How are you protecting your company from legal action?
California has long been known for having a challenging regulatory environment for employers. The number of employment actions in California continues to rise, sometimes costing employers millions of dollars. In the most recent data released, the California Department of Fair Employment and Housing reported more than 20,000 employment discrimination claims filed, with the vast majority of those filed by California employment attorneys. Just last month a former employee of Kaiser Permanente Medical Center in Woodland Hills, CA was awarded $41M by the jury in her discrimination and retaliation lawsuit, according to Jakob Emerson at Beckerโs Hospital Review.
In addition to costly discrimination and retaliation claims, employers have been dealing with class action lawsuits, typically joined with California Private Attorneys General Act (PAGA) suits. Since these cases bring multiple employees into the class, the cost to an organization may increase exponentially. California saw a 20% increase in Class Action and PAGA lawsuits from 2022 to 2023 (Michael Nader, et. al, January 12, 2024, www.ogletree.com/insights-resources/blog-posts/the-data-is-in-california-class-action-and-paga-filings-to-hit-new-highs). The rapid increase of class-action suits has also resulted in more plaintiffโs firms entering the wage and hour space, according to Nader. In the end this means more class-action and PAGA lawsuits for small to mid-size companies; it is not just for the big corporations anymore.
