals and that the Court of Appeals failed to put on the docket anywhere that timelines were suspendedā¦ if that is indeed the case.
Weāll wait to see what the Court says, but in the meantime our eyes need to stay fixed on winning this case ā whether by dismissal or on the merits ā and winning in November.
šØMeasure 114 UpdatešØ
May 31, 2024: the State Defendantsā Opening Brief was due. The state missed that deadline. Therefore, we have officially moved to dismiss the State Defendantsā appeal and now await the Courtās ruling on that issue, Defendantsā Response (if any), and to see if the State Defendants file their untimely opening brief.
What does this mean?
First, it means the chief law enforcement officer in Oregon requested a short deadline, got a longer deadline, and still failed to meet it despite spending MILLIONS of our tax payer dollars defending this travesty of a constitutional infringement.
Second, it means that our win in the trial court will stand if the appeal is dismissed. This would be the official demise of Measure 114.
If granted, the federal court case would be moot. All involved will likely prepare for whatever nightmares the Oregon Legislature has planned for 2025.
Do I think the Court will dismiss the appeal? Iām not sure. Should they? 110%. When I see deadlines from the Court, I know that I am expected to meet them. Maybe Rosenblum and her army think differently. We will see!
Theyāre coming for usā¦ Trump is just in the way.
And now we gear up for November.
There is no excuse not to vote in Novemberās election. We are down, but not out of the AG race. Putting ANYONE other than another corrupt Democrat in that position needs to be our goal. The one who is running that race is Will Lathrop and he has my vote.
Congratulations to Julie Hoy! The next Mayor of Salem. God Willing, we might see sanity prevail in Salem again.

needs to hear a complete and transparent report about this issue from our Secretary of State:
1. How many ballots were held?
2. What was the chain of custody employed to secure those ballots?
3. How many post office branches were involved and in what counties?
4. When will those ballots be released?
5. What caused this delivery delay?
6. How will this issue be resolve in this primary election?
7. What will be done to prevent this and other USPS issues in the November election?
Oregonians deserve full transparency, especially when confidence in elections is at historic lows.
With the Opening Brief by Defendants-Appellants due date looming, we are making another fundraising push to keep this appellate case on track.
Thus far, most of our resources were spent obtaining the denial of stay sought by AG Rosenblum and her cohorts. If granted, that would have put the UNCONSTITUTIONAL Ballot Measure 114 in place during the appealā¦ meaning we would have been living under this tyranny for the first time. Instead, we made sure that stay was denied.
