AN OFFER TO DANIEL BOONE FROM THE SPANISH GOVERNOR TO EMIGRATE TO UPPER LOUISIANA
Nathan Boone: "About the time my father moved from Point Pleasant to Kentucky, my brother Daniel went down the Mississippi, exploring and examining the country, and hunted and trapped on the upper waters of the Tombigbee River. He did not like that country, and his attention was directed towards Missouri. He had heard something about Missouri when going down the Mississippi.
In the fall of 1797, he decided to go and see the country. Colonel James Smith, the old pioneer and captive, and Joseph Scholl, my brother Daniel’s brother-in-law, agreed to accompany him. Father took an interest in this exploration and even then considered Missouri as his future home. He gave instructions to call on the Spanish governors and make inquiry in his behalf.
He wanted to know the quantity of land granted to new settlers, heads of families and children and servants. He also wanted to know if settlers were required to embrace the Catholic religion. Daniel M. Boone, Colonel Smith and Scholl travelled by boat down the Ohio to old Fort Massac, then across the country to Kaskaskia and Fort Chartres. In Illinois, Smith and Scholl were not pleased with that country; not caring to go further, they returned home.
Brother Daniel went on. He examined the Femme Osage in the St. Charles District, then called on [Lieutenant] Governor [Zenon] Trudeau, who seemed pleased with the idea of having my father settle in the country as the head of a new colony of emigrants.
The governor wrote him a letter on January 24, 1798, expressing his pleasure at the prospect of his settling in Upper Louisiana. He said that if he came, he should have 1,000 arpents of land for himself and that each family who came with him should be entitled to 600 arpents or perhaps 400 for the man, 40 arpents extra for his wife, and 40 acres extra for each child and servant. An unmarried man would have 400 arpents.
Though it was usually required in the Spanish dominions that their citizens should be members of the National Church, it was not enforced so far as American emigrants to Upper Louisiana were concerned.
The priests only resided in the towns and the dense Spanish settlements, and American settlers were left to enjoy their own religious views but without attempting their propagation."

This mural represents the colonial period of Missouri. Daniel Boone is seated at the base of the famous Judgment Tree, with his gun across his knees. He is watching the accusers who have brought a culprit before him, a man with hands bound. Boone held the position of Syndic, or Commandant of the Femme Osage District, Missouri being under Spanish rule. Note the Spanish flag in the background. He was vested with the entitlement of judge, jury and sheriff, and could order the guilty party whipped, banished or killed. Historical accounts say his decisions were widely accepted as fair. - Location: The Senate Chamber in the Missouri State Capitol.
