In the interest of T.D., et al, Children (Mother), the mother appealed a juvenile court’s decision granting physical custody of her children to their father and ordering her to pay child support.  
              
Custody Ruling: The Court conducted interviews with the children in chambers, which the parties agreed would not be taken down by a court reporter.  In superior court, the interviews may not be used as a basis for the final ruling if they are not transcribed; however, since the case was handled under Juvenile court jurisdiction,  the court could consider the interviews even though they were not transcribed. Under OCGA§ 15-11-15(a), (b) Juvenile courts hold the discretion to conduct un-recorded in-chambers interviews of minors and the right to consider the testimony in its ruling. Since the mother did not originally elect to have the interviews recorded, she cannot show that the juvenile court’s decision was made in error, and therefore the ruling was affirmed. 
               
Child Support Calculation: The court agreed with the mother that the father’s supplemental income from side-jobs should have been considered in the child support calculation (see: OCGA§19-6-15 (f) (1) (A) (iii)). They reversed this part of the decision and remanded for a recalculation.   
              
Medical Expenses: The court found no error in the decision to make the mother responsible for 75% of the children’s uncovered medical expenses, given the circumstances and evidence presented.

Crary (mother), who had sole legal and physical custody of a minor child, contested the denial of a motion to declare a grandparent visitation statute unconstitutional, denial of a motion for contempt against Khristel and Frank Clautice (the child's maternal grandparents), and denial of a motion for attorney fees and expenses.

The Supreme Court of Georgia dismissed the appeal regarding the constitutionality challenge as moot since the trial court had already revoked the grandparent visitation order. The court decided that declaring the statute as unconstitutional would have no practical effect on the underlying case and determined that Crary’s request for declaratory relief does not meet the standard in which her constitutional challenges depend.

Additionally, the court affirmed the trial court’s orders denying Crary’s contempt motion and motion for attorney fees and expenses. It noted that Crary had not provided evidence at the hearing to support a contempt finding, and that the trial court was not required to hold a hearing or take evidence before denying the motion for attorney fees and expenses. A hearing on the issue of attorney’s fees is only required if attorney’s fees are going to be granted, so the Court’s decision to deny the award of attorney’s fees did not require a hearing.

Magic Mike actor Channing Tatum has been tied up in divorce proceedings with his wife Jenna Dewan for more than six years. While they both are in new relationships and want to move on, the couple cannot decide how to split the intellectual property from the Magic Mike movies. Tatum claims it is his separate property, while Dewan claims it was developed and co-financed with marital funds.

While the specifics have kept them from settling, the two have attended many settlement conferences. It seems that the lack of agreement has them headed towards trial. Having an experienced mediator on your team can be the determining factor in whether or not your case settles.

A Georgia trial court recently legitimated Rafael Taylor (Father) as the legal father of his biological daughter (C.T.) and awarded him joint legal and primary physical custody of her. During the course of the case, the trial court elected to appoint a Guardian ad Litem (GAL) who represented the best interests of the child. Nikesha Davis (Mother) attempted to appeal the ruling (in part, based on the custody decision), however, it was decided that the trial court was authorized to resolve this question of custody, particularly considering the evidence it was provided, such as the GAL's recommendation based on her investigation.

In November 2022, Mother stopped allowing Father parenting time with their daughter, and on December 5, she filed a motion to suspend Father's parenting time, alleging that Father had physically attacked the daughter. The GAL found that Mother's allegations about the attack were not credible and recommended that the trial court continue Father's parenting time, even before the legitimation was granted. Following that recommendation, the trial court entered an order denying Mother's request to suspend parenting time. At trial, the GAL opined that legitimation was in C. T.’s best interest. She recommended that the trial court award Father primary physical custody due to concerns that Mother was alienating the child from Father. On February 1, 2023, the trial court entered an order legitimating C. T. and on February 7, 2023, the trial court entered a final order that, among other things, designated Father as C. T.’s primary physical custodian and awarded Father child support and attorney fees.

The Georgia Court of Appeals found that the trial court had enough evidence before it, including the GAL's investigation and recommendation, which supported its ruling; therefore, the trial court did not abuse her discretion and her decision was upheld. The GAL's work in this case helped get to the truth of what was going on in this family and what would be best for the child- which turned out to be more parenting time for the Father, even before he was legitimated.

A new bill to be enacted, HB499, will “authorize child support and insurance policies for disabled children who what have reached the age of majority but lack to ability to otherwise support themselves independently...” Once signed into law, this is HUGE for future family law cases as previously there was no mechanism for court ordered support for adult disabled children.

Beall v. Beall, a 2024 Georgia Court of Appeals case, was brought by Andrew Beall (Father) on the grounds that the trial court erred by denying him any parenting time with his child. A temporary order from the trial court (2020) reflected that Mother had primary custody of the child and Father had visitation for two hours each weekday afternoon and Sunday. It also stated that the child shall have no contact with B, the Father’s girlfriend. 
 
The trial court deemed that the Father disregarded the temporary order, that he had lost his support system, and the trail court was unsure if Father was a fit parent. Due to this, the trial court gave Mother sole custody of the child and gave Father NO visitation with the child.
 
The Georgia Court of Appeals found that the trial court abused its discretion by denying Father any and all visitation and found that there were not “exceptional circumstances” that justified denying the Father all access to his child. No visitation is an extremely harsh remedy and was not warranted in this case. Instead, at least supervised visitation should have been granted to Father under these circumstances.
