What percentage of cases do you think go to trial? Both at the criminal and civil level, the answer might surprise you. Take a guess before reading further.

⚖️ Criminal Cases: It's estimated that over 90% of criminal cases in the United States end in guilty pleas. Moreover, about 98% of federal cases and 95% of state cases are resolved via plea bargains.

⚖️ Civil Cases: 1% of all civil cases filed in federal court end up going to trial. Why so few? Because trials can be costly and lengthy, and the outcome is never guaranteed. Settling allows both parties to have a say in the resolution, often making it a more appealing option.

Where legal matters can be found, so, too, can legalese — representing a significant hurdle for defendants and plaintiffs alike. That is why our team places a premium on client education and why we’re defining a common legal term today.

“Burden of proof” is the obligation to prove allegations presented in a court of law. It determines who is responsible for presenting evidence and the level of evidence required to satisfy the court. This principle is crucial in ensuring fairness and clarity in legal proceedings.

In civil cases, the burden of proof typically rests on the plaintiff who must demonstrate their case "by the preponderance of the evidence," meaning it is more likely than not that the facts are as claimed. In criminal cases, however, the burden is on the prosecution and requires proof "beyond a reasonable doubt," a much higher standard, reflecting the serious implications of a criminal conviction.

Understanding this concept is vital for both legal professionals and the public, as it shapes the course of litigation and protects the legal rights of all parties involved.

If legal matters surface, it can be very helpful to have some foundational knowledge of affidavits. With that in mind, we are shedding some light today on the what, when, why, and how of affidavits:

💡 What It Is - An affidavit is a written statement made under oath, often witnessed and authenticated by a notary public or other official authorized to administer oaths.

💡 When One Is Used - Affidavits are used in a myriad of situations, from property disputes to personal injury claims, providing a formal method to present facts that are essential to a case or legal process.

💡 Why an Affidavit Is Used - Affidavits serve as evidence or supporting documentation in court proceedings and other legal transactions, affirming the truthfulness of its contents. They are used across various legal contexts.

💡How an Affidavit Is Made Official - Depending on the state and document type, the person making the affidavit, known as the affiant, may need to swear before an authorized officer that the statement is true and accurate.

Most people know the term “Miranda rights,” but not everyone knows that it comes from the landmark 1966 Supreme Court case Miranda v. Arizona. Today, let’s take a quick look into the case and its impact.

🔎 The background: When Ernesto Miranda was arrested after being recognized as a victim’s assailant, the police officers that questioned him failed to inform him of his Fifth Amendment right against self-incrimination or Sixth Amendment right to an attorney.

🔎 The argument: Though he did confess to the crime after being interrogated for two hours, his attorney later argued that this failure to inform him of his rights was grounds for the confession to not be allowed at trial.

🔎 The conclusion: The Supreme Court agreed with Miranda’s attorney. This is why police officers must now inform people of their constitutional rights if that person is interrogated while in custody.

If nothing else, I hope this legal history tidbit gives you a bit more knowledge the next time you’re watching Law and Order and hear the familiar “You have the right to remain silent” speech!

Did you know: If an officer did not read you your rights, your case is not automatically dismissed? This is definitely the legal principle I have had to explain to clients the most in my career.

Here’s the truth: Your Miranda rights must be read during custodial interrogation. If not, any statements made may be suppressed, but this does not guarantee case dismissal. The determining factor is whether the suppressed evidence is crucial to the prosecution's case. Additionally, if you do not make any statements, the fact that Miranda warnings were not read to you will not necessarily be an issue in your case.
