In response to recent statements from President Biden regarding the negotiation of real estate commissions, it's important to address the potential implications for homebuyers and the broader real estate market. As a Real Estate Broker at EagleWings Realty, I understand firsthand how such policy shifts can significantly impact both buyer’s agents and consumers.

President Biden's assertion that commissions are now negotiable raises eyebrows among industry professionals. The reality is that commission rates have always been subject to negotiation, reflecting the dynamic nature of the real estate market. This oversight suggests a disconnect from the intricacies of real estate transactions.

Moreover, the proposal to shift the burden of paying buyer's agents onto homebuyers raises concerns about affordability. In an already challenging housing market, this change could further strain the finances of prospective homeowners. By adding the cost of buyer's agent fees to their budget, homebuyers face an additional hurdle in their pursuit of homeownership.

This shift in commission responsibility not only impacts homebuyers but also has broader implications for the real estate industry. Many agents who traditionally relied on buyer commissions for their income may see a decline in earnings, potentially disrupting their livelihoods.

Interestingly, while this decision may seem to benefit sellers and listing agents by cutting costs, it ultimately serves to widen income disparities and favor real estate investors. By channeling more money into the pockets of investors, the policy inadvertently exacerbates affordability issues for homebuyers.

In conclusion, the proposal to shift commission responsibility has far-reaching consequences that extend beyond the realm of real estate transactions. As industry professionals, it's crucial to advocate for policies that promote fairness and accessibility in the housing market. Only by addressing the root causes of affordability challenges can we ensure a more equitable and sustainable real estate landscape for all stakeholders.

I have been trained extensively many decades ago in the art of detecting dishonesty and lies. In my previous role, I was employed specifically for this skill, with a track record of 100% accuracy in identifying falsehoods. Despite this proficiency, I inherently maintain a trusting disposition and consistently extend the benefit of the doubt to others.

However, my recent interactions with a dishonest real estate agent have been revealing. Our communication, predominantly through written correspondence on my part and verbal exchanges on hers, has exposed a troubling lack of transparency in her approach. Greed likely played a significant role in the agent's persistent dishonesty and deceitful behavior.

I hurried to send an offer letter on Monday evening, because she stated that her in-laws are in the hospital, stressed-out, and needed to make a quick decision that same evening. However, I received no updates until I reached out to her in writing the following day, on Tuesday morning. She then called me, confirming that they were accepting my offer and assuring me that the signed acceptance would be sent by evening.

She verbally confirmed acceptance of our offer and assured that her sellers, who are currently hospitalized, would sign the acceptance by evening. She explicitly stated that no further offers would be entertained, and the property would no longer be shown. These statements contained revealing cues. However, come evening, the promised acceptance letter was not received.

Wednesday morning, she relayed the surprising news on her very first written communication:
“To my surprise, my in-laws decided to take another offer. The other offer has been signed already, so it is a done deal.” So her in-laws opted for another offer, which had already been signed, solidifying the deal. Disregarding her prior verbal acceptance of my offer.

It seems she was indeed entertaining other offers despite indicating otherwise.

The only conceivable explanation for her in-laws signing another offer would be if she presented them with a competing offer, persuaded them that it was superior, and provided guidance on where and how to sign. This contradicts her earlier verbal acceptance of our offer, where she assured us that ours was the strongest and best offer, and that her in-laws were ready to sign in the evening. She also obviously disclosed the details of my offer to the other party who subsequently outbid my offer the following day after she already verbally accepted our offer. Very unethical and very dishonest.

If she had indeed committed to accepting our offer and signing the contract that evening, I would have placed trust in her word. However, the absence of a written acceptance and formal ratification renders her verbal promise of acceptance dubious, particularly in light of her subsequent acceptance of another offer. A moral compass, if present, should have compelled her to honor her commitment by providing me with a signed acceptance letter.

This unethical conduct and blatant dishonesty she exhibited undermine the integrity of the transaction, casting a shadow on the profession as a whole. It is disheartening to witness such behavior becoming increasingly prevalent among real estate professionals. Tsk tsk tsk

Zillow's Zestimate is notoriously inacurate as it relies on computer generated algorhytm, there is no intelligence in the actual processing of numbers.

On the other hand, a Broker's CMA (Comparative Market Analysis) has a human element which actually collects information, historic sales data, market trends, averages, we look for at least 3 most recent sales which are actual comparables to the subject properties, (i.e., location, age, size, quality, condition, construction, style, square footage, elevation, floor plan, number of bedrooms/bathrooms, etc.) and making adjustments based on differences with comparables.
