They receive requests from various parties, including the ICC President, ICC Chambers, third parties such as ICC counsel, governments, NGOs, and individuals. Before submitting a formal request, it is encouraged to consult with the Amicus Committee.

An "amicus curiae" refers to a person or organization that assists the court by providing relevant information, legal expertise, or a unique perspective. The submission of amicus curiae briefs is a well-established practice in common law jurisdictions and international human rights and criminal tribunals.

Applications for amicus curiae observations before the ICC are governed by Rule 103 of the Rules of Procedure and Evidence. Chambers have the discretion to grant authorization if they find the proposed observations desirable for the proper determination of the case. They may also invite interested persons or entities to submit amicus curiae observations on specific issues.
