We got a new call today regarding a lost Will. Since a Will does not avoid Probate, I advised this new client to file a Probate which would distribute the assets equally to him and his sister. Should a Will be found I would determine it's validity and change the heirs if needed. The client agreed to go forward and file a Probate.

Our new client came to us with a Will which needed to be probated. First, we verified that the Will was valid. We then filed the petition with an attached copy of the Will. The original Will is lodged with the court. Our client is happy to know that her Probate will be handled both professionally and timely.

Since the house was fully paid for, he paid the property taxes and utilities etc. He has 3 siblings and 1 deceased who had children. There was no Will or Trust and due to the rise of real estate prices, all heirs wish to sell the property. He was surprised to know the the property taxes that he paid over the years could be reimbursable.

I advise all my clients not to take an advance on their inheritance due to the high fees. Nevertheless, he insisted--so I helped arrange for him to get a small advance.

WE'RE OPEN and READY to HELP! A new client called us regarding a Probate problem. His spouse passed away without a Will or Trust and the family home is in her name only. After some discussion, I determined that the property would be considered 'community property'. When this is the case, a 'spousal petition' would be filed which would award him a larger portion of the property. When the property is considered community, my client would receive 1/2 the property and since his spouse has 1 sibling, he would split the remaining 1/2 with her. In essence, he would be awarded 3/4 of the property by filing a 'spousal petition'. My client is pleased with the proposed outcome.

I asked that he email the Will to me to determine if it's valid. Once I received it, I determined that I could file a Probate based on the Will. He's happy to move forward!

WE'RE OPEN and READY TO HELP! Our new client was just notified that his spouse passed away. They were living separately for over 5 years but they never divorced. His spouse owned a home in Los Angeles. As a spouse he has priority to be the administrator and since there are no children he would be the sole beneficiary... unless there is a Will or Trust or someone else's name on the deed. I will order a copy of the deed to be sure. He likes that we can help with all aspects of the probate including the sale.

I explained that we can handle the Probate, sell the house (which is her dad's only asset) and distribute the proceeds once the estate closes. Unfortunately he never got around to having a Trust prepared. Our client is the only biological child of her father, but she has a half-brother who is the son of her mom. Her parents are divorced. Since her brother was never adopted by the father, she would be the only heir to the property in the Probate.

WE'RE OPEN and READY to HELP! Today a new client decided to have me prepare a Trust. She owns property and has one adult child who will be the 'successor trustee' and beneficiary of her house. In the time of Covid, I will prepare the Trust based on our conversation using FaceTime since she only has one child and everything will be left to him (normally I would see her in my office). I am very sure that she is 'of sound mind' and not under any undue influence. She's relieved to get this done.

However, he told me that his dad was not his real dad--but his 'step dad' and he was never really adopted. I reassured him that he would still inherit since his mom had passed away less than 15 years from the date of his dad's passing. This is the law in California.
